International round table on the anti-corruption expertise of legal acts
and draft laws in Moscow

Strasbourg, 23.06.2008 – A round-table discussion on how to make sure
that the legislative process in Russia and other countries in Eastern
Europe and Asia is not vulnerable to corruption will take place in
Moscow on 24 and 25 June. The meeting aims to discuss techniques for
assessing the corruption risks to laws.

Participants will include different ministries, expert organisations,
NGOs and academics, international organisations, regions of Russia as
well as representatives from Moldova, Belarus, Lithuania, Latvia,
Azerbaijan, Armenia, Kazahstan and Uzbekistan.

The event is being organised by Europe’s leading democracy and human
rights watchdog, the Council of Europe, together with the Security
Committee of the Russian State Duma, Ministry of Economic Development
and Centre for Strategic Research.

Miklos Haraszti, the OSCE Representative on Freedom of the Media,
today condemned the five-month prison sentence handed down to Turkish
publisher Ragip Zarakolu for "insulting the institutions of the Turkish
Republic" despite the fact that Article 301 of Turkey’s Penal Code
was recently reformed.

"It is disappointing that despite recent changes in the law, serious
obstacles to free speech in Turkey remain. People are still jailed
for publishing peaceful ideas," said Haraszti. "Freedom of debate in
Turkey will increase only if the government stops trying to control the
debate in the first place. Article 301 must be abolished altogether."

Following a reform of Article 301 in April, the maximum prison
sentence was reduced from three years to two, and the crime of
"insulting Turkishness" was changed to "insulting the Turkish nation".

On 17 June, an Istanbul court found Zarakolu guilty of "insulting
the institutions of the Turkish Republic" for publishing a Turkish
translation of "The Truth Will Set Us Free" by British author George
Jerjian. The book covers the killings of Armenians in 1915.

The sentence is commutable to a monetary fine, but Zarakolu has
said he opposes paying the fine on principle and will appeal the
verdict. Following the amendments, cases under Article 301 must be
referred to the Justice Ministry. However, the judge decided not to
refer Zarakolu’s case on the basis that it was launched under Article
159, an earlier version of the current Article 301 of the Penal Code.

"Regardless of the legal dispute over this particular case, publishing
a book critical about a country’s history should not be criminalized
in a democracy. The Helsinki principles, to which OSCE participating
States including Turkey have committed, provide for the free flow of
information and ideas," said Haraszti.

In May 2008, Zarakolu was the recipient of the International Publishers
Association’s Freedom to Publish Prize.

Russian, Armenian Police Chiefs To Sign Cooperation Agreement

YEREVAN, June 20 (Itar-Tass) — The senior officials of Russia’s
Interior Ministry and Armenia’s police force will gather for a
joint conference in Yerevan on Friday to consider joint search for
criminal offenders and missing persons. Taking part in the event
will be Russian Interior Minister Rashid Nurgaliyev and his Armenian
counterpart Alik Sargsian.

Upon arrival in Yerevan Nurgaliyev said the Russian Interior Ministry
and Armenia’s police were determined to step up cooperation in the
search for criminals and missing persons.

According to the inter-state data bank over 119,000 names are on the
inter-state list of persons wanted for committing criminal offences,
including 71,000 wanted by Russian law enforcers. Armenia has declared
the search for 13,000 criminals.

Nurgaliyev said the Russian Interior Ministry and the Armenian
police will employ the entire potential that there exists and take
all necessary measures to make detective work more effective.

"In 2007-2008 Russian transport police detected and detained 240
wrong-doers whose names are on Armenia’s wanted list," he said.

Also, Russian and Armenian police officials will discuss matters
related to the investigation and solution of inter-regional crimes
committed in the territories of Russia and Armenia.

"A number of documents, including an agreement on cooperation between
the Russian Interior Ministry and the Armenian police force will be
signed," Nurgaliyev said.

The application of the "genocide" expression by George Bush, the
President of the United States, will not be useful for Armenian-Turkish
relations. As the Turkish press reports, this statement was made by
Danniel Fried, the U.S. Assistant Secretary of State for the Bureau
of European and Eurasian Affairs, during the hearings organized in
the Foreign Affairs Committee of the House of Representatives of
U.S. Congress.

This statement of the U.S. Assistant Secretary of State was made in
response to the question of Congressmen of "why does not President
Bush use the "genocide" expression?"

"The United States of America and President Bush have never refused
those events. However, when speaking about those events we do not
use the "genocide" expression. Its application will not be favourable
either for Armenian-Turkish relations, or for Turkey, from the point
of view of taking into consideration its own history," Daniel Fried
stated.

Armenian Foreign Minister Edward Nalbandian who is in Brussels on a
working visit met today with the European Union High Representative
for the Common Foreign and Security Policy (CFSP) Javier Solana.

Armenian Foreign Ministry press service told Armenpress that during
the meeting the interlocutors discussed Armenia’s and EU’s cooperation,
pace of implementation of the European Neighborhood Policy Action Plan,
post-electoral developments in Armenia, as well as issues connected
with the regional security.

Armenian foreign minister reconfirmed the determination of the Armenian
authorities to continue reforms towards consolidation of democracy
in the country.

E. Nalbandian also presented to Javier Solana the current situation
over Nagorno Karabakh conflict regulation process and the results
of the meeting of the Armenian and Azerbaijani presidents in Saint
Petersburg.

They also referred to the issues on regional security and stability.

On the same day Nalbandian conducted meeting with his Belgian
counterpart Karel de Gucht. During the meeting the sides positively
assessed the dynamically developing cooperation between the two
countries.

Minister Nalbandian said he is pleased with the active trade ties
established between the two countries and noted that there exists
serious potential for their expansion.

They also noted about the importance of activating the political
dialogue. The sides also effectively assessed the cooperation within
international organizations.

While L. Ter-Petrosyan seeks to maintain the tension

In the post-electoral period, especially during the past 2-3 months,
our domestic policy agenda has developed into a long series of
proposals and formats which are introduced in a consistent manner and
rejected quite speedily.

The events develop in the following succession: the regular
idea-proposal on a dialogue between the authorities and the opposition
is advanced, some discussions begin, then some of the political figures
and members of society become enthusiastic while others express
moderate optimism and finally, the pan-national movement, on behalf of
L. Ter-Petrosyan, publicizes its regular rejection. And everything
returns to the same starting point.

Any attempt, proposal or format aimed at relaxing the tension is
estimated by the self-declared `supreme body’ as an imitation of a
dialogue which immediately loses its sense without even starting.

Such was actually the fate of the necessary and useful idea of
establishing a Public Chamber. Judging by all, the same prospect is in
store for the proposal aimed at setting up an interim parliamentary
committee conducting a comprehensive investigation of the March 1-2
events.

A question arises as to what causes this particular part of the
opposition to demonstrate such self-confident persistence when the
authorities do not absolutely isolate them from the political
processes. On the contrary, the opposition is currently free to appear
on the Public TV Channel and voice its opinion. Let alone the press,
which grants the pro-opposition figures unlimited opportunities for
conducting advocacy.

In the meantime, communications, meetings and discussions are
periodically organized between society on the one hand and the
representatives of the Government on the other. Beginning an active
dialogue with the outstanding scholars, artists, public and political
figures, the top figures of the Government are seeking optimal ways
towards the solution of the complex problems faced by the country. All
this testifies to the fact that they are ready for a dialogue both with
the opposition and society.

Along with increasing the publicity of the government’s activities, the
instructive posture of the opposition and its leader creates an obvious
misbalance on the political arena. There appeared a person suffering
from the complex of faultlessness and, like the `father of the
nations’, knows everything in advance; therefore, he decides on his own
that such initiative only brings harm to the country. With the help of
several official and non-official evaders, Ter-Petrosyan currently
advances the idea that the future dialogue may only be devoted to the
selection of the method of ceding power.

What causes such intolerance and obvious maximalism when the
international community and the observers who followed the recent
elections formulated a different kind of task for initiating a dialogue
between the authorities and the opposition? They hold the viewpoint
that the presidential candidate who received 21 percent of votes should
recognize the legitimacy of the authorities, and the authorities, in
turn, are obliged to investigate the March 1-2 events, release the
individuals detained for their political views etc.

It may seem to some people that the in-depth reason of such arrogant
behavior is the expectation of a new wave of the `pan-national
movement’, prior to which the opposition is speaking in the language of
ultimatums. However, June 20 will arrive, and it will become obvious
that the pro-Ter-Petrosyan team just wanted to extend its `mission’ in
the capacity of the opposition leader. And this is all.

As a matter of fact, all the attempts of the authorities towards
improving the situation and extending the rights of the opposition
receive a sharp counteraction by Ter-Petrosyan’s team for a very simple
reason. The essence of the big political bluff skillfully orchestrated
by Ter-Petrosyan and his political team was to bring the authorities
face to face with unsolvable challenges by way of escalating the
political tension to its zenith rather than seize power and gain an
influential position in the country’s political life. Having achieved
their objective, i.e. splitting and polarizing the political arena,
Ter-Petrosyan and his political team are pursing one goal: to assert
the fact of hostility and polarization and on their basis, bring
Armenia face to face with the continuing pressure and increased
internal instability.

Therefore, if there starts a serious political dialogue, the March 1-2
events are investigated, a Public Chamber is set up etc., Ter-Petrosyan
and his team will be deprived of the opportunity of realizing their
objectives dictated by external impulses and will find themselves in
the status of people who are `politically unemployed’.

And because some individuals obviously need `significant instabilities’
while our country and people are in need of a peaceful and prosperous
life, the authorities should direct their attempts at initiating a
dialogue with the public vs. the opposition and involve larger and
larger groups of society in the process.

Official Baku thinks it’s "absurd to engage the Armenian community
of Nagorno Karabakh in the negotiation process," according to an
Azeri official.

"Azerbaijan is not going to engage the Armenian community of Nagorno
Karabakh in talks because it is negotiating with Armenia," said Novruz
Mammadov, head of the foreign relations department at the Azerbaijani
presidential executive administration.

"Should Armenia quit the process and pledge not to interfere anymore,
the issue will be possibly considered in the future," he added.

"Azerbaijan can agree to negotiate with the Armenian community of
Nagorno Karabakh, but only in case the definite issues regarding joint
habitation of Nagorno Karabakh’s Azerbaijani and Armenian communities
after striking a peace agreement are solved, which is unlikely to

Armenian Foreign Minister Edward Nalbandian held meetings with heads
of diplomatic representations accredited to the republic, the RA MFA
press office reported.

At a meeting with Russia’s Ambassador Nikolay Pavlov, the parties
discussed issues referring to the forthcoming visit of the Russian
President to Armenia.

The Minister also met with Ambassadors of Sweden, France, Ukraine,
Brazil, Romania, India and Italy as well as the head of the OSCE
Yerevan Office to discuss current relations between the states and
ways of their development.

10th San Francisco Black Film Festival (Part One)

To write about the San Francisco Black Film Festival is not to give
hosannas at discovering a previously unknown film festival. This black
film showcase has thrived very well for ten years. Writing about the
festival, then, needs to be a giving thanks for exposure to films
not seen at other local festivals.

"The People’s Advocate: The Life And Times Of Charles
R. Garry" reacquaints viewers with one of San Francisco’s
most famous (or notorious, depending on your point of view) criminal
defense attorneys. This advocate gained fame during the 1960s with
his vigorous defenses of various leftist personalities, principally
Huey Newton, Bobby Seale, and other members of the Black Panther Party.

Director Hrag Yedalian’s documentary takes a "just the
facts" approach to depicting Garry’s life. The viewer is
thus treated to period news footage, interviews with Garry’s
contemporaries, and a near overuse of title cards. It is suggested
regular exposure to anti-Armenian prejudice (Garry was actually
Armenian) predisposed the future attorney to use his legal skills on
behalf of other discriminated groups.

Former Black Panthers talk about how the attorney understood implicitly
the injustices that the black power group opposed. Garry displayed a
gift for turning the courtroom into a lectern to show Middle Americans
just how clueless they were about black culture. One jaw-dropping
anecdote in the film concerns Garry’s questioning potential
jurors on their knowledge (if any) of singer James Brown or the song
"Papa’s Got A Brand New Bag."

However, the police outpaced the civilians in the cluelessness race
when it came to understanding the rising leftist movements of the
1960s. Having shinier shoes and newer jeans than that worn by the
typical anti-war activist is not a recipe for blending unobtrusively
into a protest group. Garry successfully exploited police ignorance
in the courtroom through such tactics as getting cops on the witness
stand to inadvertently damn themselves as rat finks.

The attorney’s empathy for leftists fighting oppression
eventually turned out to be a mixed blessing. That talent may have
allowed him to vigorously represent controversial leftists such
as Los Siete. But it also blinded him to the fatal madness of the
Reverend Jim Jones. Garry’s enchantment with the progressive
dream offered by Jones’ People’s Temple led to his becoming
a public apologist for the Temple. The act of becoming an unwilling
presence near the mass Jonestown suicides hit the attorney with the
world’s nastiest reality check. Yedalian’s film states the
attorney never recovered emotionally from that shock.

The material described above is dramatic and humorous and even
tragic. So why does "The People’s Advocate" feel so dull
and shallow?

Yedalian makes the mistake of keeping Garry’s life mounted on
a pedestal. Treating him as generally flawless undercuts objective
assessment of the attorney’s work. The cops who clashed with Garry
over the years or less enthusiastic co-workers at Garry’s firm
needed acknowledgment in the film. Such acknowledgment need not be
agreement with their opposing positions. But even non-flattering
appraisals can provide necessary perspective on Garry’s
achievements.

How much of the film’s emotional shortcomings derived from
its apparent presentational shortcuts (e.g. excess use of title
cards)? It’s unclear. But the resulting film does a disservice to
an important participant in some of the 1960s’ biggest historical
flashpoints.

"Evolution of the Hill"

The titular Hill in "Evolution Of The Hill" turns out to
be Brooklyn’s Clinton Hill neighborhood. But the evolutionary
force discussed in this short film will be familiar to displaced
black San Francisco residents. It’s gentrification. Director
Samori Amir Toure allows various Clinton Hill residents a chance
to voice their feelings about the steady gentrification of their
neighborhood. Toure tries to maintain a balance of voices. But the
most memorable pro-gentrification voice belongs to that of the white
cookie cutter condo owner.

More importantly, the film’s best line belongs to an
anti-gentrification world studies teacher. This word called
"gentrification" is nothing less than colonialism under a
different name.

"Music is My Life – Politics is My Mistress"

Why wasn’t Oscar Brown, Jr. better known outside of American
jazz aficionado circles? His introductory song for the character of
Mr. Kicks came with an infectiously bopping beat that could seduce a
listener within a couple of minutes. Brown worked with such talents
as Abbey Lincoln, Max Roach, and Muhammad Ali. Even in old age, the
jazz musician remained a witty and entertaining raconteur who could
describe old age as "moving into a really bad neighborhood."

Despite these strengths plus the admiration of Miles Davis and John
Coltrane, the Chicago native generally remained more highly regarded
by his musical peers than by the American public.

Donnie Betts’ film "Music Is My Life – Politics My Mistress
– The Story Of Oscar Brown" successfully works to re-introduce
viewers to this singular artist’s music. It also pairs Brown’s
music with a warm portrait of a very funny and perceptive man.

Betts eschews a strict chronological structure for his film. Its
form is instead that of a well-crafted jazz piece, one drifting back
and forth in time following various themes in Brown’s life. For
example, the thread tracing Brown’s career in electoral politics
turns into deadpan farce. How else could one describe the career
of someone who ran at various times on the Communist, Democratic,
and Republican campaign tickets?

Brown’s life turns out to be an object lesson in the vagaries
of heritage and luck. Two noteworthy Chicago theaters and black
neighborhood life proved greater formative influences on the young
musician than his father’s law practice. Yet Brown’s political
activism turns out to be a spiritual inheritance from his father. The
older Brown had been active in the NAACP and a failed effort to make
the 49th American state a haven for African Americans. The frustrated
promise of Brown’s theatrical career becomes an ironic study in
how luck can be an unfaithful lover to the immensely talented.

One is amazed at Brown’s musical alchemy on often depressing
realities. His ability to observe and capture just the right detail
does not prevent him from simultaneously exercising his gift for
creative playfulness. A memorable song-story of a Harlem jitney
captures the hilarious unpleasantness of forced seat sharing with a
very odiferous homeless man. The Sisyphean battle with continually
breeding cockroaches turns into a humorous declaration of endless war.

Brown may have entertained people first. But his art didn’t ignore
controversies in the African-American community. His "Freedom
Now Suite" collaboration with Roach was one of the first jazz
treatments of the civil rights movement. That collaboration ran into
creative difficulties, though, when Brown played Martin Luther King
to Roach’s Malcolm X. The musical revue "Opportunity Please
Knock" was an implicit indictment of American society’s
willingness to abandon troubled black youth. That indictment became
more pronounced when one knew that Brown’s revue collaborators
were the Blackstone Rangers, a notorious Chicago street gang.

Did conservative opposition cripple Brown’s musical career? One
does not appear on a Web list of "treasonous" artists by
keeping politically quiet. Brown’s own unapologetic smoking of
a farm’s worth of marijuana certainly didn’t endear him to
the "just say no" types. Yet bad luck and Brown’s own
personal failings certainly played their part. Had Brown taken up
Burgess Meredith’s suggestion to adopt the lead role in "Kicks
& Co.," perhaps the musician’s theatrical fortunes would have
been far more different.

Betts’ film doesn’t ignore Brown’s painful personal
flaws. The musician’s infidelities led to the collapse of two
marriages and some noticeable resentment among his children. The
commercial failure of "Kicks & Co." becomes more painful
when one learns just how much gifted creative talent and financial
resources were lost thanks to Brown’s failure of nerve.

In the end, though, Betts’ lively delight of a film will spark
renewed interest in a semi-forgotten jazz master. Brown deserves a
higher accolade than being the jazz world blend of Ron Sexsmith and
Rodney Bingenheimer.
