BAKU. June 19, 2012: The Azerbaijani media circulated the letter by
Ilham Amiraslanov, the civic activist from Kur Civil Society, which
he wrote from prison. Ilham Amiraslanov was arrested on trumped-up
charges after he voiced the indignation of the local people in
Sabirabad about the government compensations to the flood victims in
the region. In his letter, addressed to the Attorney General’s Office,
Ilham Amiraslanov graphically describes his arrest and torture at
the police station. Below is the full text of his letter:

I am informing you that on June 8th, 2012, while on my way home after
buying medicine from a pharmacy located in the city of Sabirabad,
I was detained by operatives of Anti-Organized Crime Department of
the Miistry of Interior near my place of residence in the city of
Sabirabad, Esgerbeyli village.

The agents, along with Sabirabad policemen, threw me on the ground,
handcuffed my hands behind me, put a green bag over my head, and
after picking me up off the ground, placed me in a private car and
drove me to an unknown location. There were agents seating on each
side of me in the backseat of the car. I felt one of the agents,
sitting on the right side of me and referred to as Seid by the others,
place something at the back of my pants in my belt. I felt as if it
may be some kind of a device. At this point, he hit me on the head
several times with his fist and lashed at me with curses.

>From agents’ conversation in the car, I understood that they were
taking me to their chief named Nadir and from their conversation it
was revealed that he was relaxing at a sports complex. I understood
that I was being taken to Sabirabad’s Olympics complex. They took me
to some building after taking me out of the car and after they took off
the bag from my head, I realized that this is one of the Complex’s 2-3
floor buildings. They sat me on a chair and tied my hands behind the
chair. Seid kicked me in the head with his foot and I fell on the floor
together with the chair. He put the bag over my head again and tried
to choke me with the ropes from the bag. He punched me over my mouth,
I started bleeding from my mouth, he punched me under my eye, the
swelling and the bruise under my eye was visible until two days ago.

When they took off the bag from my head after beating me, I saw broad
shouldered, built man going down the stairs from the second floor.

>From the way they were addressing him, I understood that this is
Nadir. Nadir asked me, why is it that you haven’t left your house in
the past 2-3 days? Because of you we have been stuck here. Seid took
out from my belt what he had placed there earlier and put it on the
table. It was then that I saw that this was a gun.

As Seid was taking the gun out from my belt, there was a video
recording taking place with a small camera. The video recording was
being done by one of the agents, whose name I did not learn. When Seid
took out the gun he told me that, this gun has been given to you by
your brother. I told him that, you put this gun on my back while on
the bridge.

After these words, Seid began punching me in the head and in the
stomach with his fist. Seid put the bag over my head and began
threatening me that he will make me sit on a bottle, do all sorts of
things to me (he told me the sort of things he would do to me by their
name, but I am not writing them to you, so as not to be unethical).

With a bag over my head they placed me in an imported gray car
again (with the same car they took me to Baku as well) and brought
me to Sabirabad district police’s deputy chief’s, Rauf Macidov’s,
room. In his room they took off the bag from my head and with my
hands handcuffed sat me in a chair. There was Rauf Macidov, Nadir,
Seid, and four others I did not know.

Seid placed the gun in my belt again and once again they did a video
recording. Seid took out the gun and placed it on the table himself.

Seid asked me, where did you buy the gun, who gave it to you. He
put the gun on my forehead and pulled the trigger. It didn’t shoot,
the gun was empty. I told him that the gun is not mine, you put it
on my back. At this point Nadir slapped me on the head with a force
and I fell on the floor together with the chair.

Then they picked me up, Seid with his hands tried to rip my mouth
apart by pulling my upper and lower chin. I got up at this point.

Nadir approached me, hit me with a strong force on my forehead and I
fell on the floor. Others in the room started kicking me with their
feet. Seid asked Rauf if he had a bottle and he said yes, but there
is a little bit of a vodka in it. Seid said “pull his pants down,
he must turn into a queer.”

Rauf Mejidov told me that even if things will be done to you, are you
going to go outside and say that they tore my ass up? I told them that
it is better to be beaten to death, than to be like that. Thereafter,
they said that an order has been given and you must be arrested. Out
of respect to you, we are taking you in this way. I was forced to
state that the gun belonged to me. They wrote the script for me
themselves, as if I found this gun two months ago, in a plastic bag,
on the side of Araz while on my way back from cutting grass. I agreed
and my confession was written this way. After this Rauf Mejidov told
me that Anti-Organized Crime Unit officers do not know, but you do,
why are you not saying that the grass can’t be cut two months ago? Why
are you not saying it? I said that you are writing it yourselves. I
am not the one saying it.

After this the script was changed. This script was put together by Rauf
Mejidov and Seid. They said that you will say that two months ago,
on your way back from pasturing the animals, you found the gun in
a white plastic bag on the side of Araz. The confession was written
in this way. After this Nadir said that, I should give them 5 (five)
bullets. I asked him where would I get it. He said we will throw it
under your house, you will get it from there and give it.

I signed a confession written this way. I would like to note that I
never had animals, and do not have any right now. I never pastured
livestock or shepherd sheep. I have spent my life in Russia and Baku,
engaged in trade. I returned to the village in August of 2009 and
due to the river flood have stayed to help out the people – worked
in the village. Prior to this, I have not lived in a village.

Approximately, late afternoon, until 15 [3 o’clock], with a car and
with black masked people we set out to the village. I showed them
the location of our house. We stopped on the street. Destroying the
entrance door they went inside. When they entered they kicked and
turned upside down the table and chairs in the yard. They shoved me
under the house and Seid said pick it up. I asked him to pick what up?

Seid said, the plastic bag. I picked up the plastic bag, it was torn
and empty. Then Seid said not that one, the plastic bag under the
tile. I picked up the plastic bag and saw five (5) bullets inside it.

I gave the plastic bag to Seid. There was a video recording taking
place at this time. They put me in a gray car and I was taken to a
police station, and from there to Baku. On the way Seid said to other
agents that Nadir was rebuked for not seizing more items.

Dear Prosecutor!

Currently, the flesh of my left ear is torn, I cannot hear well and
I feel sharp pain.

In addition to this, the pain I felt from the blows I received near
my heart on my left side as I was beaten remains.

I require an immediate medical examination.

I ask of you to ensure that the court comes to a decision on ordering
a medical examination upon me and in order to investigate my torture
and to determine the injuries I have received.

d’action quinquennal qui prevoit une forte croissance economique et
une diminution importante de la pauvrete. Le programme presente par le
Premier ministre Tigran Sarkissian a dit que le gouvernement visera
a atteindre un taux de croissance annuel entre 5% et 7% et souhaite
creer 100.000 nouveaux emplois et reduire le taux de pauvrete officiel,
qui s’elève actuellement a 36%. Le gouvernement devrait lutter contre
la corruption et renforcer la ” justice ” dans le pays.

Lake Sevan is our national symbol and our salvation, Chairman of the
Public Council’s Agriculture and Environment Committee, Deputy Chairman
of the Sevan Committee Yuri Javadyan said during a press-conference
on Thursday.

He said that the law allows releasing from the lake no more than
170mln c m of irrigation water a year. “But this year because of high
temperature and low precipitation we have run short of water and were
forced to take additional 150mln c m,” Javadyan said.

President of the Association of Consumers Armen Poghosyan said that
low precipitation and high temperature were just a pretext. “The real
reason why you are releasing more water from Sevan is your fear that
the lake’s rising water may cover the houses and restaurants of some
people,” he said.

According to the government’s program by 2029 the level of Sevan will
grow by 6 meters. In 1993-2002 the level of the lake dropped by over
19 meters, in 2002-2012 it rose by just 4 meters.

YEREVAN, JUNE 21, ARMENPRESS: The entrance of Mozrov Cave has closed
this March, Marine Avanesyan, representative of “Historical Environment
and Historical-Cultural Museum Preserves Protection Service” NCSO of
the Ministry of Culture of Armenia told Armenpress.

Mozrov Cave has been close to the visitors from the very beginning,
as this cave, opened still in 1980s, has had no routes, enabling to
use the monument for purpose of tourism.

“Despite that, some adventurers, ignoring the risk, organized
expeditions, which has been periodically registered by the employees
of “Historical Environment and Historical-Cultural Museum Preserves
Protection Service” NCSO and prevented,” said Mrs Avanesyan.

But during professional studies in the territory of the cave it was
found out that stones fell from the vault of the entrance part of the
cave, creating a slide of the ground. It was also found out that the
cave, in general, is not under risk, but some part of the entrance
has become emergency due to geological and climate conditions.

“Taking into consideration the conclusion of the specialists and the
circumstance that very often ordinary citizens and lovers of extreme
tourism try to enter into the cave the board of the NCSO adopted a
decision to close the entrance of the cave to prevent and rule out
the casualties.

A comprehensive plan on the use of Mozrov Cave is now being worked
out. The plan will be submitted to the Ministry of Culture, after which
“Historical Environment and Historical-Cultural Museum Preserves
Protection Service” NCSO will undertake implementation of complex
measures.

The parties to the Nagorno-Karabakh conflict have agreed at a meeting
between Azerbaijani and Armenian foreign ministers Elmar Mammadyarov
and Edward Nalbandian in Paris that the OSCE Minsk Group co-chairmen
must intensify their mediation activity, spokesman for Azerbaijani
Foreign Ministry Elman Abdullayev told Trend today.

“Azerbaijan is in the same position,” he said. “According to it,
the occupation of Azerbaijani lands by Armenia is the basis of the
Nagorno-Karabakh conflict. This hinders the process of the conflict
settlement.”

“At the meeting, Baku said that first it is necessary to withdraw
Armenian troops from the occupied territories to achieve progress in
the settlement,” he said. “This will help open up new opportunities to
develop the entire region. The parties agreed that the mediators will
soon visit the region within the Nagorno-Karabakh conflict settlement.”

The OSCE Minsk Group co-chairmen from the U.S, France and Russia,
Robert Bradtke, Jacques Faure and Igor Popov, as well as personal
representative of the OSCE chairman Andrzej Kasprzyk attended the
meeting.

The foreign ministers expressed their determination to continue working
with the co-chairmen to â~@~Kâ~@~Kachieve a peaceful settlement and
confirmed their readiness to conduct confidence building measures
that could improve the atmosphere of the talks, the message said.

The conflict between the two South Caucasus countries began in 1988
when Armenia made territorial claims against Azerbaijan. Armenian
armed forces have occupied 20 per cent of Azerbaijan since 1992,
including the Nagorno-Karabakh region and seven surrounding districts.

Azerbaijan and Armenia signed a ceasefire agreement in 1994. The
co-chairs of the OSCE Minsk Group – Russia, France and the U.S. –
are currently holding peace negotiations.

Armenia has not yet implemented the U.N. Security Council’s four
resolutions on the liberation of the Nagorno-Karabakh and the
surrounding regions.

The presidential campaign has begun in Nagorno-Karabakh. Four
candidates are going to struggle for the post of head of this
breakaway region. Experts assume that the result of the struggle is
predetermined. They associate this fact with the aggravation of the
situation on the borderline with Azerbaijan.

Bako Saakyan, the current head of the republic, is considered to be
the favorite of the campaign. His main rival is Vitali Balasanyan,
a deputy of the National Assembly. In addition, Arkadi Sogomonyan, the
rector of the local branch of the Armenian State Agrarian University,
and Valeri Khhchatryan, who is currently unemployed, will participate
in the struggle for the post. Experts consider the chance of the
latter two candidates to be negligible.

Unlike other electoral processes in post-Soviet countries, Moscow
hasn’t got any favorite in this case. The Nagorno-Karabakh Republic
has not been recognized by any state, including Armenia which is its
patron. Russia is an intermediary between Baku and Yerevan in the
Nagorno-Karabakh conflict; it recognizes the territorial integrity of
Azerbaijan. Therefore it cannot have any official relations with the
leaders of the breakaway region, Alexei Vlasov, the editor-in-chief
of VK notes.

“There are some officials among Russian politicians who have special
relations with the elite of the Nagorno-Karabakh republic, including
experts and even Duma deputies, but they do not represent the official
point of view of our country. I suppose the Nagorno-Karabakh issue,
as before, will be considered in the context of settling the conflict
with our participation, but no more. Russia can hardly build special
ties with the Nagorno-Karabakh republic.

Concerning the prospects of settling the conflict, the results of the
presidential campaign in the republic will not influence this issue.

The first reason for this is the fact that the representatives of the
Nagorno-Karabakh republic don’t participate in the negotiations on
this problem. The second reason is that the sides should be ready
to agree to compromise in order to overcome the deadlock, but the
favorite of the campaign, Bako Saakyan, thinks that it is impossible
to make any concessions to Azerbaijan. At the same time, Alexei Vlasov
is sure that Saakyan’s victory is predetermined:

“Most of the candidates registered by the Central Electoral Commission
will play subordinate roles. It is a known fact that Bako Saakyan is
the main favorite in the coming presidential elections. That’s why
we cannot speak about true competition of programs or ideas; we can
speak about a quasi-competition created by the participation of three
other candidates who emphasize the advantages and political experience
of Bako Saakyan, the current head of the republic. It is a gross
exaggeration to say that these elections will really be competitive
or there will be any intrigue in them,” Alexei Vlasov summed up.

Interview of Human Rights Defender of Armenia, Candidate of Legal
Sciences Karen Andreasyan to ArmInfo

Mr. Andreasyan, on June 11 more than 550 out of 1200 representatives of
the Chamber of Lawyers went on a 1-day strike and did not attend the
court sessions, thereby protesting against the problems and judicial
outrage in the legal system. How much do you think such actions are
efficient for removing the existing shortcomings in the system?

The judicial system of Armenia has so many problems, and the lack of
trust in the court system is so much obvious that I was not at all
surprised at the strike of the lawyers. Moreover, we support the
lawyers, in particular, when they are jointly trying to fight the
outrage of courts and unfairness. Today the society has got very
few ways to influence the court ~Selite~T. In fact, the latter is
rather ~Sprotected~T against the public pressure. This is fixed in
the Constitution, as well as in the world practice – the external
impact on the judicial power should be reduced to minimum for the
latter to be independent in its actions. However, actually, in Armenia
this requirement of the Constitution and international norms has in
fact led to the opposite effect, i.e. – despotism of judges. A court
must depend on the law, it must not depend on neighbors, relatives,
oligarchs or money. In Armenia the independence of courts has turned
into total chaos. Such prudence often leads to the expected and fair
public protest. I don’t want to comment on this action of lawyers.

Nevertheless, I can say that the general struggle against the top
of the judicial power is clear and acceptable to us. It is still
relevant today.

The focus in this problem is always put on the fact that the judges and
the courts should change, without the slightest hint of the necessity
to create conditions for the judges~R independence and to curb the
oligarchs and those at power.

If a judge takes a bribe and passes an unfair verdict, to blame is
not so much the oligarch that has bribed him but the authority that
has failed to punish the judge.

Do you mean the Justice Council?

Yes, I do. It is the only force, besides the mass media, that can
influence our courts, but, unfortunately, it is not efficient.

How did your polemic with the Cassation Court regarding the problem
of the Justice Council end?

By asking the Justice Council to punish three judges I meant to show
that the punishment mechanism is ineffective. Instead of punishing the
judges, the Council just said that the judiciary is independent. So, we
are right when saying that there is no progress in the Council’s work.

The European Court of Human Rights (ECHR) has recently obliged the
Republic of Armenia to pay 6,000 EUR to prisoner Ararat Muradkhanyan.

Are there many such claims against Armenia? How does the state fulfill
its obligations with respect to the claimants who win the case?

Lots of complaints have so far been filed to the Court against Armenia,
with most of them satisfied. Our authorities timely pay the required
compensations but do nothing to improve the situation. What we need
is to punish the judges that are to blame for our spoiled image.

Many local and international human rights organizations regularly
raise the problem of poor custody in Armenian penitentiaries. What~Rs
the solution to this problem?

Unfortunately, insufficient financing prevents the Human Rights
Defender’s Office from improving conditions in Armenian jails. The
problem of poor custody and bad treatment in jails is very urgent
in Armenia, but my office does not have enough money to make a real
change. We still keep visiting jails and, together with NGOs, reporting
the problems existing there. The Justice Ministry is building new jails
to solve the problem of congestion, but there are still problems of
poor conditions, bad treatment, corruption and violence.

The hotline service has been operating since November 2011. Are the
citizens interested in cooperation with the Human Rights Defender~Rs
Office?

We receive a huge number of statements, applications, and we
received about 700 calls on the very first day of creation of the
hotline service. People call us every day and get assistance from
us. Our cooperation with the NGOs, as well as the funds we receive
from international structures, allow us to provide the necessary help
to the people who become victims of injustice, bad treatment in the
Police, investigation bodies and other law-enforcement structures.

stance regarding the government’s five year plan of action by
saying that if the votes garnered by the opposition in the recent
parliamentary elections are added together then it becomes clear
that there can be no talk of the people having confidence regarding
the program.

Zohrabyan noted that the country faces a multitude of challenges,
most importantly poverty, emigration and extreme corruption.
