Armenian court confirms violation of ex-president's rights

Armenia's Criminal Court of Appeals has upheld a lower court's decision that investigators violated former President Robert Kocharyan's rights, when they froze his assets last year, News.am said on 24 July.

Kocharyan's bank accounts were frozen in July 2018 days after he was first arrested on charges of overturning the constitutional order stemming from the 2008 post-election violence in Yerevan.

Acting on a lawsuit filed by Kocharyan, a first instance court in Yerevan ruled on 7 June that the asset seizure constituted a violation of his rights. The Prosecutor General's Office considered the decision unlawful and appealed appealed against it at a higher court. The Criminal Court of Appeals, however, rejected the appeal and left the lower court's decision unchanged, the website said.

Kocharyan, who attended the hearing, complained that he had been unable to pay his legal costs during all this period. He said he had been forced to rely on the financial support of his relatives, which, he said, was not an "honourable thing" for him to do.

"This is a practice, when a person is deprived of everything, as well as of the possibility to defend himself, probably with an intention to intimidate and reach some aims," Kocharyan was quoted as saying.

Asked why the investigators had taken 27,000 dollars from his lock box, Kocharyan told the judge that it was probably because of the shock.

"I think because of the shock. When they opened the safe and saw not 4bn but only 27,000, they were shocked," Kocharyan was quoted as saying.

As the judge reprimanded Kocharyan for ironical remarks, noting that the investigators were doing their job, Kocharyan said that he was free to use the language he wanted to defend himself.

"My rights have been violated for a year, they are being violated in an impudent way, and I have the right to speak out about it," News.am quoted Kocharyan as saying.

YEREVAN, JULY 6, ARMENPRESS. OSCE Parliamentary Assembly Political Affairs Committee has adopted a clause proposed by a French delegate, which records that Artsakh issue should be solved exclusively under the format of the Minsk Group Co-chairs based on 3 equivalent principles – non use of force or the threat to use it, territorial integrity and self-determination of nations. The Armenian delegation was able to prevent an anti-Armenian formulation in one of the resolutions, ARMENPRESS reports head of the Armenian Delegation to the OSCE PA Hayk Konjoryan said in a Facebook live broadcast.

He explained that in one of the resolutions there was a formulations saying ''the 7 Azerbaijani regions''. ''And our delegation was able to extract that absurd formulation and it will not be included in the resolution of the OSCE PA', Konjoryan said.

Karén Karslyan to Discuss Contemporary Armenian Revolutionary Movements at Abril Bookstore

GLENDALE—Author Karén Karslyan will release his new book in Armenian titled, “The Regime is in Panic.” The book launch will be accompanied by a special slideshow presentation, as well as a discussion of contemporary Armenian revolutionary movements. The event will be held on Saturday, July 13 at 7:30 p.m. at Abril Bookstore, located at 415 E. Broadway, Glendale, CA 91205. Admission is free with reception to follow. Karslyan will be introduced by activist Hayk Makhmurian.

“The Regime is in Panic,” a documentary tragicomedy consisting of 21.5 acts and 168 dramatis personnae, unearths the roots of the 2018 revolution of love and solidarity in Armenia going as far back as 1996. The most significant movements associated with the presidencies of Levon Ter-Petrosyan, Robert Kocharyan, Serzh Sargsyan, and the premiership of Nikol Pashinyan are depicted from the perspective of the notorious phrase “the regime is in panic.” Various derivatives of this phrase have, for decades, been periodically exploited by numerous public and political figures (such as Nikol Pashinyan, Levon Ter-Petrosyan, Artashes Geghamyan, Zaruhi Postanjyan, etc.). 91 out of 300 pages are Karén Karslyan’s authentic animated illustrations of the following remarkable revolutionary movements: “Levon, Go Away!” (1996); “Struggle, Struggle Until the End” (2008); “The Revolution of Hello” (2013), “Electric Yerevan” (2015), “Hostage Crisis of Sasna Dzrrer” (2016) and “My step” (2018). Some of these illustrations will be exhibited during the presentation at Abril Bookstore.

Directed by Nanor Petrosyan, and staged at the Tech Degh theater, the premiere of the play took place in Yerevan, on June 18.

Karén Karslyan is a poet, novelist, translator, musician, and a visual artist. He is the author of “The Regime Is in Panic,” a tragicomedy (Actual Art, 2019),”Aterazma,” a typographic film/novel (Inknagir, 2016), “Doomed to Spell,” a collection of deformed hayrens (Inknagir, 2010), “X Frames/Sec,” a collection of works including a minimalist novel of the same name and a few poems (Bnagir, 2003). Armenia’s public TV declared him the Scandalous Writer of the Year 2003 for X Frames/Sec. He is the recipient of 2004 Young Artists Award for the manuscript of Password, a novel in progress.

YEREVAN, JUNE 18, ARMENPRESS. Secretary of the Security Council of Armenia Armen Grigoryan had a working meeting with Secretary of the Security Council of Russia Nikolai Patrushev on June 18 in Russia's Ufa city.

As ARMENPRESS was informed fropm the Security Council of Armenia, Secretary of the Security Council of Armenia Armen Grigoryan highlighted the dynamic development of Armenia-Russian allied relations. Grigoryan also presented the economic reforms crried out in Armenia as a result of which Armenia recorded 7.1% GDP growth in the first quarter of tis year, while economic activity index rose by 9.2% in April. Secretary Grigoryan highligthed the role of Armenians living in Russia and Russians living in Armenia for the development of the Armenian-Russian strategic relations.

Secretary of the Security Council of Russia Nikolai Patrushev highlighted the strategic relations etween Armenia and Russia in the sidelines of the CSTO and the EAEU, as well as bilateral relations.

Nikolai Patrushev once again thanked Armenia for providing humanitarian assistance to the people affected by the Syrian crisis.

The sides emphaiszed the absence of an alternative to the peaceful settkement of Nagorno Karabakh conflict.

The implementation of the cooperation plan between the two Security Council Offices was discussed. The side sgareed to hold the next meeting in August in Yerevan.

Ahead of an upcoming meeting with Azerbaijani FM Elmar Mammadyarov in Washington D.C., Armenia’s FM Zohrab Mnatsakanyan held a meeting with OSCE Minsk Group Co-Chairs Igor Popov of the Russian Federation, Stéphane Visconti of France, and Andrew Schofer of the United States of America. Personal Representative of the OSCE Chairperson-in-Office Andrzej Kasprzyk also participated in the meeting in the US capital, the Armenian foreign ministry said in a news release.

“During the abovementioned preparatory meeting the interlocutors assessed the current situation of the peace process, including in the context of implementation of agreements that were reached during previous meetings,” the ministry said.

Ադրբեջանը այսպես կոչված վերելակային դիվանագիտության շրջանակներում որոշ ժամանակ պահպանեց հրադադարի ռեժիմը սահմանին, սակայն դա երկար չտևեց: Օրերս Արցախի սահմանին հայ զինծառայող է զոհվել, իսկ ադրբեջանական զինուժը սկսել է ավելի մեծ տրամաչափի զենքերից կրակել հայկական դիրքերի ուղղությամբ:


Այս ամենը տեղի է ունենում Նախիջևանում թուրք-ադրբեջանական զորավարժությունների պայմաններում: Բաքուն այդ կերպ փորձում է կրկին անգամ փորձել ուժի սպառնալիքի կիրառմամբ հասնել ղարաբաղյան հարցում հայկական կողմից միակողմանի զիջումների:


Հայկական կողմերը հստակ հայտարարել են, որ տարածքներ չեն պատրաստվում զիջել, այսինքն մադրիդյան սկզբունքներն, որոնց շուրջ ընթանում են բանակցությունները վերջին տարիներին, արդեն ակտուալ չեն:


Սակայն համանախագահողներն իրենց կողմից հստակ մեսիջ են հղել Երևանին, որ Արցախի՝ բանակցությունների սեղանին վերադարձն այս պահին անհնար է Բաքվի անզիջում դիրքորոշման պատճառով: Հարցը փակուղի չմտցնելու համար ՀՀ վարչապետ Նիկոլ Փաշինյանը ստիպված է շարունակել բանակցությունները ՀՀ-Ադրբեջան ֆորմատով՝ հանդիպելով նախագահ Իլհամ Ալիևին: Եթե բանակցությունները խաթարվում են, դրա այլընտրանքը լայնածավալ պատերազմն է, ինչը ձեռնտու չէ գերտերություններին, այդ թվում Մինսկի խմբի անդամ ՌԴ-ին, ԱՄՆ-ին և Ֆրանսիային:


Ղարաբաղում լայնածավալ պատերազմը խաչ կքաշի Արևելք-Արևմուտք ուղղությամբ էներգետիկ-տրանսպորտային լոգիստիկայի, Հարավային գազայի միջանցքի վրա, որն ենթադրում է կասպիական էներգակիրների առաքում դեպի Եվրոպա՝ շրջանցելով ՌԴ-ն: ԱՄՆ-ին ձեռնտու չէ լայնածավալ պատերազմը, որը կխաթարի ՌԴ-ն շրջանցող այդ էներգետիկ-տրանսպորտային միջանցքի ստեղծումը:


Ինչ վերաբերվում է ՌԴ-ին, ապա Մոսկվան սերտ տնտեսական, էներգետիկ-տրանսպորտային կապեր է ստեղծում Ադրբեջանի հետ, բացի այդ, ռազմա-տեխնիկական համագործակցությունը նույնպես բարձր մակարդակի վրա է: ՌԴ-ն չի ցանկանում իր հարավային հարևանի՝ Ադրբեջանի ապակայունացում, որը կանդրադառնա նաև ՌԴ-ի Հյուսիսային Կովկասի վրա: Դրան զուգահեռ ՀՀ-ն ՌԴ-ի թիվ մեկ ռազմավարական դաշնակիցն է Հարավային Կովկասում՝ ՀԱՊԿ-ի անդամ դաշնակից, ինչը նշանակում է, որ ՀՀ-ի դեմ ադրբեջանական ագրեսիայի դեպքում ռուսական զորքերը պետք է կանգնեն ՀՀ-ի ու հայ ժողովրդի կողքին:


Սակայն գեոպոլիտիկայի մեջ առկա է այսպես կոչված «սև կարապի» («чёрный лебедь») ֆենոմենը, այսինքն երբ տեղի են ունենում չնախատեսված զարգացումներ, որոնք փոխում են ողջ գեոպոլիտիկ լանդշաֆտը: Այդպիսի «սև կարապ» էր նաև 2016թ.-ի ապրիլյան քառօրյա պատերազմը: Ոչ ոք չէր կանխատեսում Ադրբեջանի կողմից այսպիսի ռազմական գործողություն. Բաքուն, գտնելով հարմար ժամականահատվածն ու բացերը հայկական դիրքերի ու առաջնածի մեջ, անցավ հարձակման և գրանցեց հաջողություններ: Բաքուն գրավեց որոշակի դիրքեր Արցախի հյուսիսում և Լելե Թեփե բարձունքը Արցախի հարավում: Դրանք ապագա լայնածավալ պատերազմի համար պլացդարմներ են ընդդեմ Արցախի:


Ադրբեջանը կարող է ստանալ Թուրքիայի աջացկությունն ու օգտվելով ՀՀ-ի ներքաղաքական լարված զարգացումներից, այդ թվում ՀՀ-Արցախ հակասություններից, սխալ հաշվարկ կատարել՝ հույս ունենալով, որ հայկական կողմերը զբաղված են միմյանց դեմ պայքարելով ու անցնի հարձակման՝ չստանալով գերտերությունների  լուռ համաձայնությունը կամ չեզոք դիրքորոշումը:


ՀՀ-ն ու Արցախը պետք է զգուշանան Բաքվի անկանխատեսելի պահվածքից, որը կարող է հիմնված լինել սխալ հաշվարկների վրա՝ ՀՀ-ում ներքաղաքական լարվածություն, Արցախում նախընտրական իրավիճակ ու ներքին հակասություններ Արցախի էլիտաների միջև ու հայ-ռուսական հարաբերություններում նկատվող որոշակի խնդիրները:

Legal Dissonance in Armenia

The events connected with the arrest and then the re-release of the second President of Armenia, Robert Kocharyan, gave rise to a political resonance in Armenia, comparable to a seven-point earthquake. The judge, who made the decision to release Kocharyan from the courtroom, forced political forces not only in Armenia, but also in Artsakh to play in the open, laying all the cards on the table. For society, as a whole, this is a positive phenomenon, because it allowed us to produce a kind of lustration of all political forces and show the people who is who and who protects whose interests. As for the judicial system as a whole, the fundamental reform of which was spoken a year ago, this court decision was the last straw for breaking the old judicial system — corrupt from top to bottom, starting with the Constitutional Court — and building a new one.

It should be noted that Armenia received positive feedback from Europe and the United States on this decision of the government. Thus, the PACE co-rapporteurs on monitoring in Armenia, Yulia Levochkina and Andrei Shirchel, stated that the independence of the judiciary is a necessary condition for the rule of law and is best ensured by the absence of any interference from political actors. The US Embassy issued a statement saying, in particular, that the United States is ready to help strengthen an independent judiciary in Armenia, which includes efforts against corruption and the formation of rule of law institutions. Senior expert of the International Center for Transitional Justice Ruben Carranzan arrived in Armenia.

However, in all statements of Western circles, it was emphasized that reforms in the judicial system and vetting should be carried out strictly within the law. And some did not support Pashinyan at all. Thus, the former Polish ambassador to Armenia, Marek Novakovsky, stated that “he was surprised that the Prime Minister of Armenia Nikol Pashinyan appealed to block the buildings of the courts.” The ambassador is concerned that the stock of public confidence granted to Pashinyan may quickly run out.

A year ago, experts spoke about the reforms not only of the judicial system, but also of the importance of the immediate adoption of laws on property, parties and elections. However, could these laws be drafted and adopted, taking into account today's realities, if the Basic Law – the Constitution, which was written to legitimize the power of one person Serzh Sargsyan – remained and now remains unchanged? Of course not.

During this time, it would be possible to write a new constitution in accordance with the spirit of the time, discuss and adopt it. Now, if we want to adopt a new law or reform the judicial system, there have always been and there are still people and organizations who claim that the law or reform does not comply with the Basic Law and all actions of law enforcement officers are aimed at settling accounts by the new government. As a result, all suspects flee to Russia, which does not betray its "own," turning them into political martyrs. And this is despite the fact that in Armenia they are not persecuted for political reasons, but for purely criminal cases. This, of course, is Russia's business, but it should be noted that such an approach does not clearly increase the percentage of the pro-Russian-minded population of Armenia.

Here we are in such troubled times. The absence of a property law gives rise to constant disputes in society — why a bribe-taker who plundered the country was not imprisoned, and he is walking free. But this law could clearly distinguish the difference between the stolen or legally earned. In this case, the courts could make the right decisions, and the people would be happy, because everything stolen would go to the treasury. And so, all corrupt officials are quietly walking around in Armenia, and if they feel the danger, they immediately flee to Moscow. Our law enforcement officers, with enviable consistency, give them the opportunity to escape from the country, and then make excuses that they cannot be caught. Only it is not clear who is deceiving whom.

Of course, vetting, about which people talk so much, is necessary. However, it will not be able to solve all the above problems without adopting a new Constitution.

  

Asbarez: 4th Class of Students Graduate from UWC Dilijan

DILIJAN, Armenia—UWC Dilijan celebrates the graduation of its 4th class of graduates—104 international students. With this, the school sends 104 young ambassadors with a knowledge of, and connection to, Armenia into the world.

Founding Partner and Chair of the Board of Governors of UWC Dilijan Veronika Zonabend, Member of the Board of Governors of UWC Dilijan, President of the Board of Directors of the Free University of Brussels Pierre Gurdjian, his excellency ambassador of Armenia to Japan Hrant Poghosyan, Professor of Paro College of Education, Bhutan, Kinzang Lhendup will be present at the graduation ceremony. Donors, community and guests from all over the world will arrive in Dilijan to celebrate the special day with students. The graduation is the culmination of series of events that take place on May 31 and June 1, including a tree planting ceremony and a thank you event for donors.

“Graduations are emotional landmarks in all schools. At UWC Dilijan, our soon-to-be-graduates have an additional emotional layer, as most of them will leave Armenia, a country that has been their home for two years. One could argue that Armenia now has a new cohort of ambassadors from all over the world. Graduations are also a moment of pausing to take stock of the progress made and to celebrate the successes and the failures, as they all are learning opportunities. We are very proud of each of our students’ individual paths and cannot wait to see what they will achieve as they follow their passions,” stated Gabriel Ernesto Abad Fernandez, Head of UWC DIlijan College

“I literally started from nothing. Before this I never traveled abroad, and everything happening was a challenge for me. I could not even speak proper English and the language barrier was immense for me. However, not giving up and doing my best to succeed paid off. Not everyone has been given a chance to study at this amazing school, let alone on a full scholarship, like me. This made me proud and at the same time I felt like I had no chance to let those people down. People who had faith in me, and believed in me. UWC Dilijan gave me the chance to become the person that I dreamt to be. We here are as a one big family. Caring for each other, helping each other and holding each other when the times are tough. I am endlessly grateful as this has been the experience of my life. I know that everything I learnt from here is going to guide me throughout my life, no matter where I find myself in the future,“ said Aido, a UWCD class of 2019 graduate from Iraq. The graduating class’ students come from 61 countries, with 79% of graduates on scholarships supported by the generosity of donors. Students are accepted based on merit, and not the ability of their families to afford tuition. Some of the current scholarships are named after Lamya Haji Bashar, Amal Clooney and Charles Aznavour.

YEREVAN, MAY 31, ARMENPRESS.  An investigative committee has been set up in the National Assembly of Armenia to examine the circumstances of April 4-day war that took place in 2016, ARMENPRESS reports President of the National Assembly Ararat Mirzoyan said.

Mirzoyan informed that 47 MPs have requested to set up the committee.

The President of the National Assembly also informed that another committee will be set up by the request of 1/4th of the total number of the MPs that will delve into the issue of water recourses.

During the May 20 consultation PM Pashinyan had announced that it’s already time to set up a parliamentary investigative committee into the April war details to find the answers of a range of issues of public interest.

The war between Artsakh and Azerbaijan named April war or the 4-day war took place in 2016 when the Azerbaijani troops made a sudden large-scale attack against Artsakh. The war lasted 4 days and ended on April 5, when the Chiefs of Staff of the Armed Forces of Armenia and Azerbaijan signed a ceasefire agreement in Moscow. The borderline between Artsakh and Azerbaijan remained nearly  unchanged following the war, but the Azerbaijani troops suffered at least 5-fold more casualties than the Armenian side, estimated at 558.

Co-Chairs Say They Have ‘Concrete Steps’ for Karabakh Peace

After a four-day visit to the region, the OSCE Minsk Group co-chairmen—Igor Popov of Russia, Stéphane Visconti of France, and Andrew Schofer of the United States—issued an announcement Thursday in which they said that they proposed concrete steps for the Nagorno-Karabakh conflict resolution process.

During their latest visit, the co-chairs, along with the Personal Representative of the OSCE Chairperson-in-Office, Andrzej Kasprzyk, met with officials in Yerevan, Baku and Stepanakert to assess the latest development in the region.

Below is the text of the announcement.

The Co-Chairs of the OSCE Minsk Group, together with the Personal Representative of the OSCE Chairperson-in-Office, Andrzej Kasprzyk, visited the region from May 27 to 30.

The Co-Chairs met with Prime Minister Nikol Pashinyan in Yerevan on May 27 and with President Ilham Aliyev in Baku on 30 May. In both capitals, they held consultations with the respective Foreign Ministers and Defence Ministers. On May 28, the Co-Chairs met with the de facto authorities in Nagorno-Karabakh. In Baku, the Co-Chairs met with the Chairman of the Azerbaijani Community of Nagorno-Karabakh. While in Nagorno-Karabakh, the mediators were briefed on humanitarian issues by the local representative of the International Committee of the Red Cross.

The main purpose of the visit was to assess the evolution of the situation on the line of contact and the international border, and to follow up on the discussions held by the Azerbaijani President and the Armenian Prime Minister in Vienna on March 29 and their respective Foreign Ministers in Moscow on April 15.

As requested, the Co-Chairs provided proposals for concrete next steps in the settlement process, including on humanitarian and security measures. The Foreign Ministers of Armenia and Azerbaijan accepted the Co-Chairs’ proposal to meet soon under their auspices, and will announce details at the appropriate time.

The Co-Chairs expressed deep concern about recent casualties and called on the parties to exercise maximum restraint to avoid escalation.
