THE STATE OF HUMAN RIGHTS IN THE MINISTRY OF NATURAL PROTECTION

The serial part of the Ombudsman’s 2012 report is about the Ministry
of Natural Protection.

According to it the following shortcoming were registered in the
activities of the Ministry.

â~@¢ There are numbers of unresolved issues related to hazardous
materials and waste generation as well as violations of transportation.

â~@¢ Numerous complaints were received related to different
environmental spheres: logging, pollution of the atmospheric air,
poisoning of the fish and water in the rivers, hunting and illegal
seizure of timber, hazardous materials and waste and toxic emissions.

â~@¢ The program of the actions directed at the implementation of the
Armenia’s commitment to Aarhus Convention was not done; in particular
the regulation of the legal relations wasn’t implemented.

â~@¢ Appropriate measures were not taken for the resolution of the
problems related to water-taking of the hydropower.

â~@¢ The Ministry didn’t implement consistent policy directed at a
proper response of the violations and the solutions.

â~@¢ Many cases of environmental damage caused by the business as a
result of the absence of the positive finding are quite concerning.

â~@¢ The issue of the assessment criteria of the impact on the
environment, as well as legal sanctions for the damage caused to the
environment and offenders is not yet clear.

â~@¢ The licensing issue of the “Teghut” CJSC for the operation of
the molybdenum mine has not been solved yet, while numerous calls
from the environmentalists were received.

â~@¢ It gives rise to concern that the Ministry has not been proactive
in its approach to overseeing the areas under its control in order to
identify and sanction the cases of hunting in the reserves â~@¢ The
organization of proper public debates related to legal acts remains
unsolved, as a result of which the public participation bears a
formal nature.

Registered positive developments

â~@¢ Steps are being taken to provide public with information
about concerning issues â~@¢ Special criteria for the appointment
of inspectors are being implemented in accordance with the law on
“Civil Service”.

â~@¢ Steps are being taken to comply the provisions of the legislation
with Aarhus Convention.

Next the Ombudsman’s Office will present the part of the report
concerning the Ministry of Energy and Natural Resources and Public
Services Regulatory Commission.

HOLY ETCHMIADZIN URGES RAFFI HOVANNISIAN TO STOP HUNGER STRIKE

The Mother See of Holy Etchmiadzin issued a statement referring to the
post-election tensions in Armenia which became a topic for speculation
in different circles.

“We highly appreciate our people’s good sense, which guaranteed
the conduct of a peaceful and a civilized election. Considering the
reports on and assessment of the February 18 presidential election
by the Central Election Commission, observation mission, the Mother
See of Holy Etchmiadzin has clearly expressed its stance on the
election results. We consider all attempts of making the Holy Church,
the Armenian Catholicos, and the Gospel of the Virgin Mary [which is
used during the swearing-in ceremony of Armenia’s President] a target
of political manipulations to be inadmissible.

At this period of Lent, we invite our nation’s children to pray. We
call on them to be guided by the spirit of brotherly love and
solidarity and keep away from intolerance and hatred.

We also urge [Heritage party leader] Raffi Hovannisian to stop his
hunger strike in Freedom Square, and to choose a more constructive
means of political struggle. The Church does not accept a hunger
strike because it threatens God-given life.”

Addressing people in one of his rallies in Freedom square, Raffi
Hovannisian, the official runner-up in February’s presidential
election, said, “If on April 9, Serzh Sargsyan takes a fake oath on
the Bible, and if the Catholicos desecrates the Bible, they will do
it over my dead body!”

Azerbaijan is far from being free-visa regime country out of the six
member countries of the “Eastern Partnership” of the European Union.

Besides Azerbaijan other countries like Armenia, Georgia, Ukraine,
Belarus and Moldova participate in the program, the Azerbaijani Radio
Liberty says.

The Radio Liberty said that in order to find out how each country
meets the criteria for a visa-free regime, one can check the table
of index on visa regime liberalization, prepared by the Coalition
“Europe without visas” and the Stefan Batory Foundation.

According to a report, the Index assesses the work done in four areas:
it is the information contained in the documents of the citizens,
including the availability of biometric cards, immigration and
readmission, that is, return, public safety and fundamental rights.

“Among the six countries of the Eastern Partnership Azerbaijan has
implemented the least work on all four aforementioned areas,” Radio
Liberty writes.

Thus, in the block “Documents” is noted that Armenia was awarded 7.5
points, Georgia 7.5, Moldova 9, Ukraine 4.5, Belarus and Azerbaijan
shared the last place with 4 points. In the block of “uncontrolled
immigration” Moldova received 8. points7, Ukraine 7, Georgia 6.3,
Belarus 5, Armenia received 6.2 points. Azerbaijan was again on the
last place with 3.7 points.

Armenia is ahead of Azerbaijan in all criteria.

The reportage notes that the volume of the work implemented in the
field of free-visa regime, Azerbaijan remained at the same level as
it was in December 2011.

The Head of the Centre for Migration Alovsat Aliyev said that
Azerbaijan does not sign an agreement on readmission. “Other countries,
including Armenia, acceded to the Agreement on readmission.

This agreement, to which EU gives importance, means that the country
has made a commitment to the EU for the return of its citizens to
their homeland. Azerbaijan does not take such an obligation,” he said.

According to him, Russian citizens pay 30 euros for a Schengen visa,
Armenian citizens pay 30 euros too, and the citizens of Azerbaijan
pay 60 euro.

Prosperous Armenia party leader Gagik Tsarukyan had and has no wish to
buy Armenia’s national carrier Armavia, his spokesperson Iveta Tonoyan
told Tert.am, asked to comment on the news published in Hraparak paper.

“Moreover, if there are organizations able to assume the works of
the sphere, solve the existing issues and improve the quality of the
services, Gagik Tsarukyan will only welcome it,” she said.

According to Hraparak paper, PAP leader met with Armavia’s owner
Mika Baghdasarov and discussed the purchase of the airline, urging
Baghdasarov to declare it bankrupt.

“The information published in press does not correspond to reality
and is a result of imagination. Regretfully, but such like continuous
misinformation reduces public’s trust toward mass media,” she said.

ARMENIA AHEAD OF TURKEY IN UNDP HUMAN DEVELOPMENT REPORT

Armenia is three points ahead of Turkey in the latest Human Development
Report unveiled by the United Nations Development Program (UNDP).

The document has placed Armenia in the 87th position, which this year
is the lowest position in the South Caucasus region. The country’s
ranking has lowered by one point since 2012.

The Human Development Index is an annual report featuring a
comprehensive statistics of the life expectancy, literacy level and
per capita GDP income in world’s different states. The criteria rate
countries in four general groups – very high, high, low and average.

This year’s report, entitled The Rise of the South: Human Progress
in a Diverse World, looks at the evolving geopolitics of our times,
examining emerging issues and trends and also the new actors which
are shaping the development landscape.

Norway remains a leading country in this year’s index featuring 187
states. Australia and the United States come next. The other countries
in the top ten list are the Netherlands, Germany, New Zealand, Sweden,
Ireland, Switzerland and Japan. Armenia, together with its neighbors,
is in the group of countries with a high human development.

Georgia, which ranks the 74th, is this year a leading country in the
South Caucusus region. Iran is the 76th and Azerbaijan is the 82nd
stets in the 2012 ranking.

The index has been published annually since 1990 to provide a general
outlook on the human development level in different country. It also
serves as a guideline for future investment or business plans in the
given state.

LES EVENEMENTS DE KHOJALY : COMMUNIQUE DE PRESSE DU COLLECTIF VAN

De multiples evenements se deroulent cette semaine a Paris et dans
le monde, pour commemorer les evenements de Khojaly, qui ont eu lieu
en fevrier 1992 en Azerbaïdjan.

Les informations sont surtout relayees par le site negationniste
Turquie News [1] qui ne manque pas une occasion de designer les
Armeniens a la vindicte publique. Mais une pleine page de publicite
[2] a egalement ete inseree dans le numero du 18 fevrier 2013 de ” A
Nous Paris ” (magazine gratuit parisien), pour promouvoir le ” Concert
pour Khojaly ” organise en l’Eglise Saint Roch jeudi 21 fevrier, avec
des musiciens de renom, a l’initiative du Cercle Europeen d’Azerbaïdjan
(TEAS).

Il faut retourner deux decennies en arrière pour comprendre l’origine
du mythe de Khojaly. En fevrier 1992 – durant le conflit qui
opposait l’Azerbaïdjan a la Republique armenienne du Haut-Karabagh –
Stepanakert, capitale de la RHK, etait nuit et jour sous le feu azeri.

Sa population etant condamnee a la famine et a la mort, il etait vital
pour les forces de liberation armeniennes de prendre la localite
de Khojaly d’où partaient les bombardements. Bien avant l’assaut,
les autorites armeniennes ont prevenu qu’elles menageraient un
corridor humanitaire afin que la population civile de Khojaly puisse
etre evacuee vers l’Azerbaïdjan. Mais c’etait sans compter sur la
politique interieure de l’Azerbaïdjan. Le 26 fevrier 1992, les civils
azeris sont devenus les victimes d’un jeu machiavelique entre les
forces nationalistes du Front Populaire Azerbaïdjanais desireuses de
provoquer la demission du President azerbaïdjanais Ayaz Mutalibov,
et leurs adversaires.

Tous les temoignages [3] – y compris celui du President Mutalibov
! – concordent pour dire que les habitants azeris de Khojaly ont ete
fauches par les soldats (reguliers ou non) de leur propre Etat. Leurs
cadavres ont d’ailleurs ete trouves a plusieurs kilomètres de Khojaly
dans un territoire sous contrôle des troupes azerbaïdjanaises. Ils
ont donc bien utilise le corridor humanitaire et ont atteint Aghdam,
avant de se replier legèrement et de tomber sous les balles de
leur propre camp. Comme en 1915, l’idee etait en fait de faire
porter aux Armeniens la responsabilite de cette tuerie : pour cela,
les miliciens azeris n’ont pas hesite, deux jours après les faits,
a revenir travestir la scène du crime, a scalper et profaner leurs
propres victimes dont le nombre a constamment evolue a la hausse.

Depuis 1992, l’Azerbaïdjan, allie de l’Etat negationniste turc, tente
de faire passer les Armeniens pour les auteurs de crimes de masse,
afin de susciter la haine non seulement au sein de son propre peuple,
mais aussi parmi les Turcs et les musulmans en general. Le but a ete
atteint : des appels au meurtre d’Armeniens sont regulièrement lances,
y compris en France par de jeunes issus de l’immigration turco-azerie.

Et comment ignorer la situation des chretiens d’Orient, souvent
persecutes, en proie a tous les dangers, et designes comme coupables
de genocides imaginaires a l’encontre de musulmans ?

Les autorites azerbaïdjanaises ont transforme la tragedie de
Khojaly en fonds de commerce visant a faire sombrer dans l’oubli
les pogroms anti-armeniens de Soumgaït (1988), Bakou et Kirovabad
(1990) et de Maragha, village du Haut-Karabagh où, le 10 avril 1992,
leurs militaires ont sauvagement tue 100 civils armeniens. Bakou est
epaule dans son entreprise de mystification par Ankara qui voit dans
le pseudo ” genocide de Khojaly “, le pretexte ideal pour enterrer,
aux niveaux politique et historique, le genocide des Armeniens de
l’Empire ottoman, et la spoliation de ces derniers.

Selon une depeche de l’Agence de Presse officielle azerie, la
Commission des Affaires etrangères de la Chambre des deputes du
Parlement tchèque, aurait adopte a l’unanimite le 7 fevrier 2013
une resolution condamnant l’Armenie pour crime contre l’humanite
a Khojaly. Si l’information etait averee, elle serait un exemple
terrifiant du pouvoir de propagande (et de persuasion “sonnante et
trebuchante”) de la dictature azerbaïdjanaise auprès des instances
internationales.

En tant qu’association de lutte contre le negationnisme, nous ne
pouvons rester indifferents aux evenements organises en France qui
promeuvent un mensonge d’Etat, au mepris de la memoire des innocentes
victimes de Khojaly, tombees pour satisfaire les desseins de leurs
politiciens.

WASHINGTON-The Chairman of the House Foreign Affairs Committee,
Ed Royce (R-CA), joined with fellow members of the Congressional
Armenian Caucus and the visiting Minister of Youth and Culture from the
Nagorno Karabakh Republic Narine Aghabalyan in a bipartisan Capitol
Hill celebration today marking the 25th anniversary of the Artsakh
democracy and freedom movement.

Aghabalyan addressed the celebration and highlighted some of the most
pressing issues facing the Nagorno-Karabakh Republic today. Below is
the text of the English translation of Aghabalyan’s presentation:

Reverend Fathers,

Your Excellency Ambassador Markarian,

Honorable Members of Congress,

Ladies and Gentlemen,

First of all, I would like to thank the Congressional Caucus on
Armenian Issues for this initiative, which once again shows Congress’
interest in the peaceful settlement of the Azerbaijani-Karabakh
conflict, in preserving peace, and in fostering democratic progress
in the South Caucasus.

I would also like to thank all those who are participating in this
event, in particular the Armenian Embassy, the Armenian National
Committee of America, the Armenian Assembly of America, NKR office and,
of course, all of you for being here.

Recently, Armenians, not only in my homeland but also in many countries
around the world, including the United States, are celebrating the
25th anniversary of two historic events, which have played a crucial
role for the people of Artsakh: the Karabakh movement and the Sumgait
massacres. The Karabakh movement symbolizes the struggle of the
Armenians of Artsakh for their rights and freedoms.

I was lucky not only to witness these historical events, but also
to be a direct participant. The Karabakh movement started at the
end of 1980’s. It was the period of Gorbachev’s Perestroika, a new
approach was initiated in the Soviet Union. It gave people a hope for
democratic change and inspired them to speak out about problems that
had existed in the Soviet Union for decades, but were subjected to a
“symbolic silence” under the Communist regime. The Karabakh issue was
one of those problems, and, I am proud to say, we were the first to
break the silence.

When the Karabakh movement started I was a student at the Educational
Institute in Stepanakert. On February 13, 1988 young students decided
to organize a rally and publicly declare that we wouldn’t tolerate
Azerbaijani oppression any longer and that we wanted to decide the fate
of our historic motherland ourselves. When the Institute leadership
learned of our intentions, they locked the doors to prevent us from
going into the streets. We had no other option but to jump – jump out
of the second story windows to the street below. In fact, with that
jump we not only broke through the physical barrier before us, but
through a barrier deep within us. It was a moment of civic awareness,
of rebirth, the beginning of the people’s battle against dictatorship
and injustice.

Once on the street, we moved to the city’s central square. The whole
population of Karabakh joined our movement. The people understood that
they were the real power and they were the decision makers. It was a
courageous step to take living under the control of Soviet regime. It
was for the first time in the Soviet Union that people went to the
public square to raise their voice and stand up for their rights.

The Parliamentarians of the time supported the will of people of
Karabakh. On February 20th, the Regional Council of the People’s
Deputies in Karabakh decided to request that the Soviet authorities
transfer the Nagorno Karabakh Autonomous Oblast (NKAO) to Armenia. Our
forefathers had dreamt, and also worked, for this since 1921 when
Karabakh had been arbitrarily and forcibly placed under Azerbaijani
administration by decision of the Caucasian Bureau of the Communist
Party.

We were naive enough to believe that the central government in
Moscow would hear our voice and make the right and moral decision. We
believed that there was nothing anti-constitutional in our request,
since the reforms that were being carried out in the USSR in 1980s
gave us hope that justice would triumph.

However, just a few days later, Sumgait began.. With the silent
agreement of the authorities and the complete inaction of the
law enforcement agencies, an Azerbaijani massacre of the Armenian
population of the city was organized. Innocent people were being
murdered, raped and maimed simply for being Armenian. That was the
Azerbaijani response to our peaceful protests.

The events in Sumgait became the “litmus-test” for the totalitarian
Soviet regime, which demonstrated its inability for true reform. The
events which started 25 years ago on this tiny spot on the world
map – in Nagorno Karabakh – would have a significant impact not only
on this region but also on the collapse of the Soviet Union and the
future geopolitical developments worldwide.

We faced a threat of physical annihilation and we had to take measures
for self-defense in the face of Azerbaijani military aggression.

The imposed war cost thousands of lives, almost completely destroyed
Karabakh’s economy, infrastructure, housing, cultural and civic
centers and caused the forced displacement of many of our people.

For four years we lived in dark, wet basements, without light and gas,
without any possibility to find clean drinking water. Our homes were
being shelled every minute, our children could not go to school. Many
of our children learned to count by counting the shells of fired
bullets. They also learned to distinguish the type weapons used
against us, by the sounds they made.

I am sure that many of you know the story well, so I won’t go
into greater detail about the past. Let me speak about the current
situation.

A quarter of a century has passed and today the Nagorno Karabakh
Republic (Artsakh) is a free, sovereign and democratic state. In the
last 25 years significant progress has been made to rebuild that which
was destroyed by war, to meet the basic needs of our people to thrive
and build a democratic state.

Internationally unrecognized and therefore largely deprived of
much-needed support, we have chosen the path of democracy and built a
state where human rights and civil rights are considered our highest
of values. Artsakh’s commitment to democratic principles have been
affirmed by U.S. legislators and all the international observers who
have, in recent years, served as observers at Artsakh’s presidential,
parliamentary and municipal elections.

We have achieved all this while being under constant military threat
by Azerbaijan. There are shootings on the Azerbaijani-Karabakh border
every day which frequently cause the death of our 18-20 years old
youth. This is evidence of how fragile the peace is in our region
remains.

Of course, the role of the OSCE Minsk Group, in which the United
States serves as a Co-Chair, is crucial in maintaining peace in
the conflict zone. On behalf of the authorities and people of the
Nagorno Karabakh Republic, I want to thank the U.S. government for
its mediation efforts within the OSCE Minsk group.

Unfortunately, I believe that what is happening in Azerbaijan today
doesn’t leave space for much optimism that the mediators will be able
to secure tangible results in the near future.

Both in Artsakh and Azerbaijan a new generation is growing, offering
the opportunity to sow the seeds of tolerance which will help us reach
a stable and long-lasting peace. But, sadly, that’s not happening,
for only one reason: With Azerbaijan threatening war every day,
people on both sides of the border have to prepare for that war.

The President of Azerbaijan declares that all Armenians of the world
are the number one enemy of Azerbaijan. He glorifies and makes a
national hero of a man who beheaded a sleeping Armenian lieutenant with
an axe, and presents him as a role model to the coming generations. He
pursues and organizes persecution of a national writer at a state
level only because he dared to present his point of view about the
conflict between Azerbaijan and Karabakh in his novel…

This list could go on, and these are not events of the past, they
happen every day and cast doubt not only on Azerbaijan’s willingness
to solve the problem in a peaceful way, but also on their promises
to ensure the future security of the people of Nagorno Karabakh.

The first step in the peaceful settlement of any conflict is civic
dialogue. In this regard, I would like to draw the attention of this
respected audience and especially Members of Congress to the fact that
Azerbaijan is not ready for civic dialogue and at the same time tries
to prevent or interfere with Artsakh’s communication with the world.

For many years Azerbaijan has been conducting an isolation policy
towards the Nagorno Karabakh Republic that absolutely defies common
sense. Everyone who visits Artsakh is included in Azerbaijan’s “black
list,” even if they visit Artsakh with the most peaceful of missions
or for simple tourism. Members of parliaments of various countries,
political and public figures, who have visited Karabakh as elections
observers, various journalists who came to report the events taking
place in Artsakh, sculptors, singers, painters and others have been
included in Azerbaijan’s “black list.” Even astronauts Charles Duke
and Claude Nicollier, who took part in the conference titled ‘Man and
Universe’ dedicated to Neil Armstrong, in Stepanakert, were included
in Azerbaijan’s persona non grata list. It turns out that even people
who have travelled to the moon have to ask Azerbajan’s permission to
visit Karabakh. If this policy continues, I suppose, the number of
the people registered in Azerbaijan’s black list will exceed that of
the population of their country because the number of the visitors
to Artsakh increases annually by at least 40-50 percent. In fact,
Azerbaijan’s absurd behaviour in seeking to prevent Artsakh from
participating in international exhibitions creates an additional
interest in Arstakh, which also increases the number of visitors
to Artsakh.

Azerbaijan’s policy of isolating Artsakh from the world may be
explained by the fact that Baku, despite its claims, is not interested
in making the international community aware of what really happens
in Artsakh. Because the reality completely differs from the ‘truth’
that it is trying to present to the world.

Of course, we welcome the efforts, made by all those institutions and
public figures who try to temper Azerbaijan, however it’s obvious
that Azerbaijan succeeds in escalating the tension in the region
and endangering the process of the peaceful settlement of Karabakh
conflict. In such a situation, naturally, we must note that 25 years
is enough for us to have learned the lessons from the past, and that
today, more than ever before, Artsakh is ready to defend its rights.

The Nagorno Karabakh Republic is a legal state, which was created
through the free expression of the democratic will of the people of
Karabakh, and it is, in fact, the non-recognition of this state that
contradicts international laws and norms. Our unrecognized status
prevents the full realization of the rights of the people who live in
Artsakh. It is appropriate to cite the words of the third President
of the United States, an outstanding public figure, Thomas Jefferson:
‘Everything is changeable in the world except the natural rights
of people.’

In this regard, I would like to thank the representatives of the U.S.

legislature who have been defending the rights of the Karabakh all
these years, have worked for the recognition of the Republic of
Artsakh, and assisted in the development of democracy in Artsakh. On
behalf of NKR authorities, I would like to thank and convey the Artsakh
people’s warm greetings and best wishes to the American legislators
who congratulated the Artsakh Republic President and people on the
25th anniversary of the Artsakh movement. We would be glad to see you
in Artsakh, because the best way to know the reality about Artsakh is
to visit. My country welcomes everyone who comes with kind intentions
to see and learn more about our Republic.

The French artists who have recently given concerts in Artsakh
confessed that ‘in Artsakh you can find such frankness and depth as
nowhere else’.

In the recent years we hear more and more frequently about these kinds
of praise from international visitors. They come to see the historical
monuments of Artsakh, which number in the thousands, to learn about
our culture, rest in our beautiful nature, enjoy the clear air, and
communicate with the people of Artsakh, who have always been known
for their hospitality.

Of course the role of Armenia and Armenian Diaspora including the
Armenian Diaspora in the United States is immense in the establishment
and development of Artsakh. A meaningful part of the problems we face
in Artsakh over the last several years has been solved due to the
annual aid from the American Congress. By the way the United States
is the only country, which provides direct aid to Artsakh.

This aid solves problems of vital importance and helps our people
to overcome the consequences of Azerbaijan’s war. So in conclusion,
once again I would like to thank the Congress and people of America
and express hope that the United States will remain committed to its
political mission and continue its efforts in supporting peace in
Artsakh and the South Caucasian region, and stand for basic fairness
in recognizing the inalienable right of people of Artsakh to self
determination.

Armenians Mark 116th Anniversary Of Charents

ARMENIANS MARK 116TH ANNIVERSARY OF CHARENTS

On March 13, 2013, Armenians are marking the 116th anniversary of
renowned Armenian poet Yeghishe Charents. Pupils from Yerevan schools,
literary critics, poets and prominent cultural figures today visited
the memorial to the great writer.

Every year on this day we gather here to congratulate the birthday
of the most untranslatable and the most spiritual poet and genius
which will always remain alive for us, said Lilit Hakobyan, director
of Charents museum in Yerevan.

“Charents was one of the greatest poets of the 20th century who shared
with his people all sufferings and hardships, falls and delights,”
said Levon Ananyan, President of the Writers’ Union of Armenia.

“Yeghishe Charents has gifted many beautiful poems to Armenians. We
should be proud of him and return him everything. I like his “Yes
Im Anush Hayastani” (To My Sweet Armenia) most of all,” said pupil
Armen Barseghyan.

Yeghishe Charents was born in Kars in 1897. The outstanding poet of
the twentieth century fell victim to Stalinist repression.
