AZERI POW ‘RESISTING REPATRIATION’

An Azerbaijani soldier who was taken prisoner by Karabakh Armenian
forces earlier this month claims to have been badly mistreated by his
commanders and fellow conscripts and does not want to be repatriated,
according to the authorities in Stepanakert.

Vusal Garajayev reportedly crossed into the Armenian-controlled
territory east of Karabakh on December 7. The International Committee
of the Red Cross has since been trying to negotiate his repatriation.

In the words of Arkady Ghukasian, president of the self-proclaimed
Nagorno-Karabakh Republic, the 19-year-old "consciously crossed"
the heavily fortified frontline to escape systematic hazing at the
hands of other Azerbaijani servicemen.

"According to his accounts registered by representatives of the Red
Cross, he was regularly and continuously beaten by fellow soldiers,"
Ghukasian told reporters in Yerevan.

"That soldier has been placed at the disposal of the International
Committee of the Red Cross which is holding negotiations with
relevant structures in Azerbaijan," he said. "At least until now,
he has said that he does not want to return home because he does
not want to again face the people who beat him and because he fears
government retribution."

The Azerbaijani Defense Ministry dismissed this version of events as
"Armenian propaganda," saying that Garajayev accidentally strayed into
Armenian-controlled territory. "Vusal Garajayev will be repatriated
to Azerbaijan," a ministry spokesman told the Day.az news service.

Ghukasian made it clear, however, that the conscript will not be
sent back to Azerbaijan against his will. "That said, I am sure the
Azerbaijani authorities will put pressure on his parents and relatives,
and they will eventually convince him to come back," he said. "And I
assure you that this lad will face lengthy imprisonment in Azerbaijan."

Prisoner-taking happens regularly along the Armenian-Azerbaijan
line of contact in circumstances that are not always trivial. In
some cases, soldiers were clearly not captured by force. In January
2005, for example, four Armenian soldiers who spent several months in
Azerbaijani captivity were arrested and prosecuted immediately their
repatriation. Military prosecutors said that they willingly crossed
into Azerbaijani territory and "came into contact with the enemy."

A few weeks later, three Azerbaijani soldiers crossed the frontline
in similar circumstances. They were subsequently repatriated and
reportedly faced prosecution in Azerbaijan.

TEHRAN (Fars News Agency)- Armenian Foreign Minister Vartan Oskanian
stressed the need for the fair settlement of Iran’s nuclear issue
through negotiations.

Speaking to reporters in a joint press conference with his Iranian
counterpart Manouchehr Mottaki here on Sunday, Oskanian said that
his country follows all nuclear issues at the UN and other world
organizations, and said, "We would like the issue to be resolved
fairly, through talks and with full respect for all countries’ assured
and inalienable rights and not through pressures and sanctions."

Elsewhere, he viewed Iran-Armenia relations as uptrend, stressing
that the high level of relations between Tehran and Yerevan is a
product of the two nations’ strong desire for such ties.

Noting the Iranian foreign minister’s statements about the strong
bonds between Iran and Armenia, Oskanian said, "Our friendship has
its origin in history and it enjoys fortified foundations. Nothing
can undermine this friendship."

The Armenian foreign minister further evaluated Iran’s stances on
regional issues as excellent, and named Iran as an important state
in the region.

Armenian President Robert Kocharyan has urged the political forces
of the country not to use possible ballot-rigging for electioneering.

Commenting on the parliamentary elections to be held in 2007, the
president also said that political parties funded from abroad pose a
danger to the country’s security. At the same time, Kocharyan denied
that the Karabakh negotiating process will be suspended until the
elections in 2007, saying that the talks will only slacken. He also
denied reports of disagreements within the ruling team and praised
the country’s economic development. The following is an except from
report by Armenian Second TV Channel on 15 December. Subheadings have
been inserted editorially:

[Public TV correspondent Armen Arzumanyan] In the run-up to the
elections, some people in our country often speak about possible
election fraud and even planned fraud. Naturally, the authorities
say that everything will be fair, but the opposition says everything
will be rigged. The Electoral Code has been amended once again. Will
this give us an opportunity to hold a free and fair [parliamentary]
election?

President warns against using fraud for electioneering

[Armenian President Robert Kocharyan] You are right in saying that
it has become a tradition in Armenia to use election fraud for
electioneering. This is done mainly by the parties or politicians
that do not have a real opportunity to gain votes. Their purpose is
clear. If they do not gain the votes they want, they can always speak
about the legitimacy of the future authorities and in doing so, can
find their political niche in the next five years. If they gain votes,
they can say that these votes have been gained by them and they are
decisive to attain their goals.

Let us try to understand who will falsify the election results and
how? There is the Central Electoral Commission and the regional
and district commissions. They are responsible for organizing the
elections and the entire voting process. If the elections are rigged,
they are rigged in these electoral commissions when votes are counted
and the first results are made public.

Who forms these electoral commissions? According to the new law, the
president nominates one person. It is supposed that the judiciary will
nominate one person as well, but it is still a draft law. The other
seven members of the commission will be appointed by parliamentary
factions and groups.

A small country in a complicated region

[Armenia TV correspondent Gagik Lazarian] Mr. President, what impact
will external forces have on the election process, especially given
the fact that the Karabakh issue has not been settled yet?

[Kocharyan] Armenia is a small country in a complicated region and
it is clear that it will be influenced in various ways. It would
even be insulting if the states that have interests in this region
did not try to influence us. This would mean that they do not need
us and Armenia is not an important state. If we look at seminars
and conferences held in Armenia and those who finance them, it will
become clear what sort of foreign forces are trying to influence the
political field of Armenia. I mean if you look at grant programmes
and the affiliation of certain media outlets. This causes certain
problems for the national security of Armenia. We cannot resist all
this. We should be flexible and conduct comprehensive explanatory
work. Our people should understand that the political forces which
come to power with foreign funding or support from external forces
are dangerous for the state. The authorities should be pro-Armenian,
Armenia-centric and be loyal to our national interests. This is the
direction that will guarantee a secure future for Armenia.

[Arzumanyan] You said that it is dangerous to try to settle the
Karabakh conflict during the election period.

[Kocharyan] It is not dangerous. I do not want the Karabakh settlement
to become hostage to the election campaign as it is impossible to
expect impartiality.

[Arzumanyan] Does it mean that the Karabakh talks will be suspended
till the end of the presidential election [in 2008]?

[Kocharyan] No, it does not. I did not say that they will be
suspended. I said that there will be no active negotiating process. I
said this for the politicians who are going to use this factor to
invent something new for their campaign. I think we should be fair
with the people.

Charity no key to success

[Armenian Second TV Channel correspondent Shavarsh Gevorkyan] Mr.

President, charitable actions held by some parties have become a target
of opposition criticism these days. What is your attitude to this?

[Kocharyan] Name a country where charitable actions do not intensify
before elections. There is no such country. In well-established
democratic states, charity and elections are regulated by laws at such
a level that it is possible to notice where charity ends and election
bribes start. Unfortunately, our legislation does not provide for
this strict boundary, but I should say that those who speak about
this have not suggested any draft law in this direction.

Political activity, especially parliamentary activity, supposes that
if you have a problem and worry about something, then you should
first initiate a law and suggest adopting it, but if the National
Assembly does not adopt it, you can accuse the ruling parties of
not accepting this sound advice. But there is no such suggestion,
only senseless talk.

Incidentally, the subject of charitable actions has become more
intensive in connection with the activity of the Prosperous Armenia
Party [PAP]. The growth in the authority of this party has caused
certain anxiety in the political field. I do not think that the
growth in the rating of the PAP is a direct result of its charitable
actions. It would be a very simple explanation and many people would
start doing charity. But they do not do this as they instinctively
understand that in our society, there is demand for a new political
force that would act in a constructive field and use simple and clear
slogans. Their main idea is that they take care of people. Who does
not want to be taken care of? I think this is the main reason for
the success of the PAP.

No disagreements within authorities

[Arzumanyan] Mr President, in parallel with the growing rating of
the PAP, there are rumours about disagreements between you and the
Republican Party of Armenia [RPA]. Various scenarios that you invented
have been presented to us. But I am sure that nobody saw or heard
something personally and all this is a prediction.

[Kocharyan] Some analysts express ideas that surprise me sometimes.

Do I really have such political inventions? No, I do not. I think
that those analysts prepare such analyses with the aim of creating an
atmosphere of distrust within the authorities and split the team that
runs the state today. The situation is clear: there is the Republican
Party of Armenia which has been represented in the government since
May 2002 in this format with little change and has been the biggest
parliamentary faction since that time. And the prime minister is the
leader of that party. We have had a serious economic growth over the
last six years. These are the best years of Armenia’s independence
in the sense of its economic development.

[Shavarsh Gevorkyan] Everybody in Armenia is interested in your
political future.

[Kocharyan] I can say for sure today that I am not going to become
the youngest pensioner of Armenia. Life will start from the very
beginning. We shall certainly meet again and I will be pleased to

Director Robert Guédiguian ()

A few years ago, the entire life’s work of French communist director
Robert Guédiguian was screened in a retrospective tribute at the
Toronto International Film Festival.

Guédiguian is unique in that he has chosen the setting of Marseilles
for all his films, using the same principal actors in varying roles.
This creates an amazing and intriguing sense of continuity, even
though the themes and stories are extremely different from one film
to the next.

It isn’t surprising that his films are relatively unknown in the
United States. Choosing social themes that are based on knowledge of
class struggle, American imperialism and progressive politics, he
makes films that have limited commercial appeal to the Western media.

This year, for the first time, Guédiguian has ventured outside
Marseilles for a story about Armenia.

It’s a touching, thought-provoking drama about a French woman doctor
who has had little connection with her immigrant Armenian father, who
is suffering from heart problems. Rather than undergo surgery, he
slips away from her to his homeland to conclude his life. Her concern
takes her to a country she knows little about, a culture and a
history she has avoided most of her life.

His reasoning for returning home is beyond her understanding. But the
film makes a dramatic statement about the Armenian condition and the
emotions that draw people back to their place of birth. The film
`Voyage to Armenia’ is not only about the trip to a country, but the
journey one makes in life to discover true meaning and love for
people and their culture.

Since this film probably won’t be available for quite a while, you
can get a taste of a Guédiguian masterpiece by renting the available
DVD `Marius and Jeanette.’

In a revealing film about terrorism of the 1970s variety, Hans
Joachim-Klein tells his amazing tale. `My Life as a Terrorist’
follows the life of a member of the German radical left who joined up
with the infamous Carlos the Jackal and became involved in the 1975
plot to kidnap oil ministers in Vienna. The plot went awry and
resulted in the death of three captives.

The film points to Libya as having been implicated in the plot.
Through a process of negotiations with the authorities – including
the fact that he wasn’t one of the actual killers – Joachim-Klein
served a minimum sentence. After his release he went into hiding for
many years.

Joachim-Klein’s testimony decries the senseless violence adopted by
the radical left fringe of that era, and concludes, `From a moral
perspective, these groups had completely hit rock bottom.’

The soft-spoken Klein, the child of a troubled working-class family,
shows remorse for his involvement and makes a sincere effort at
trying to explain what drove some leftists to the extremes. As he
retraces critical moments and places in his life in an almost
cathartic way, the audience begins to share his newfound tranquility.

Nagorno Karabakh, during which reference was made to issues of troops
command.

ArmInfo correspondent informs from Stepanakert that the trainings were
conducted with the application of theoretic and practical
methods. Great attention was paid to the operative and combatant
preparedness. When summing up the results, it was noted that the
preparedness of the staffs is on a proper level.

MDR ` the Public Television of Germany ` screened a documentary titled
`The History of Baku,’ where the current reality of Azerbaijan is
severely criticized. According to the Azeri Day.Az., the film
particularly criticizes corruption, poverty, and the terrible
situation in oil wells. Te film pictures Azerbaijan as a backward
state full of corruption. It is said that the journalists who shot the
film were arrested by the Police at the moment they were interviewing
the local residents protesting against the construction of an oil
pipeline. They were asserting that the documents on their agreement to
the construction were forged by local officials. The film met great
reaction in Germany, which seriously damaged Azerbaijan’s reputation.

pensioner in the country after the presidential election of 2008,"
said Armenian President Robert Kocharyan in an interview to native TV

Asked about his future activity after the expiry of the term, the
president said he has no intention to become a pensioner. "I have very
much force and the life still begins," Robert Kocharyan said. To
recap, according to the Constitution of Armenia, Robert Kocharyan’s
term expires in 2008 and he has no right to run for a third term.

After voting to the constitution NKR President Ghukassian answered the
questions of reporters. In answer to the question on the effect of the
constitution on the talks, the president said, `I think it will be
positive because the adoption of the constitution corresponds to the
logic of the talks. I mean the right of NKR for
self-determination. We did not tell anything new, we confirmed what we
had already said. This document shows our commitment to the values we
have created, it helps protect our national identity and at the same
time keep up with the developments in the world. The generation who
have voted today are the children of people who voted in 1991 for
independence, and their children are confirming it.’ Arkady Ghukassian
believes that the world will sooner or later recognize the decision
made by the people of Nagorno Karabakh. `The constitution is first of
all important for us, but the world cannot remain indifferent towards
it. I believe that sooner or later the international community will
recognize our decision. For us, we will keep to our track: we have
chosen independence and we will not give it up,’ said the NKR
president. With regard to the attitude of Azerbaijan towards the
constitution of NKR the president said: `I do not expect a better
attitude from Azerbaijan. Similarly, we may not recognize any popular
event in Azerbaijan considering that no Armenian lives in
Azerbaijan. Unfortunately, this stance of the Azerbaijani government
has led to a state when we are unable to settle the conflict. I think,
under the pressure of Azerbaijan the international community will
start acting as a coquette in connection with the adoption of the
constitution, but I do not take this seriously. Because I believe that
the goal of the international community is to set up peace in the
region. And the only way to reach peace is the independence of NKR.’

Statement of Democratic Faction of NKR National Assembly

STATEMENT OF DEMOCRATIC FACTION OF NKR NATIONAL ASSEMBLY

On December 11 the Armenian office of the Council of Europe released
the statement of the CoE Secretary General Terry Davis on the
referendum held in NKR, which runs: `A lasting solution for
Nagorno-Karabakh can only come out of the political process
facilitated by the Minsk Group. Any future solution must respect human
rights, and if it is submitted to popular consultation, the vote must
be free and fair and open to everyone. The main responsibility for the
settlement is with the political leadership of Armenia and Azerbaijan
and especially President Kocharian and President Aliyev. This is one
of the accession commitments of both Armenia and Azerbaijan to the
Council of Europe.’ We are not likely to argue with the Council of
Europe Secretary General, nevertheless, we have to note that the
referendum on Constitution is not an initiative for the settlement of
the conflict and does not determine the outcome of the talks over the
settlement of Karabakh, but concluded 15 years of experience of our
independent state and marked new, more liberal and democratic goals,
which, we believe, are fully compliant with the goals of the
international community. With his statement the secretary general
admits that every step based on human rights is fair, but amazingly he
sees such a possibility for Nagorno Karabakh in the future only,
whereas the 150 thousand citizens of the republic, which has existed
for 15 years, has overcome the war imposed on it and taken the track
for democracy, cannot postpone the problems of shaping a more liberal
public administration and levers of civil control until indefinite
future, because life demands keeping up with the modern world.
Meanwhile, Mr. Davis unfortunately wishes to direct the people of NKR
towards totalitarianism and arbitrariness, which is not only
inappropriate for the system of values of the Council of Europe but
may also shatter stability in the region. We are hopeful that this
unrewarding mission was not an appointment commitment of Mr. Davis to
the high-ranking post of Council of Secretary General. As to the
statement of the CoE Secretary General that the main responsibility
for the settlement is with the political leadership of Armenia and
Azerbaijan, we have to note that earlier he personally appealed to
Azerbaijan to set up relations with the Karabakh party, which was
neglected by official Baku. We are reluctant to insist that official
number one of such an authoritative organization as the CoE edits his
own approaches in accordance with expediency, but unfortunately, the
neglect of the NKR people and its elected representatives by Mr. Davis
arouses no other attitude but pity.
