Le 29 decembre 2011, la cour de Garadagh (près de Bakou) a rejete la
demande de liberte conditionnelle formulee en appel par le blogueur
et activiste Bakhtiyar Hajiyev. Une decision prononcee par le juge
Reshad Mustafaev.

L’avocat du net-citoyen, Intigam Aliyev, denonce un procès partial,
politiquement motive et indifferent aux objections de la defense. Il
se dit pret a interjeter appel auprès de la Cour europeenne des droits
de l’homme (CEDH) dans les prochains jours.

Officiellement condamne pour “desertion” (art. 321.1 du code penal),
le jeune blogueur s’est retrouve dans la ligne de mire des autorites
depuis la publication sur Internet de videos denoncant des fraudes
aux elections legislatives de novembre 2010. Poursuivi depuis janvier
2011, il a ete arrete le 4 mars après avoir lance un appel a manifester
contre le gouvernement sur les reseaux sociaux.

Le blogueur Jabbar Savalan, arrete le 5 fevrier 2011, avait lui
ete accuse de possession de drogue, après avoir egalement appele a
manifester. Il a ete grâcie le 27 decembre 2011.

Les manifestations pro-democratiques, survenues en mars et avril
2011 a Bakou, dans le sillage des printemps arabes, ont ete durement
reprimees, internet et les blogueurs ont tout particulièrement ete
vises. Reporters sans frontières reitère son soutien a Bakhtiyar
Hajiyev et appelle a sa liberation immediate.

All the four May issues of the “Telerama” weekly issued in France and
having 1 million copies will fully be dedicated to the world famous
singer Charles Aznavour. Armenpress correspondent from Shirak reports
that for completing the raw of essays about the artist responsible
for the May issue and correspondent of the weekly Clementine Derodit
is in Armenia. She has already been in Yerevan and Gyumri and will
soon visit Vanadzor and Akhalkalak.

“Telerama” is an art weekly. Annually four issues are being prepared
especially for one author. In May the weekly will fully be dedicated
to Charles Aznavour. It is impossible to speak about Aznavour and
not present Armenia, the artist’s ties with Armenia,” she said.

Sharing her impressions from the already conducted meetings, French
journalist said she has been accepted very warmly.

“Of course, in France everyone accepts Charles Aznavour as a great art
figure but in Armenia he is spoken about with special warmth. It is
strange that in Armenia people insist that Aznavour is a world star and
present their love toward him very modestly. Aznavour is like a key:
you say Aznavour and all doors open. Generally, I have been in many
countries but Armenia is the first one to love French people so much,
and be so hospitable,” she said.

PanARMENIAN.Net – The European Union has prepared to release a
judiciary report on Turkey this week criticizing the justice system,
particularly the unreasonable periods of detention.

The EU Council’s report was prepared upon the visit of the Council
of Europe Commissioner for Human Rights Thomas Hammarberg to Turkey
in October.

“There are some functional problems that have continued for a long time
and have affected the system negatively,” said the report, according
to daily Hurriyet. The report also cites the problem of presumption
of innocence not being used in court decisions when arresting suspects.

There are also problems in impartiality and independence of judges
and prosecutors, said the report, which also criticized the prolonged
periods of detentions and prosecutions. The report urged officials
to use “release on bail” as an option instead of detention.

The European Court of Human Rights has made over 2,200 decisions
against Turkey between 1995 and 2010.

Almost 700 of these decisions were about violating the right to a fair
trial. More than 500 of the cases were about freedom and security
of the people. The judicial reform strategy that started in 2009
to adjust the laws within the EU norms should be put into action,
the report said.

Lengthy detention periods were still a significant problem despite
measures taken to prevent them. The lack of compensation for the
duration of detention or lack of access to a mechanism to fasten the
prosecution also increases the judiciary problem, the report said,
according to Hurriyet Daily News.

Aghasi Abrahamyan, 18, killed on August 26 in the military unit of
Yeghnikner, NKR, was the victim of the cruelest crime in the army
in 2011. There were 19 traces of violence on the body of the young
man, including hemorrhages, open wounds, bruises, injuries of kidney
and brain.

His mother’s scream “they made a salad out of my son” spread through
the media and social networks. People held up the photo of Aghasi’s
mutilated face in front of the prime minister’s office, demanded
clearing the army of murderers.

The military prosecutor, worried about the noise, left for the crime
scene. The ex-deputy minister of defense Vladimir Gasparyan hurried
to announce two days after the murder that it has been revealed. The
fairy tale about urinating in the wrong place which has become part
of prosecutorial lore wanders from one criminal case to another.

Recently we have learned that the serviceman Vahe Harutiunyan who
had allegedly punished Aghasi for urinating under the tree disclaimed
his testimony and refuted the story about urinating in the wrong place.

Certainly, his new position is not final. We have learned that the
investigator is still “working” with the detainee, and he may change
his position again.

So far the second main accused to the case, the head of the medical
service Vardges Poghosyan who was officially reported to have beaten
the soldier who was taken to the medical point with serious injuries
resulting from violence. The two medical assistants of the same
medical point are charged with “light” offenses, namely for a wrong
medical conclusion, informing the head of the medical service about
Aghasi’s state with delay, reporting that he was drunk and simulating.

“The case was in the night of August 26. The head of the medical
service was not informed until 3 o’clock pm. The medical assistants
thought that my boy would be OK and there would be no need to send
him to hospital. They thought if he was sent to hospital, there would
be a lot of fuss about it. They did not understand that my boy’s
life was in danger. The boy was wobbly, in coma. They said he was
drunk,” Gegham Abrahamyan. Aghasi’s father told us. On these days,
he is unable to telephone the investigator Igityan in NKR and learn
about the process of the case.

We also tried to contact the investigator to check our information and
learn about the proceedings on this case. However, he is chronically
and constantly unreachable. Gegham Abrahamyan assures that the months
of the investigation did not add anything to the information released
on the first days of the investigation.

He knew from the beginning that Vahe Harutiunyan who told and showed
how he fought with Aghasi and hit him 5 times and the doctor Poghosyan
could not cause about two dozens of wounds, hemorrhages and other
injuries on the boy’s body. He is sure that others were involved in
the incident who are in the shade of the investigation.

He learned from Investigator Igityan that on the day of the incident
there must have been two officers in charge of duty and the battalion
at the emplacements.

“I inquired about those officers from the investigator. He said their
houses are about 100 meters from the barracks and they were at home
at that time. I am sure that these two officers were involved in the
murder of my son, and I will demand their presence at the trial,”
says the father of the killed soldier.

He will demand to transfer the trial to Yerevan because he has no
advocate, and in this way he hopes to ensure public control over
the trial.

Hence, during the past 5 months the investigation did not move. The
same people are accused, the story about urination has been doubted
and an effort is made to save the commanders of the battalion from
responsibility. By the way, Grisha Yegoryan, another serviceman from
Aghasi Abrahamyan’s military unit, was taken to the military police
of Stepanakert immediately after the murder, and he is still there.

We informed about this in an article on September 20 entitled “Aghasi’s
Friend Detained for 24 Days.”

Echoing our publication, the investigative service of the Ministry of
Defense stated a week later that as of September 22 Grisha Yegoryan was
at the military unit and applied to the investigation body to change
his place of service and defend him, and he will soon be transferred
to another military unit. In fact, the investigative service is busy
with spreading false information.

“Grisha is still at the police. He was expected to move on December
28 but now they have said to transfer him to Armenia on January 13 to
15,” his father told us. Norair Yegoryan says a major told him he is
kept there for the sake of his security, until the trial. My elder son
went there with my father to visit him, and talked to him, he is fine.

Norair Yegoryan says his son and Aghasi Abrahamyan were close
friends. However, he did not see how Aghasi died because he was not
near him at that time. He cannot understand why his son is enclosed
for so long. Grisha is not a witness. For who is he so dangerous? Or
maybe he witnessed something? We expect clarifications from the
head of the investigative service of the Ministry of Defense and the
military prosecutor.

On January 23, the French Senate will consider the draft law penalizing
the denial of the Armenian genocide. The minister for relations with
the parliament of France Patrick Ole made it clear that “a general
agreement was reached on this issue”. Earlier, the mass media had
reported Nicola Sarkozy’s intention to initiate the signing of a
pan-European agreement on penalizing genocides.

It is evident that the recognition of the Armenian genocide passed
the limits of Armenia and even regional politics, though it has never
been there.

In this situation, the Armenia-Turkey and Armenia-Azerbaijan relations
completely lose topicality for Armenia, and they are substituted by
the Armenia-Georgia and Armenia-Iran relations.

Even Western funds, which used to actively finance the Armenian and
Turkish non-governmental projects lost interest in this issue. The news
portals which opened sections in Turkish, connected with the Armenian
and Turkish process, will soon open new ones in Georgian and Farsi.

The interest towards Georgia is already visible: Armenian-Georgian
joint TV programs have been realized simultaneously on two Armenian
channels. Armenia seems to be revealing for itself the Georgian music,
cuisine and rich culture. True, it is done in the traditional way –
competition to find out who is better the Armenians or Georgians,
but the fact of disappearance of the taboo of the Georgian topic
is noteworthy.

The Iranian and Armenian rapprochement is also obvious. In Yerevan,
as well as on the way connecting Armenia and Iran, cafes with Iranian
writing appeared, where Islamic food is offered. There are already
Iranian bakeries, motels and let alone the flow of Iranian tourists
to Yerevan during Muslim festivities.

The annual Armenian-Turkish trade circulation is about USD 250
million, and the Armenian-Iranian, according to non-official data,
more than 300 million, the Armenian-Georgian is this much too. But,
Iran is going to increase the trade circulation up to 1 billion.

Against the background of the development of relations with Iran and
Georgia, the relations with Turkey are no longer important in the
Armenian policy. In this connection, the process of criminalization of
the denial of the Armenian genocide in Turkey is seen in Armenia as
something directly connected with its actual interest. This interest
can arise if the West’s pressure on Turkey increases up to the critical
point, which can be followed by the fragmentation of the country or
demand territorial compensation to the victims of genocide.

No changes are expected in the Nagorno Karabakh issue in the new
political year, political analyst Alexander Iskandaryan told news
conference today. He said there will be meetings, statements, attempts
to maintain the Minsk group process which even if succeeds will not
result in serious changes.

Armenia’s foreign policy sphere is not ending with the NK issue. The
political analyst convinced that more important events are being
elaborated in the whole field. Elections are expected in the Unites
States which are very important for our country. Elections will take
place in Russia as well. Iskandaryan said if formally the results
of the elections are predictable the same cannot be said about the
future developments in Russia.

The processes ongoing in Iran are very dynamic. “I do not think there
will be a war in Iran. But what happens there is very significant for
Armenia,” the speaker said. He positively assessed the processes in
Armenian-EU relations.

Kajaran borderline village and interests of unknown people eager
for robbery are on the scales, says the statement by Rafik Atayan,
Head of the Kajaran Village Administration, provided to ArmInfo.

It is noteworthy that there are around 250 residents in the village,
who are mostly engaged in cattle- breeding. Despite that Government
decision dated April 28 2011 recognizing the 608ha of the village
area of prior public interests, the residents refuse to transfer
their lands to the Zangezour copper and molybdenum combine. Eviction
threatens residents of Kajaran. The government’s decision aroused
wide public response, with Trchkan Initiative Group taking an active
part in the fight against it.

“Residents of Kajaran village will never leave their village, and
won’t let anyone’s personal interest be considered public interest,”
such is the attitude of the village residents. “They speak of ‘high
public interest’ and say that the decision will replenish the budget,”
Atayan says.

Afterall, he says, the goal of the budget funds must be strengthening
of the borderline areas, that is the high public interest.

At the same that the ‘patriotic statements’ of ZCMC Director Maksim
Hakobyan have nothing in common with patriotic views of the Kajaran
villagers. He blamed the leadership of the combine for not hiring
oung villagers demobilized from army to make them leave the village
for earning.

“In addition, we appeal to the German Ambassador to Armenia for
organizing a visit of the leadership of German Cronimet Mining Company,
which is the key owner of ZCMC, to the village. We want to understand
why the company claims the territory of Kajaran if the currently
developed deposit will ensure incomes for at least 2 centuries,”
the statement says.

Artavazd Vanyan said during a press conference on Tuesday.

In his words, no group poisonings were recorded on January 1-9,
but there was one botulism case. Also, there were fifteen cases of
alcohol abuse, and several cases of digestive system disorder.

As per Vanyan, this calm situation was conditioned on the preventive
measures taken and the explanatory work carried out among the public.

And according to the information which Health Ministry Chief of Staff
Suren Krmoyan provided, more emergency calls were recorded during
the New Year, but this was not pended on the deterioration of the

Turkish Ambassador to Azerbaijan Hulusi Kilic has said that Armenia
should withdraw its troops from the territories around Nagorno Karabakh
which will pave the way for the opening of the Armenia-Turkey border.

According to the Azerbaijani news website SalamNews, Kilic also said
that Turkey does not have problems with Armenia to open the border,
but rather conditions.

“The issue that has resulted in closing of the border with Armenia
should be resolved. Armenia should pull out from the occupied
territories and open the border with Azerbaijan after which there
will be no problem in establishing ties with Turkey,” said he.

The Turkish ambassador also said that the West also encourages the
rapprochement between Ankara and Yerevan.

“That is also a sacred issue for Turkey, and we would like to see a
rapid resolution to the conflict,” said he, adding that Turkey is in
favor of equal development in the region.
