The Bill On the Legal Regime of the State of Emergency passed by
the Armenian Parliament is unconstitutional and the oppositional
Armenian National Congress (ANC) alarmed of that yet in November
2011 when the bill was still under elaboration. Gagik Jhangiryan,
ex-military prosecutor of Armenia, Head of the ANC Commission for
State and Legal Affairs, told media on March 23.

He said that the Constitution bans involvement of the Armed Forces
in political processes unlike the bill. Jhangiryan thinks that hasty
adoption of such bill on the threshold of elections is just warning
against post- election public protests. “It is a peculiar message to
manage the public and make it close eyes on the arbitrariness of the
ruling regime during the elections process,” Jhangiryan said.

Nevertheless, he hopes the president will veto the bill, otherwise
the Congress will be fighting against the bill’s coming into force
by all means possible.

The National Assembly of Armenia approved on Wednesday the second and
final reading of a bill determining the legal regime of the state of
emergency by 68 votes “for”, 0 votes “against”, and 0 “abstentions”.

The president in cooperation with the prime minister and the parliament
speaker can announce the state of emergency in response to a real
threat to the country’s constitutional system, like a coup, an armed
rebellion, mass disturbances, an occupation, an ethnic, racial or
religious conflict, and can be ensured by the police and the national
security service. The army should be used only if the police and the
national security service fail the task.

Criminal proceedings might be filed against writer Hovhannes
Ishkhanyan, who on Mar. 22 was once again called in for questioning
by police about his book “The Day of Discharge.”

Ishkhanyan informed Epress.am that a few weeks ago he was called in for
questioning by the military police, who asked him to give a written
explanation regarding certain excerpts of the book, especially those
related to the military, and tell them to what extent this work of
fiction corresponds to real-life events.

The writer replied that his work is a work of art and all the
characters and events described are works of fiction. Ishkhanyan was
forced respond to the same questions at the central police division
on Thursday.

“Judging by their questions and their mood, they see in my book an
insult to the army, an insult to the image of the mother, but since
there aren’t any criminal laws against this, they’re trying to bring
a case against me under the pornography clause, which refers only to
visual arts. From what I understand, they want to launch a criminal
case [against me],” he said.

The Armenian police’s press department informed Epress.am that the
case is currently under review and is being examined also by the
Ministry of Culture. Only after all this will the police decide
whether to launch criminal proceedings or not.

The 178-page novel “The Day of Discharge” published in 2011 in 300
copies and valued at 1,500 drams (about $4 USD), according to police,
contains “sexual relations of a vulgar nature which are described
with the use of gross profanities and statements.”

Les parties du conflit du Karabagh sont d’accord sur les elements clés
d’un règlement et pourraient parvenir a une percée dans le processus
de paix si ells manifestaient plus de compréhension pour le point
de vue de la partie adverse, a indiqué le 21 mars le coprésident
américain du Groupe de Minsk de l’OSCE. “Le plus important, a mon
sens, est que l’on se situe plus près que jamais d’un règlement. Mais
en raison d’un manqué de confiance réciproque, les parties ont du
mal a en prendre conscience”, a indiqué Robert Bradtke, dans un
entretien accordé a RFE/RL a la veille d’une declaration commune
des ministres des affaires étrangères de la troïka du Groupe de
Minsk a l’occasion du 20e anniversaire du lancement du processus.

Bradtke a estimé que l’Arménie comme l’Azerbaïdjan étaient en
désaccord sur les détails des fondamentaux d’un accord de paix
présenté par les Etats-Unis, la Russie et la France et désignés
comme les ” principes de base ”, sur lesquels ont achoppé les
dernières négociatons. Pour le diplomate américain, le diable se
cache dans les details, et en instaurant un climat de confiance dans
les négociations, il serait possible d’en venir a bout et de surmonter
les divergences. Bradtke s’est toutefois bien gardé de divulguer
la nature de ces divergences, ni même des details de ces fameux
principes de base, conformément a l’exigence de confidentialité
qui a toujours présidé au processus de négociations.

Au début du mois, les trois coprésidents avaient visité l’Arménia,
l’Azerbaïdjan et le Karabagh et avaient présenté aux parties un
” plan d’actions ” visant a dégager le chemin vers un accord de
paix. Ce plan viserait a “mettre en oeuvre” la declaration commune
qui avait été faite par les presidents d’Arménie et d’Azerbaïdjan
a l’issue de leur sommet du 23 janvier a Sotchi, sous l’égide du
président russe Medvedev. Dans cette déclaration, les présidents
Serge Sarkissian et Ilham Aliyev s’engageaient a “accélérer la
conclusion d’un accord sur les Principes de base”.

Mais de l’avis des observateurs, les élections présidentielles
prévues l’an prochain tant en Arménie qu’en Azerbaïdjan devraient
rendre difficile la mise en Å”uvre d’un tel engagement. Pourtant,
Bradtke a souligné que les médiateurs pourraient obtenir quelques
avancées dans les mois a venir. Il a notamment fait état de la
poursuite de leurs efforts en vue de mettre en place un mécanisme
d’investigation conjointe sur les cas de violations du cessez-le-feu
le long de la frontière arméno-azerbaïdjanaise et de la “ligne de
contact” séparant les forces du Karabagh et celles de Bakou, où
la situation est plus volatile. Le ministre arménien des affaires
étrangères Edward Nalbandian avait affirmé la semaine dernière
que l’Azerbaïdjan aurait rejeté un tel mécanisme tel qu’il avait
été proposé par la troïka l’an dernier.

Hier, 22 mars, la commission des affaires étrangères du Parlement
européen a adopté un document sur â~@~Kâ~@~Kl’Arménie, qui, outre
autres dispositions, a proposé que l’Union européenne reconsidère
la place de la France au sein du Groupe de Minsk de l’OSCE.

Les documents doivent être mis aux voix lors de la session plénière
du Parlement européen, d’ici un mois. Les experts estiment que la
ratification de cette disposition a peu de chance d’aboutir.

Rappelons que cette action est le résultat du lobbying turco-azéri.

Artsvik Minasyan, an MP of the Armenian Revolutionary Federation
Dashnaktsutyun (ARFD), is not surprised at Armenia’s coalition forces
using the word “believe” in different contexts in their slogans.

“They are well aware that they have for many years done so much bad
that their only hope is people’s faith. They are trying to turn faith
into a political category. Our slogan is justice, equality and unity,”
Minasyan told journalists on Friday.

Interestingly, the Armenian coalition forces’ slogans are: “Believe
to change” (Republican Party of Armenia – RPA), “Believe, trust,
demand” (Prosperous Armenia Party – PAP), “Let us believe to build
up a country of law” (Rule of Law party).

As soon as the election campaign begins, the ARF-D will present its
view of Armenia. The party will address numerous issues, from domestic
policy to foreign policy.

The ARF-D is expecting free and fair elections. “I would not like to
see elections that would bring to street fights. I want all of us to
congratulate one another the very first day,” Minasyan said.

He pointed out the need for young people to become politically active.

“Unfortunately, many of them are indifferent and materialistic.

Our main task is to show the potential for creating jobs. People must
have opportunities for realizing themselves,” Minasyan said.

be a unity but not be discussed name by name. It provides complete
unification for coming years. It provides freedom for Armenian person
and representatives of various spheres are presented in our list. Head
of the “Heritage” party Raffi Hovahhnisyan announced about this during
the press-conference today.

According to the speaker the alternative for the future of Armenia is
presented in their list and the power of the right is the main value
here. R. Hovhannisyan also noted that the joint discussions created the
list and it is false to consider that this is “Raffi’s list”. “If this
was Raffi’s list Raffi would be on 21st place and young people would
appear on the first places”, leader of the “Heritage” said and added
that “Free democrats” have decided their places in the joint list.

R. Hovhannisyan also expressed confidence that if the elections passed
fair “Heritage” will get 25 % of the votes.

“The elections will be unique this time as Armenian President and
the leading party announce about this and I accept this announcement
seriously as a citizen”, R. Hovahhanisyan said.

Leader of the “Heritage” party underlined that his party is ready
to struggle and be the leader. “I announce with whole responsibility
that our deputies will be at the NA next session”.

YEREVAN. – Armenia’s bill on the State of Emergency will cause
serious problems for the country abroad; it is a troublesome law,
opposition ARF Dashnaktsutyun Party’s National Assembly (NA) Faction
leader Vahan Hovhannisyan stated during a briefing at NA.

“Any country must have a law to prevent special incidents. We
demanded that there would not be such divisions within the MOD. It
should have been within the police or security agencies. They did
not listen to us, and the army was given the right to intervene,
which is unconstitutional,” Hovhannisyan said.

And in response to the question as to whether ARF could join the
ruling coalition following the parliamentary elections in May,
Vahan Hovhannisyan noted: “We want to increase our presence in the
parliament so much that there would not be a need for coalitions.”

“The word ‘to believe’ is in the slogans of the three coalition
forces. A [ruling coalition’s] Republican [Party of Armenia] MP said
you need to have a right to politicize ‘believing’ and to bring it into
politics. Our authorities have squandered that right. The authorities
have come to understand that they have no argument to present to the
people,” Vahan Hovhannisyan concluded.

The newly appointed Ambassador Extraordinary and Plenipotentiary of
the Federal Democratic Republic of Ethiopia to Armenia Kasahun Dender
Melese (seat in Moscow).

Noting that Ethiopia is one of the countries on the African continent,
which Armenia has centuries-old relations with, President Sargsyan
said good bases exist for deepening and reinforcing the relations
between the two peoples based on historic memory.

Serzh Sargsyan attached importance to the establishment of
the necessary legal framework with an aim of intensifying the
Armenian-Ethiopian political dialogue. The parties praised the
cooperation within international organizations.

According to Ambassador Kasahun Dender Melese, for centuries, Armenians
have been contributing to the development of science and technologies
in Ethiopia and they have warm feelings for Armenians.

The Ambassador assured that the Government of Ethiopia is interested
in developing relations with Armenia.

Recently, the mass media has almost daily reported about regular
violation of the ceasefire by Azerbaijan, the number of which per
week increases to several hundreds. Moreover, these violations
are increasingly intense. Thus, according to the operative data of
the Defense Army of the Nagorno Karabakh Republic, in just a week,
that is between March 10 and 17, the Azerbaijani party violated the
ceasefire almost 350 times, making over 2500 shots from small arms
at the positions of the Karabakh forces.

Such provocative actions of Azerbaijan, which lead to deaths on
both sides of the contact-line, convincingly prove that the country
continues to ignore the appeals of international structures for
strengthening the cease-fire. Moreover, Baku does not carry out
the commitments assumed at the negotiations on the settlement of
the Azerbaijani-Karabakh conflict under the auspices of the OSCE
Minsk Group.

As you know, one of the main principles, on the basis of which the
co-chairs of the Minsk Group proposed to resolve the Karabakh issue,
is non-use of force or threat of force. By the way, this principle
is constantly noted in the joint statements on Nagorno-Karabakh,
which is always signed by Azerbaijan, thus declaring its intention
to resolve the issue by purely peaceful means. However, in practice,
the behavior of the Baku leadership flatly denies its willingness
to seek a way to peace just by peaceful means, as via violation
of the ceasefire, it actually uses force; moreover, it constantly
threatens Armenia and Nagorno Karabakh with the prospect of resuming
the war. The actions of official Baku, which does not follow the
contractual commitments assumed and, despite numerous appeals by
authoritative international organizations, stubbornly refuses to
withdraw snipers from the frontline, creating an explosive situation
at the contact-line, can be only called a challenge to the mediators,
and, first of all, to the co-chairs of the OSCE Minsk Group.

It is time for the co-chair-states of the Minsk Group, and the UN
too, a non-permanent Security Council member of which Azerbaijan has
recently become, to be more active and resolute and to bring to justice
the high-handed violator of the ceasefire. But, it is Azerbaijan
that applies to the UN with accusations against Armenia. On March
5, Permanent Representative of Azerbaijan to the UN Agshin Mehdiyev
sent a letter to Secretary General of the organization Ban Ki-moon on
Armenia’s violation of… the ceasefire. The cynicism of this action
of official Baku is obvious. However, the letter, which cannot be
called in any other way than a mock, was circulated as an official
document of the UN General Assembly and Security Council.

Is it a paradox? But, is it really a paradox? It is rather regularity.

In the conditions that the obviously dangerous actions of Azerbaijan
threatening the regional peace and stability are not given an adequate
and strict assessment yet, nothing else can be expected. Nature, as
we know, abhors a vacuum. And Azerbaijan rushed to fill this vacuum,
in this particular case – by the noted letter to the UN. Ignoring
the international principles of conflict resolution and norms of
international law, Baku has assumed the principle of a petty thief who,
being seized by his hand, is the first to cry, “Stop the thief!”

We’ll not be mistaken if we say that the general principle of thieves
lies at the heart of Azerbaijan’s foreign policy concept aimed at
distorting the essence of the Karabakh conflict and discrediting
Armenia and the NKR. Having committed some genocidal actions during
the Karabakh conflict and having unleashed a war against the NKR, it
ignores the basic norms of morality and dares to accuse both Armenian
parties of aggression. Rejecting the withdrawal of snipers from the
frontline and preventing the establishment of corresponding mechanisms
to investigate the incidents in the conflict zone, Azerbaijan at
the same time calls upon the UN and the OSCE … to bring Armenia to
justice for the situation created on the contact-line by itself.

Unfortunately, the competent international organizations do not give
a fair legal assessment to the actions of the Azerbaijani party and
limit themselves to general calls for peace and the statement that the
unresolved Karabakh conflict poses the greatest threat to the region.

And I must say that Azerbaijan, trying to wrest profitable preferences
for itself from the mediators, speculates this “international concern”,
threatening, with impunity, to blow up the current state of “neither
peace nor war”. In other words, maintaining tension in the conflict
zone became part of Azerbaijan’s foreign policy, a means of pressure
on the mediators and the Armenian parties. This means that it will
continue to violate the ceasefire, multiplying the statistics of
victims of its dirty policy of blackmail and threats. And it will
continue doing this until it gets a slap on its arms, which are
already blood-stained up to the elbows.

Politician Calls For State’s Social Responsibility

The Republic of Armenia has to bear a social responsibility for its
citizen, according to Aram Sargsyan, the leader of the Democratic
Party.

The politician made the statement while introducing his program at
a Thursday news conference. He particularly called for reforming the
state system.

“What we mean by saying a system reform is that Armenia has to be
socially responsible for its citizen. It has also to be enshrined in
the Constitution which needs further amendments,” he said.

Asked why the Democratic Party made no move to run for election with a
split ticket, he answered: “If uniting is the case, [the party] would
have done so as an alliance. There would have been a joint program
where we would have our role and be listed in a ballot which includes
not only leaders of political parties but also worthy people,” he said.

Sargsyan noted that their co-thinkers, which number thousands, need
an inspiration to believe that they are not alone. He added in the
meantime the party will manage to garner about 10% of votes in the
upcoming election.

“Je ne renonce jamais”, se targue le president. Nicolas Sarkozy l’a
decide : il fera sienne la cause des victimes du genocide des Armeniens
de 1915 et de leurs descendants. Il posera sa propre pierre a l’edifice
des “lois memorielles”, initie en 1990 par Jean-Claude Gayssot. La
proposition parlementaire reprimant la negation des genocides, appuyee
par le chef de l’Etat, est votee le 23 janvier. Un mois plus tard,
elle est retoquee par le Conseil constitutionnel. Le combat s’enlise,
la riposte est immediate : le gouvernement se voit somme de preparer un
nouveau texte. “Je ne me resigne pas”, previent-il. “Porter une loi
memorielle serait, pour un responsable politique, la preuve d’une
dimension superieure, presidentielle, celle d’assumer un destin
historique national, de l’honorer et meme d’en modifier la lecture
ou la comprehension”, analyse l’historien Vincent Duclert (1).

Nicolas Sarkozy l’a bien compris. Pourtant, la constance des
convictions presidentielles n’est pas aisee a saisir. Menant campagne,
le candidat de 2007 n’avait-il pas martele sa detestation de la
“mise en concurrence des memoires” ?

Cette entreprise est grave, parce que lorsque chacun se trouvera
renvoye dans le regard des autres a ses origines, que restera-t-il
alors de l’idee de la nation ?” lance-t-il a Nîmes, un an avant son
election. Cinq ans plus tard, le president semble avoir reconsidere
la problematique.

“S’inscrire dans la grande histoire”

Pourquoi un tel retropedalage ? “On est dans l’histoire ‘bling bling'”,
s’exaspère l’historien Nicolas Offenstadt (2), fervent detracteur
de la politique sarkozyste en la matière. “Il n’y a pas de veritable
rapport a la culture historique chez lui. Il se situe dans un discours
neo-nationaliste, porte par une communication tous azimuts. A partir
de la, les contradictions n’en sont pas, les enjeux historiques sont
determines par une conjoncture immediate”.

L’historienne Annette Becker (3) verrait plutôt dans l’attitude
presidentielle un revirement de raison : “Jacques Chirac a ete le seul
grand president de la memoire de la Ve Republique. Nicolas Sarkozy,
issu de la meme famille politique et qui lui succède directement,
a voulu s’en differencier dans un premier temps. Avant de se rendre
compte que cette position n’etait pas tenable”…et de finalement
s’inspirer de l’action de l’ex-president, pour, lui aussi “s’inscrire
dans la grande Histoire”.

appartenir a une autre generation, le symbole fait date. Dans son
discours du Vel d’Hiv’, Jacques Chirac met fin a 50 annees d’ambiguïte
sur la responsabilite de Vichy dans l’extermination et deportation
des juifs. Fraichement elu, il vient de signer un acte emblematique
de sa presidence.

En fevrier 2010, a Kigali, Nicolas Sarkozy marche dans les pas de
son predecesseur. Devenu president, le candidat anti-“repentance”,
reconnaît une “grave erreur d’appreciation” de la France lors du
genocide rwandais de 1994. Le faible poids du vote de la communaute
rwandaise de France dedouane alors l’initiative de tout soupcon
electoraliste.

Il n’en va pas de meme du texte penalisant la negation du genocide
armenien. Nicolas Sarkozy s’entete, malgre la levee de boucliers des
detracteurs du texte. Si celui-ci ne pourra certainement pas voir le
jour avant la prochaine legislature, de l’aveu meme de la majorite,
que retiendra l’histoire de l’obstination presidentielle ?

“Comment ne pas remercier Nicolas Sarkozy ? ” L’image d’un chef de
l’Etat determine, contre vents et marees, a proteger une communaute du
poison revisionniste, repondent ceux qui militent en faveur du texte.

“Comment ne pas remercier Nicolas Sarkozy, ce president de la
Republique francaise qui a su non seulement trouver les mots qui
touchent lors de son voyage en Armenie, mais qui les a mis en
pratique jusqu’a rendre possible la prohibition du negationnisme”,
fait valoir un editorial de “Nouvelles d’Armenie magazine” au lendemain
du vote parlementaire. Il est chef de l’Etat qui, sans relâche, aura
combattu la discrimination, arguent ses soutiens. Qui rappellent que
les victimes de la Shoah et leurs descendants sont, eux, legalement
proteges des tentatives d’effacer l’histoire.

“La loi Gayssot (qui qualifie de delit la contestation de l’existence
de crimes contre l’humanite NDLR) se fonde sur la notion de ‘crime
contre l’humanite’ telle que definie par le tribunal de Nuremberg : il
s’agissait du genocide des juifs Pendant la seconde guerre mondiale”,
explique Annette Becker. La reconnaissance par la France du genocide
armenien ne date que de 2001. Sa negation ne tombe donc pas sous
le coup de la loi Gayssot. L’historienne, qui n’est pourtant pas
favorable au texte, concède : “D’un point de vue juridique, ses
partisans sont logiques”.

“Un calcul entièrement politique” Et, parmi eux, certains s’exaspèrent
de ce qu’ils considèrent comme de l’acharnement contre une loi denoncee
comme electoraliste. Le postulat de l’existence d’un vote armenien
est un “fantasme”, s’exaspère une historienne. Si sa realite reste en
effet a demontrer, il n’empeche que debat ouvert par le texte est, lui,
devenu un veritable enjeu de la campagne presidentielle. “Il y aura a
reprendre ce dossier – j’en prends l’engagement – dans l’apaisement,
dans la conciliation et en meme temps, dans la volonte d’aboutir”,
promet Francois Hollande, le 28 fevrier.

De leur côte, les detracteurs du texte n’en demordent pas :
prendre l’initiative d’une telle loi dans un contexte electoral
est strategique. “C’est un calcul entièrement politique, qui relève
de l’instrumentalisation”, denonce Annette Becker, qui pointe par
ailleurs le risque d’un “engrenage” legislatif. Il faut dire que,
soumise au vote du Parlement deux mois avant l’echeance presidentielle,
la loi pouvait difficilement echapper a la suspicion.

“Le parti majoritaire a cru se concilier l’adhesion indefectible
des communautes armeniennes de France et demontrer qu’elle agissait
du point de vue des principes. Les benefices politiques etaient
attendus et, du reste, de nombreux parlementaires de l’opposition,
en votant le texte, ont montre qu’ils souhaitaient ne pas laisser a
la droite le benefice de l’initiative”, rencherit Vincent Duclert,
qui denonce une “prise en otage du savoir historique par cette OPA
du politique sur la memoire”.

Sursaut revisionniste

Les motivations du dessein presidentiel divisent. Entre empathie et
benefice politique, la question du pourquoi restera sans doute sans
reponse. “Certes, il y a probablement eu, de la part des parlementaires
qui etaient favorables a cette loi ou meme du President de la
Republique un souci sincère de la souffrance des Armeniens confrontes
en permanence a la negation du genocide qui emporta leurs ancetres”,
reconnaît l’historien.

Ce n’est peut-etre pas ce que la posterite retiendra de l’initiative
presidentielle. Les inquietudes se multiplient face a un sursaut
revisionniste manifeste en Turquie. Le debat survenu en France n’est
rien venu arranger.

“Que l’episode de la loi penalisant le negationnisme ait permis cette
avancee decisive du processus negationniste est une catastrophe pour
les Armeniens, et pour la recherche” deplore Vincent Duclert.

“Humilier la Turquie ne conduira qu’a empecher encore un peu plus
historiens et journalistes turcs de travailler correctement sur le
sujet”, regrette Annette Becker. Ceux qui ont porte le projet de
loi et initie le debat qu’il a suscite en assumeront-ils, a terme,
les effets pervers ?
