A Yerevan court has ruled to use arrest as a measure of restraint in
relation to Narek Harutyunyan, President of Narekatsi Art Union.

The Court of First Instance of Nork-Marash administrative district
ruled that Harutyunyan remain under detention for two months.

Narek Harutyunyan is accused of evading paying a total of 109 million
(approx. $283,000) drams in taxes.

Following Harutyunyan’s arrest, his brother Saro Harutyunyan, issued
a statement, saying his brother was arrested on false and baseless
accusations.

“There has not been a due [investigation] process; no one has brought
any accusation against my brother, nor do they allow the release on
bail. This is simply a psychological terror that must receive its
deserved assessment,” said he.

Saro Harutyunyan also said that the aim of the arrest is to extort
large sums from him.

If this case of abuse of power against a Diasporan Armenian goes
unpunished, it will cause doubts with other Diasporan Armenian who
want to help the homeland, he added.

Activists created a group on the social networking website Facebook,
calling on Armenian authorities to set him free.

Hraparak: Vazgen Khachikyan Was Interrogated

The paper claims that Vazgen Khachikyan, former chief of social
security service, was seen by one of its reporter as entering the
police station on Nalbandyan Street on Friday.

The paper assumes that Khachikyan was in all probability interrogated
over an embezzlement case in the social security service.

Further, the paper says Khachikyan could not be contacted for
clarifications.

According to the paper, Ashot Aharonyan, the head of police press
service, neither denied, nor confirmed the version of interrogation,
adding that “several people have been summoned and interrogated within
this case”.

“For the interests of the investigation, it is inexpedient now to
publicize data on those people,” Aharonyan was quoted by the paper
as saying.

The OSCE and other international organizations should put more effort
into the settlement of the Karabakh conflict, a top Azerbaijani
official has said.

The head of the foreign relations department at the Presidential
Administration, Novruz Mammadov, said the OSCE should not just rely on
the co-chairs of the OSCE Minsk Group but act on the recent statement
by the leaders of co-chair countries and call on the international
community to be effective in resolving the conflict.

“I think that just the statements of the co-chairs are not enough. The
point is that the biggest mission of the OSCE and other international
organizations is to ensure security. For example, the OSCE was
established to ensure security and cooperation in Europe. However,
as long as the conflict remains unsettled, Europe’s security cannot be
ensured. From this point of view, it’s necessary to exert all efforts
and stand for a just settlement of the conflict,” the New Azerbaijan
Party website reported Novruzov as saying.

He described Armenia is a country occupying 20% of Azerbaijani
territory for 20 years.

“Armenia must withdraw from the occupied territories. The next stage
should focus on this. The OSCE Ministerial Council’s summit in Vilnius
once again heard statements about the necessity to change status quo.

I think it necessary to increase efforts on this.”

Mammadov said that Azerbaijan’s election as a non-permanent member
of the UN Security Council in 2012-2013 would provide an opportunity
to put forward the issue.

China Interested In Direct Air Service With Armenia

Chinese air companies are interested in direct links with Armenia,
Liu Chuan, President of Huahe International, head of the Chinese
delegation to Yerevan, said at the Armenian-Chinese business forum,
News Armenia reports.

The first Armenian-Chinese business forum started in Yerevan on
Thursday and saw 11 Chinese and 39 Armenian companies. Chuan said that
they have direct air service with Tbilisi and Baku, air connection
with Yerevan would be profitable.

Rovert Arutyunyan, Chairman of the Armenian Development Agency,
says that Armenian Chinese trade turnover through the Black Sea Port
of Poti (Georgia) is realized with especially low prices of $1,800
per container.

Arutyunyan believes that construction of the North-South (Armenia-Iran)
railway would open new opportunities for ground trade with China.

According to statistics for January-October 2011, Armenian-Chinese
trade turnover dropped by 3.5%, compared with the same period in 2010,
totaling $341 million. Armenia exported products worth $9.8 million
(0.9% of all exports) to China (-59.6%). It imported products worth
$331.2 million (+0.6%). Chinese exports totaled $172.9 million
(-10.9%).

Armenia exports marble, copper, ore, stone, pipe, cognac and other
alcohol drinks to China. China imports electronics, computers,
household goods, construction materials, metal constructions, vehicles,
polymers, clothes and jewellery to Armenia.

Armenian Deputy Foreign Minister Shavarsh Kocharyan has criticized
Azerbaijan for “destructive” approach to the settlement of the
Karabakh conflict.

“It has become a tradition with official Baku to juggle documents it
has signed and to stand back when there is a smallest opportunity
to register some progress in the Karabakh conflict settlement,”
Kocharyan said in an interview to Armenian Public TV on 7 December. He
expressed confidence that Azerbaijan’s “destructive” steps were aimed
at preserving the current status quo in the settlement process despite
Baku’s contrary statements.

Kocharyan said the conflict was the result of Azerbaijan’s “aggression
towards self-determined republic of Nagornyy Karabakh” and had serious
consequences because Baku resorted to policy of force from the very
beginning.

“If Heydar Aliyev was searching for some compromise, was ready to
negotiate with the Karabakh authorities, his son, Ilham Aliyev,
has inherited Elcibay’s policy, and all his attempts are aimed at
preserving the power in his hands,” Kocharyan said.

Armenian Deputy Foreign Minister said Azerbaijan’s policy was not
serving the interests of the Azerbaijani people, but the interests
of the ruling hereditary clan which threatened security and stability
not only in the region but in their own country as well.

Commenting on a joint statement signed by the OSCE Minsk Group
co-chairmen and Armenian and Azerbaijani foreign ministers in Vilnius,
Kocharyan said that it once again confirmed the principles contained
in the statements adopted earlier for the peaceful settlement of
the conflict and the creation of an atmosphere of trust between the
parties to conflict. He added that the OSCE mediators once again
urged the sides to agree on carrying out investigation into all the
recent incidents on the contact line between Armenian and Azerbaijani
armed forces.

Mayor of Marseille Jean-Claude Gaudin held a reception at Marseille
Mayor’s Office on December 7 in honor of President Serzh Sargsyan,
a Panorama.am correspondent reported from France.

In his remarks, Mayor Jean-Claude Gaudin touched upon the occasion of
the President’s visit, the Congress of the European People’s Party
(EPP) being held in Marseille as well as Armenian-French relations,
the role of the port of Marseille in rescue of Armenian Genocide
survivors and the Armenian community of Marseille. The Mayor thanked
the Armenians for their efforts in prosperity of the city over the
past century.

Jean-Claude Gaudin also talked about the friendly relations between
Marseille and Yerevan. The Mayor noted that there is a new possibility
for adoption and implementation of a bill criminalizing denial of
the Armenian Genocide, and the issue can be settled in the near future.

President Serzh Sargsyan in his remarks also stressed the significant
role of Marseille in salvation of Armenian immigrants as well as
the consistency of the French government and particularly municipal
authorities of Marseille in settlement of the Armenian issues. He
thanked French President Nicolas Sarkozy and Marseille Mayor
Jean-Claude Gaudin on behalf of the Armenian people.

Serzh Sargsyan reiterated his invitation to Jean-Claude Gaudin to
visit Yerevan and assuring that the fir he had planted in Yerevan
will not be left without care, nevertheless expressed the hope that
he will visit Yerevan and will personally water the tree.

Prime Minister Tigran Sargsyan paid a visit to Lori and Shirak Marzes
of Armenia, dated to the 23rd anniversary of the devastating earthquake
of 1988. The head of government laid wreaths at the victims’ memorials
in Spitak and Gyumri, paying homage with a minute’s silence.

Then, attended by Prime Minister Sargsyan, a renovated kindergarten,
a community center and a medical facility were inaugurated in Amasia.

The kindergarten is supposed to host some 60 children from the local
districts.

The building’s ground floor hosts the administrative premises, a health
hub, a playground, a venue for gatherings and a computer room, with
the first floor intended entirely as a nursery school consisting of
two groups of thirty children each, featuring a bedroom, a recreation
lounge, a cloakroom, a bathroom.

The second floor of the building hosts an eighty-seat hall of
celebrations, which can also be used for events of local importance.

The facility was refurbished with funding available from the Armenia
Social Investment Fund to a total cost of AMD 100 million.

The Amasia medical center attends some 9 thousand people from the
community and the surrounding areas. It has a maternity ward, an
outpatient clinic and an ambulance service, which are equipped with
all necessary medical equipment. The project was funded to a total
cost of 88 million drams.

The Premier also called at Amasia’s WKS textile factory where he
was introduced to the manufacturing process. The factory employs 105
people and exports the totality of its output toward Germany.

The U.S. will present anticorruption experience of Georgia to Armenia,
Azerbaijan, Kyrgyzstan, Moldova and Ukraine. As Georgian media outlet
reports regional conference “Georgia a model of successful clean-up”
opened yesterday in Tbilisi.

Organizers of the meeting are the Main Prosecutor’s Office of Georgia,
U.S. Department of Justice and the U.S. Embassy to Georgia.

Delegations from Armenia, Azerbaijan, Kyrgyzstan, Moldova and Ukraine
participate in the conference. They familiarize themselves with
Georgian experience in reforming and clean-up. Workers of U.S.

Department of Justice, American and European expert are participating
in the meeting.

The top prosecutor of Georgia Murtaz Zodelava addressed to participants
of the conference; he state that Georgia is proud of achieved results
thanking to which “the country is called No.1 in the world over
clean-up”. According to the top prosecutor, the success is conditioned
by reforms in education and justice, modernization of public service,
reforms in state purchases system and in others spheres.

Recall, the President of Georgia Mikhail Saakashvili, paying visit
to Bishkek in early December 2011, invited local specialist to visit
Tbilisi and to familiarize themselves with reforms on site. In his
opinion, Georgia and Kyrgyzstan are very much alike.

Ankara is searching for ways to renew dialogue with Yerevan, Armenia
Today reports.

Ankara is trying to use the OSCE Council of Foreign Ministers in
Vilnius to smoothen relations with Yerevan. Turkish Minister Ahmet
Davutoglu met his Swiss counterpart Micheline Calmy-Rey who mediated
development of protocols to normalize Armenian-Turkish ties earlier.

The meeting is to clarify whether Switzerland wants to play the same
role in helping resolve the Armenian-Azerbaijani Nagorno-Karabakh
conflict.

Turkey is under serious US pressure in normalizing relations with
Armenia. The Armenian community of the US urges Washington to recognize
the genocide of 1915. Vice-President Joe Biden said that a major
anti-Turkish campaign is ongoing. The Jewish and Greek communities
support the Armenian in the issue. There are concerns that a new
attempt of recognizing the Armenian genocide at the Senate may be
approved by the US legislatives for the coming presidential polls.

Plaintiff unhappy about comments that readers posted on newspaper’s
internet site.

A defamation case brought against an Armenian newspaper for the
comments readers posted on its website has alarmed media experts,
who warn that this kind of action could erode freedom of expression.

Lawyer Artur Grigoryan has taken out a libel case against the weekly
Hraparak, because of comments left under an article headlined “Are
Citizens the Victims of Dishonest Lawyers?” published on August 10.

He is demanding 18 million drams, 47,000 US dollars, in damages –
a large sum for Armenia, and says he wants to force the weekly out
of business.

“This newspaper is a danger to every citizen of Armenia, so I am
determined to shut it down,” he said. “I have a cordial relationship
with the rest of the media. Hraparak’s stance is dishonest and wrong.

It publishes slander instead of fighting for press freedom. It
publishes one-sided articles and throws mud at ordinary people.”

His lawsuit is one of a spate of civil actions launched since
defamation was removed from the criminal law code last year. Since
then, some 30 civil cases have been brought to court, raising fears
of a sharp increase in damage awards against media outlets.

Grigoryan bases his complaint on comments posted by readers, who
complained about the service they had got from him as a lawyer.

Hraparak’s editor Armine Ohanyan said readers’ comments appeared
automatically on the site, but were edited for obscene language
subsequently.

She said Grigoryan seemed determined to pick a fight, since he could
have chosen a more reasonable response.

“He didn’t even phone the office to ask us to remove these comments
from the site. He just wanted to launch a legal case,” she said. “And
what will he say if the people who complained about him refuse to
retract their words?”

This is the first case in Armenia where a publication has been sued
just for comments left on its website, and media experts are baffled
by its implications.

“The consequences of this are hard to predict. It isn’t clear
who’s going to be taken to court, and for which comments. And who
is answerable for these comments? Everyone could be dragged in,”
Gegham Vardanyan, editor of the website , said.

On November 8, a court in Yerevan froze Hraparak’s bank accounts,
then reconsidered and instead put a temporary hold on its property
so as not to force it out of business.

Shushan Doydoyan, head of the non-government Freedom of Information
Centre of Armenia, said a big damage award of the kind Grigoryan was
seeking would constitute an infringement of the publication’s freedom
of speech, under a ruling from the European Court for Human Rights
that compensation must not exceed a publication’s ability to pay.

“The court must also consider the fact that this case is illogical,
since the paper is not responsible for comments by its readers. Those
who expressed these opinions must be held accountable,” he said,
adding that “of course, this isn’t an excuse for a newspaper tolerating
obscene defamation on its site”.

Following an approach Armenia’s human rights ombudsman, the
Constitutional Court ruled that damages should be proportionate to
the defendant’s means.

It refused the ombudsman’s request to define as unconstitutional a
section of the civil code that defines the scale of libel damages,
but recommended restraint when compensation was awarded. In the legal
language employed by Constitutional Court chairman Gagik Harutyunyan,
“One must avoid imposing an intolerably large financial burden on
the defendant such as might exert a negative financial impact on his
activities and lead to bankruptcy.”

Grigoryan’s lawyer Tigran Atanesyan said his client accepted the
decision, but had no plans to alter his damage claim. Instead, he was
prepared to wait until the paper was in a position to pay the sum he
was asking for.

Atanesyan said newspapers should check readers’ comments before
publishing them. But internet experts denied there was any way of
doing this without imposing censorship.

IT programmer Mikael Ghazaryan warned that if the case was upheld,
one could theoretically leave an insulting comment about oneself on
a website, and then sue its owner for libel.

Anna Maralyan, a lawyer and expert on international law, said that
the European Court of Human Rights had never heard a case of this kind.

She noted that in one case in Britain, the judge found against the
publisher, arguing it should have been aware of the comments and
removed them. The difference was that there was no damage award,
she said.

Maralyan said that if Hraparak could demonstrate that the comments
were posted by a reader, and that it lacked the legal resources to
assess every comment on its site, then the court was likely to rule
in its favour.

The next hearing is set for December 16.

Meanwhile, the Chamber of Lawyers, the body for Armenia’s legal
professionals, is launching a disciplinary action against Grigoryan,
based on the same reader comments on Hraparak’s web site.
