SECULAR FUNDAMENTALIST THREAT

NEW YORK – The chief prosecutor of Turkey’s High Court of Appeals
recently recommended to the country’s Constitutional Court that the
ruling Justice and Development Party (AKP) be permanently banned.

Only last July, the AKP was overwhelmingly re-elected in free and fair
elections to lead the government. The chief prosecutor also formally
recommended that Prime Minister Recep Erdogan, President Abdullah Gul,
and 69 other leading politicians be banned from politics five years.

Clearly, banning the AKP would trigger a political crisis that would
end Turkey’s efforts to join the European Union in the foreseeable
future and threaten its recent strong economic growth.

So the chief prosecutor’s threat should not be taken lightly – all the
more so given that the Constitutional Court has banned 18 political
parties (including the AKP’s predecessor party) since the current
constitution was introduced in 1982. Indeed, the recent call to ban the
AKP is directly related to its efforts to change Turkey’s Constitution.

The underlying charge in the chief prosecutor’s indictment is that
the AKP has been eroding secularism. But the origins of the current
Constitution, and its definition of secularism, are highly suspect.

Turkey’s existing Constitution was adopted in 1982 as a direct product
of the Turkish military coup in 1980. The five senior generals who
led the coup appointed, directly or indirectly, all 160 members of
the Consultative Assembly that drafted the new constitution, and they
retained a veto over the final document.

In the national ratification referendum that followed, citizens were
allowed to vote against the military-sponsored draft, but not to
argue against it publicly.

As a result, the 1982 Constitution has weaker democratic origins than
any in the EU. Its democratic content was also much weaker, assigning,
for example, enormous power (and a military majority) to the National
Security Council. While the AKP has moderated this authoritarian
feature, it is difficult to democratize such a constitution fully,
and official EU reports on Turkey’s prospects for accession repeatedly
call for a new constitution, not merely an amended one.

With public opinion polls indicating that the AKP’s draft constitution,
prepared by an academic committee, would be accepted through normal
democratic procedures, the chief prosecutor acted to uphold the type of
secularism enshrined in the 1982 Constitution, which many commentators
liken to French secularism. Yet the comparison with what the French
call "laicite" is misleading.

Certainly, both French laicite and Turkish secularism (established by
modern Turkey’s founder, Kemal Ataturk) began with a similar hostility
toward religion. But now they are quite different.

In Turkey, the only religious education that is tolerated is under
the strict control of the state, whereas in France a wide variety of
privately supported religious education is allowed, and since 1959
the state has paid for much of the Catholic Church’s primary school
costs. In Turkey, Friday prayers are written by civil servants in the
70,000-member State Directorate of Religious Affairs, and all Turkish
imams also must be civil servants. No similar controls exist in France.

Similarly, until the AKP came to power and began to loosen
restrictions, it was virtually impossible in Turkey to create a new
church or synagogue, or to create a Jewish or Christian foundation.

This may be why the Armenian Patriarch urged ethnic Armenians in
Turkey to vote for the AKP in last July’s elections. Here, too,
no such restrictions exist in France.

The differences between French and Turkish secularism can be put in
even sharper comparative perspective. In the widely cited "Fox" index
measuring state control of majority and minority religions, in which
zero represents the least state control, and figures in the thirties
represent the greatest degree of control, all but two current EU
member states get scores that are in the zero to six range. France is
at the high end of the EU norm, with a score of six. Turkey, however,
scores 24, worse even than Tunisia’s authoritarian secular regime.

Is this the type of secularism that needs to be perpetuated by the
chief prosecutor’s not so-soft constitutional coup?

What really worries some democratic secularists in Turkey and elsewhere
is that the AKP’s efforts at constitutional reform might be simply
a first step toward introducing Sharia law. If the constitutional
court will not stop a potential AKP-led imposition of Sharia, who will?

There are two responses to this question. First, the AKP insists that
it opposes creating a Sharia state, and experts say that there is no
"smoking gun" in the chief prosecutor’s indictment showing that the
AKP has moved toward such a goal.

Second, support for Sharia, never high in Turkey, has actually
declined since the AKP came to power, from 19 percent in 1996 to 8
percent in 2007.

Given that the AKP’s true power base is its support in democratic
elections, any attempt to impose Sharia would risk alienating many
of its own voters.

Given this constraint, there is no reason for anyone, except for
"secular fundamentalists," to support banning the AKP, Erdogan,
or Gul, and every reason for Turkey to continue on its democratic path.

Only that course will enable Turkey to construct a better constitution
than it has now.

on 2-4 May. These are their last opportunities to book Olympic berths.

Armenpress was told from RA Wrestling Federation that Greco-Roman
style wrestlers, who have already booked two Olympic berths, have the
opportunity to qualify for Beijing 2008 durig tournaments in Rome on
9-11 May and Noviy Sad (Serbia) on 23-25 May.

that the presentation was being organized by
`ArmenTel’ Company. Does it mean that `Beline’ brand
of `Vimpelcome’ company should be presented?

-Yes, and we have already made it clear.

And how do you treat it?

-With smile and believe in tomorrow. I do not hesitate
that they have hurried a little and sooner or later
`ArmenTel’ has to make a rebranding.

Does it mean that Armenian `BeLine’ will continue to
protect its brand in Armenian courts?

-Till the end, without any suspicions towards the
victory. First the court cases in Armenia have not
been over yet, and the news spread by `Vimpel Com’
that the RA Court of Appeal affirmed that `Vimpel
Com’s’ product registration concerns Armenian
communication field is not true.

Second the decision made by the RA economic court is
suspicious, and even more it is not justified.
And finally third if in Armenia our right towards that
brand is limited or is not allowed, then we’ll apply
to international court.

In the European Court examples it is clarified that
brands and other intellectual products are defined by
the author’s rights which is a human right. The same
is applicable to Armenian court without any
exceptions. Hope that they’ll think of it in time and
we’ll not have to take the case to Strasburg.

the final.

YEREVAN, APRIL 3, NOYAN TAPAN. Armenia has an elected president and
one should take this fact into consideration. This statement was
made by Khosrov Haroutiunian, the Leader of the Cristian Democratic
Union of Armenia, at the press conference, which was held on April
3. In his words, the February 19 elections differed from all the
previous elections in the rivalry of political leaders, as well
as the impressive participation of electors and a small number of
falsifications. And after the elections, in the observation of Khosrov
Haroutiunian, the main political achievement was that newly-elect
President Serge Sargsian turned to the other forces with a suggestion
for cooperation.

Touching upon the March 1 events, the Leader of the Christian
Democratic Union of Armenia declared that he condemns the line of
conduct of the radical opposition, which brought forth a deadlock and
clashes. According to him, only opposition is responsible for what has
happened. Mentioning that rumours reached him during the nine days
of the sit-down strike ("even the court guard told me about it"),
according to which those gathered in the Liberty square were arming
themselves with wooden and metal cudgels, Khosrov Haroutiunian stated
that "an armed crowd is no longer peaceful demonstrators."

He added that living in the vicinity of the Liberty square he witnessed
the clash between the police and the demonstrators on March 1 early
morning and saw "young man with cudgels running away, as well as
demonstrators hitting at the shields of policemen to frighten them."

interdepartmental consultations between the Armenian and Ukrainian

Mr Yeliseyev will meet with Foreign Minister Vartan Oskanian, chairman
of the parliamentary committee on foreign relations Armen Rustamian.

He will attend the opening ceremony of an exhibition dedicated to 90th
anniversary of the Armenian-Ukrainian relations and the Depository
of Ancient Manuscripts of Matenadaran.

A LESSON FOR AZERBAIJAN ON HOW TO WIN A VOTE AND LOSE A CAUSE

The UN General Assembly adopted a resolution on March 14 reaffirming
the territorial integrity of Azerbaijan, reiterating the right of
return of internally displaced Azerbaijanis, and calling for withdrawal
of Armenian forces from "occupied territories."

Since the resolution was proposed by Azerbaijan and opposed by Armenia,
one would have assumed that Baku would be elated with the outcome
of the vote, while Yerevan would be licking its wounds. In reality,
neither Azerbaijan nor Armenia was happy with the result.

Azerbaijan was displeased for several reasons. To begin with, just
20% of UN member states (39 out of 193) voted in favor of the Azeri
resolution. Most of the states supporting the resolution were fellow
Muslim countries (28 out of 39). Even then, less than half (28 out
of 57) of the states belonging to the Organization of the Islamic
Conference voted with Azerbaijan, despite intensive lobbying and
threats by Baku not to sell oil and gas to countries not backing
the resolution.

Azerbaijan was also displeased that 100 UN member states abstained
and 47 others were absent during the vote. Azeri officials were even
more unhappy that among the 7 states voting against the resolution
were such major powers as the United States, France and Russia —
the three co-chairs of the Minsk Group of mediators on the Artsakh
conflict. Matthew Bryza, the US co-chair of the Minsk Group, defended
the US vote against Azerbaijan by stating that the resolution was
"one-sided" and that it "did not reflect the fair and balanced
nature of the [Minsk Group] proposal on the table." The Azeri Press
Agency (APA) claimed that the U.S., France and Russia not only
voted against the resolution, but also actively lobbied against its
adoption. Mr. Bryza disclosed in an interview with the APA that he
had cautioned Azeri officials not to proceed with the resolution.

Instead of listening to Mr. Bryza’s wise counsel, the Azeri leadership
recklessly went ahead and forced a vote on a resolution that was
not going to get supported by the overwhelming majority of the UN
member states, thereby damaging Baku’s interests! In the aftermath of
this fiasco, Azerbaijan declared a diplomatic war against the whole
world. Azeri officials announced that they would settle political and
economic scores with all those states that voted against, abstained
from or were absent during the UN General Assembly vote. This means
that Azerbaijan will end up antagonizing more than 150 countries —
80% of the world’s nation states!

Furthermore, Azeri officials have sharply criticized the U.S., Russia
and France for their opposition to the resolution, and have indicated
that they are exploring ways to dissolve or replace the Minsk Group
which would completely set back the possibility of resolving the
Artsakh conflict in the near future.

Azerbaijan has thus succeeded in antagonizing the three most powerful
countries in the world.

On the Armenian side, even though Yerevan did not win the vote and
did not succeed in blocking the resolution, it took advantage of the
Azeri blunder, to announce that Armenia reserves the right to recognize
Artsakh as an independent republic, if Azerbaijan tries to side-step
the long-standing negotiating process through the Minsk Group.

Since the Baku leadership did such a good job of over-reacting to the
UN vote and undermining its interests by antagonizing more than 150
states which did not vote for the resolution, Armenia does not have
to exert much effort to counter the UN decision, particularly since
it is advisory in nature and does not have a binding effect. Dozens
of similar resolutions have been adopted by the UN General Assembly
for decades asking Turkey to get out of Northern Cyprus, and Israel
to return the "occupied territories." Turkey, Israel and other states
have simply ignored such "toothless" resolutions. Armenia will probably
do the same.

Finally, Pres. Ilham Aliyev’s increasingly frequent threats to resolve
the Artsakh conflict by force are not likely to intimidate the Armenian
side. If Azerbaijan were militarily prepared to attack, it would have
done so without providing advance warning to Armenia. The fact is
that Azerbaijan is not capable of invading Artsakh, let alone start
a war with Armenia.

Azerbaijan is still suffering from the tragic consequences of its
last failed attack on Artsakh.

Even though no one welcomes war, should Azerbaijan attack when it is
not militarily ready to do so, it may end up losing even more territory
and cause the destruction of its valuable energy infrastructure.

Sahakian met with RA President Robert Kocharian, who arrived in
Stepanakert on a working visit the same day. Issues related to further
development and deepening of ties between the two Armenian republics,
Nagorno Karabakh’s socio-economic condition, as well as prospects of
Nagorno Karabakh settlement were discussed during the meeting.

As Noyan Tapan was informed by the General Information Department of
the NKR President’s Administration, for exclusive services done to the
NKR, by Bako Sahakian’s decree of the same day, the RA President was
awarded Grigor Lusavorich order. The NKR President handed the order
to R. Kocharian during the meeting with the head of the republic held
in the government sitting hall.

L. Ter-Petrosyan’s team. But it turned out that such dialogue was
impossible. We would meet with them around the table of negotiations,
but the very next day Nikol Pashinyan’s newspaper would publish some
material compromising Arthur Baghdasaryan.

Several times I had telephone conversations with Nikol, Alik
Arzoumanyan and Mr. Zourabyan, and I expressed my indignation. How
is it possible to negotiate in the evening and write and introduce
quite a different thing in the morning? They should realize that it
is impossible to move forward with blackmails and such approaches;
this is a bad way. We drew conclusions in proper time and reported

Azerbaijan’s FM Araz Asimov does not reflect the position of the
country’s high leadership, the RA MFA acting spokesperson Tigran
Balayan stated while commenting the initiative of the Azerbaijani
party concerning breaking up the OSCE MG.

"We agree with the Minsk group Co-Chairs and hope that this step and
Araz Asimov’s viewpoint does not reflect the position of Azerbaijan’s
higher leadership", Balayan noted. In his words, Azerbaijan presented
the letter targeted at breaking up the Minsk group and it was done
before the voting at the U. N. General Assembly on the resolution
initiated by Baku.

It once again testifies to the fact that Azerbaijan’s affirmations
and the steps of officials are not connected with the obligations
concerning continuation of the peace settlement process and most likely
are false assignments, the Armenian diplomat noted. The fact that
the Azerbaijani party failed the meeting of Azerbaijani President and
RA President-elect within the frames of the NATO summit in Bucharest
also testifies to the fact, Regnum reports.
