French parliament’s commission on constitutional laws adopted bill
introduced by Valerie Boyer and her colleagues on transposition
of the right on struggle against racism and punishment of Armenian
Genocide denial.

The document envisages punishment for denying the fact of genocides
adopted by law, the statement on parliament’s website says.

The punishment supposes one year imprisonment or fine amounting to
45,000 euro for those who will challenge or extremely minimize the
fact of the 1915 Armenian Genocide officially recognized by France
on January 29, 2001.

YEREVAN. – I rule out panic and deficit in Armenia’s egg market
towards the New Year, expert Manase Yepremyan stated during a press
conference on Wednesday.

He informed that 5 million eggs are already stored in the country,
5 million more is expected to be imported, and the local poultry
farms will produce close to 35 million eggs. And as per Yepremyan,
this is plentiful to meet the demand.

To note, the price of eggs rose virtually three times towards previous
New Year. But this time, according to Yepremyan, the egg producers
and the Agriculture Ministry learned the necessary lessons from last
year’s crisis and are making serious preparations.

The expert also said the crisis in the egg market is caused by
the consumers’ conduct, as they groundlessly store eggs in their
refrigerators.

According to Manase Yepremyan, the Armenians are among the world’s
“most-egg-eating” nations, as each Armenian annually consumes 284 eggs,
and this the world’s fifth greatest amount.

Shirak Torosyan, President of the Javakhk Patriotic Union, today
brushed aside any charges directed at him as baseless and said that
Georgian authorities have not been able to justify banning him from
entering that country.

Torosyan argued that the Armenian government should be doing more on
his behalf, despite the stiff resistance shown by Tbilisi.

“I understand that the intransigence of Tbilisi is a major challenge
for Yerevan. But I know that the matter is being raised and must be
resolved in the context of bilateral relations,” Torosyan said at a
press conference today.

The Javakhk activist said that his organization is getting its message
through to the Armenians in Georgia even though he can’t set foot
across the border.

Torosyan, a Republican Party MP in the Armenian parliament, has been
persona non grata in Georgia since 2009.

As to whether or not he will run in next year’s parliamentary election,
Torosyan said that he hasn’t yet discussed the matter with his party.

men while implementing his professional duties.

The young men were engaged in a car accident at the Charents and
Mkhitar Heratsi street. They violated the public order, assaulted

Lebanese President Michel Sleiman and his spouse Wafaa Suleiman, who
paid an official visit to Armenia, visited December 9 Tsitsernakaberd
Memorial and paid tribute to the memory of the victims of the 1915
Armenian Genocide. Accompanied by the Foreign Minister Edward
Nalbandian and Mayor of Yerevan Taron Margaryan, the Lebanese
President put a wreath at the memorial and commemorated the victims at
the Eternal Fire.

Director of the Armenian Genocide Museum-Institute Hayk Demoyan
presented to the guest the history of the greatest crime again
humanity in the beginning of the 20th century.

Michel Sleiman put a note at the Commemoration Book of the museum. He
wished the Armenian people to build a state their sons fought for and
wished Armenia find its perfect integrity, sovereignty, stability and
development.

The Lebanese President also planted a symbolizing tree at the Memory
Alley. Hayk Demoyan handed to the top guest a Gold Medal.

Lebanon is the only Arab state that has officially recognized the
Armenian Genocide.

near future. He received the invitation from his Lebanese counterpart
Michel Suleiman, who is in Armenia for an official visit.

President of Lebanon expressed gratitude to Serzh Sargsyan for warm
and special reception. “This reception reflects the firm ties exiting
between our countries,” he noted.

The Armenian President in turn thanked for the invitation and said
he will visit Lebanon with pleasure.

Entrepreneur Silva Hambardzumyan has informed local daily Haykakan
Jamanak (~SArmenian Times~T) that Syunik marzpet (regional governor)
Suren Khachatryan will transfer his debt of 102 million drams to her
account by Dec. 15.

Hambardzumyan noted, however, that she didn~Rt receive this news
from Khachatryan himself, but through intermediaries. They asked the
entrepreneur to inform them when the money is in her account so that
they may relay this information to the governor who reportedly will
then go and apologize to Hambardzumyan.

The entrepreneur didn~Rt reveal the names of these intermediaries,
promising, however, to make them public after Dec. 15, if she has
still not received the money owing to her.

Recall, meeting with reporters on Nov. 10, Hambardzumyan charged
that Khachatryan stole 102 million drams~R worth of equipment from
the Litchqvaz-Tey mine, which belonged to Hambardzumyan before the
license for her Sipan 1 gold mining company was revoked by authorities.

Following the accusations, Khachatryan publicly threatened to take
Hambarzumyan to court, saying that he purchased the equipment.

Then, on Nov. 14, Hambardzumyan asserted that she was attacked by
the marzpet as she was leaving a Yerevan hotel.

Un etranger en situation irregulière ne peut etre emprisonne au seul
motif qu’il est sans-papiers, a affirme mardi la Cour europeenne de
justice tout en reconnaissant qu’un Etat peut placer un clandestin
dans un centre de retention en attendant son expulsion.

Le droit europeen “s’oppose a une legislation nationale qui impose une
peine d’emprisonnement a un ressortissant d’un pays tiers en sejour
irregulier au cours de la procedure de retour”, a indique la Cour de
Luxembourg dans son arret.

La justice europeenne etait appelee a se prononcer dans un differend
opposant le gouvernement francais a un citoyen armenien, Alexandre
Achughbabian, entre clandestinement en France en 2008 et qui, refusant
de se soumettre a un ordre d’expulsion, a ete place en garde a vue
puis en retention pour sejour irregulier sur le territoire francais.

La legislation francaise punit dune peine demprisonnement dun an
et dune amende de 3.750 euros, le ressortissant dun pays tiers qui
sejourne irregulièrement en France, au-dela de trois mois, non muni
des documents et visas exiges, notamment de la carte de sejour.

Le droit europeen “ne soppose pas a une reglementation nationale qui
qualifie le sejour irregulier dun ressortissant dun pays tiers de delit
et prevoit des sanctions penales, y compris une peine demprisonnement”,
a rappele la Cour.

La legislation europeenne ne soppose pas non plus a un placement
en detention en vue de determiner le caractère regulier ou non du
sejour dun ressortissant dun pays tiers mais, a souligne la Cour,
les autorites nationales sont tenues dagir “avec diligence et de
prendre position dans les plus brefs delais”.

Une fois lirregularite du sejour constatee, ces autorites doivent,
en principe, adopter une “decision de retour”. Cette ultime procedure
ouvre une periode de retour volontaire, suivie, si necessaire de
mesures d’eloignement force.

Or, a conteste la Cour, la legislation francaise est susceptible de
conduire a un emprisonnement pendant la procedure de retour ce qui
va a l’encontre du droit europeen.

La legislation europeenne sur les conditions d’eloignement des
etrangers, dite “directive retour” entree en vigueur en janvier
2009, prevoit que lorsqu’il est decide de renvoyer un sans-papier,
ce dernier a entre 7 a 30 jours pour partir de lui-meme.

S’il ne s’y conforme pas, les gouvernements peuvent utiliser “en
dernier ressort” des mesures coercitives “proportionnees”, c’est a
dire un placement en retention, “aussi bref que possible”, dit la
loi europeenne. Ce n’est qu’en cas de refus d’embarquer qu’il est
possible d’envisager des mesures penales.
