Tribunal. L’expulsion d’un couple d’Arméniens annulée

Le tribunal administratif vient d’annuler une mesure d’expulsion prise
à l’encontre d’un couple d’Arméniens ayant trois enfants. Ce couple,
qui demeure à Vannes, s’était vu refuser, le 8juillet 2011, un titre
de séjour.

Obligation lui était faite de quitter le territoire français dans le
délai de 30 jours à destination de l’Arménie. Deux de leurs enfants
sont nés dans leur pays d’origine, en1995 et2003, et le troisième en
France, en 2010. Le tribunal a estimé que la convention internationale
de 1990 relative aux droits de l’enfant doit s’appliquer en leur
faveur. L’article3-1 précise que «dans toutes les décisions qui
concernent les enfants, qu’elles soient le fait d’institutions
publiques ou privées de protection sociale, des tribunaux, des
autorités administratives ou des organes législatifs, l’intérêt
supérieur de l’enfant doit être une considération primordiale». Le
tribunal relève que, «compte tenu de l’intégration scolaire de leurs
deux enfants aînés et en particulier du parcours remarquable et
exemplaire de leur fille», ce couple d’Arméniens est fondé à soutenir
que leur expulsion est contraire à cette convention. Le préfet devra
en conséquence délivrer à ces ressortissants arméniens une carte de
séjour portant la mention «vie privée et familiale» et ce dans un
délai de 15 jours, leur situation devant être régularisée avant les
épreuves du bac auxquelles leur fille est inscrite. L’État devra, en
outre, verser 1.200EUR à leur avocat au titre de l’aide
juridictionnelle.

ANTELIAS, Lebanon – Within the context of his pontifical visitation
program, His Holiness paid a pastoral visit to the Armenian
communities in Ghazvin, Rasht and Anzaly. These regions are located in
the Northern part of Tehran and in the sea-shores of the Caspian Sea.
Historically these regions had well organized Armenian
communities.However due to political and economical reasons the
Armenians in majority have left and actually only a small communities
continue to exist in these cities.

The pastoral visit of His Holiness was a wonderful occasion for these
communities to renew their Christian faith and their firm attachment
to Armenian Christian values and traditions. In his messages
Catholicos Aram stressed the importance of spirituality, he said that
“for Armenian Christianity, spirituality is not just reading Bible or
knowing about Christianity but living the values and imperatives of
the Bible. It means having Christ at the center of our daily lives”.
His Holiness reminded the faithful that the Armenian Christian
spirituality “must embrace the totality of our life. This has been our
experience in the course of history. The church has been the source of
our spirituality. Therefore we must participate in the life and
witness of our church in order to sustain our life with the living
spirituality that generate from the Bible, our church fathers and
saints”.

A warm welcome was reserved for His Holiness in these cities. His
Holiness was accompanied by the Primate of Tehran Archbishop Sebouh
Sarkissian, the Primate of Isfahan Bishop Papken Charian, reverend
fathers Magar Ashkarian and Mesrob Sarkissian and the representatives
of the Armenian community in Tehran.

Minority foundations’ property being returned

Eighteen properties have been returned to their owners in the eight
months since the amendment that enabled the return of property
belonging to minority community foundations to their owners was
instituted.

Since the Aug. 27, 2011 amendment to the Law on Foundations came into
force, minority community foundations have been able to request the
return of property that previously belonged to them.

The Foundations Assembly, a subsidiary of the Directorate General for
Foundations (VGM), looked through the applications and decided to
return 18 of 88 properties to their owners. According to the VGM, the
Foundation Assembly, which considered some demands to be inadequate,
is still processing the other applications.

Deputy Prime Minister Bülent Arınç, who spoke to Sunday’s Zaman on the
issue, noted that it was impossible for the government to approve of
practices that have worked against minority community foundations for
so many years. Reiterating that they made such an amendment to the Law
on Foundations because they did not approve of Turkey’s treatment of
minorities, which have been living together for centuries, Arınç said
the return of property belonging to community foundations is a crucial
step.

Prime Minister Recep Tayyip ErdoÄ?an, who attended an iftar
(fast-breaking dinner) given by non-Muslim minorities in 2011, then
said his government would not let any single citizen living in Turkey
be offended or exposed to discrimination.

The transfer of property that was declared to belong to minority
community foundations in 1936 to the foundations has been a nine-year
process. In January 2003, Parliament passed a `harmonization package’
aimed at bringing Turkish laws in line with EU standards, which, among
other things, paved the way for minority foundations to own property
upon obtaining permission from the VGM. As a result of the sixth EU
Harmonization Package, passed in July 2003, the deadline for the
minority foundations to apply to the directorate to formally certify
ownership of property that has been proven to belong to them was
extended as a further step to make it easier for these foundations to
own property. The amendment to the Law on Foundations on Feb. 27, 2008
as part of the ninth EU Harmonization Package was a step taken across
an historic threshold.

As a result of the amendment in August of last year, minority
foundations were asked to apply within 12 months to register claims
for property.

During this time, the Akdamar Church (Church of the Holy Cross) in Van
and the Sümela Monastery in Trabzon were permitted to hold religious
ceremonies following restoration. Additionally, great progress was
made in the restoration of the Hagia Nikolai Church in Gökçeada,
Ã?anakkale, both the Assyrian Catholic Church and the Greek Catholic
Church in İskenderun, Hatay, the Armenian Protestant Church in Sur,
Diyarbakır, and the Great Synagogue in Edirne.

Civilization of foundations

Arınç told Sunday’s Zaman: `We don’t just refer to foundations
associated with the government when we say `our civilization is a
civilization of foundations.’ We have the same respect and attention
for the foundations formed by people who had different faiths and
ideas but shared the same destiny with us, who lived on this land with
us although they had a different faith, a different religious and
racial background.’

He went on to explain that they cannot condone ending the activities
of foundations created for charitable purposes or sequester their
property for whatever reason, adding that this approach would not be
in accordance with their understanding of fairness and justice.

Eurovision : une équipe de la VRT victime de violences en Azerbaïdjan

Deux membres de l’équipe de la VRT présente à Bakou, la capitale de
l’Azerbaïdjan, pour le concours Eurovision de la chanson, ont été
impliqués dans un incident dans la nuit de mardi à mercredi, a annoncé
la radio-télévision publique flamande dans un communiqué. Un membre de
la délégation a eu la mchoire fracturée et a été rapatrié en Belgique
mercredi.

L’incident a eu lieu dans le centre de Bakou, non loin de l’hôtel où
réside la délégation belge. Les deux hommes, accompagnés d’un
collègue, rentraient à l’hôtel quand un chauffeur de taxi s’en est
violemment pris à eux alors qu’ils n’étaient pas d’accord sur le prix
de la course.

A la suite de l’altercation, la délégation a été prise en charge par
l’Union européenne de Radio-télévision (UER), le comité local
d’organisation de la chaîne Ictimai TV et la police.

`Autant l’organisation que la sécurité autour du concours Eurovision
sont gérées de façon très professionnelle`, a souligné la VRT dans le
communiqué. `Nous insistons aussi sur le fait que c’est un incident
isolé, qui aurait pu se dérouler dans n’importe quelle grande ville et
qu’il ne faut pas le mettre en rapport avec les discussions politiques
actuelles au sujet de l’Azerbaïdjan.`

La candidate belge Iris et ses choristes n’ont eu aucun problème et
pourront donc participer à la demi-finale de mardi.

Après Valence, la virtuose Astrig Siranossian (violoncelle) triomphe à Romans
Alexandre Siranossian a dirigé « Nanor » de Parsegh Ganatchian

Samedi 19 mai la Salle des Cordeliers à Romans affichait complet pour
la soirée musicale de l’Orchestre des Jeunes « Il Mosaïco » de
Saint-Gallien (Suisse) dirigé par Herman Ostendrarp avec les solistes
Jonas Moosmann (violon) et la virtuose Astrig Siranossian
(violoncelle). Au programme, le « double concerto (violon-violoncelle
en la mineur) de Brahms, la 5ème Symphonie (en ut mineur) de Beethoven
et Nanor de Parsegh Ganatchian (1885-1967). Lors du Concerto pour
violon, violoncelle et orchestre en la mineur de Brahms, le public
découvrit les talents au violon de Jonas Moosmann et surtout la
virtuose Astrig Siranossian au violoncelle, très présente sur scène et
qui « vivait sa musique » avec ses gestes surs teintés de grce et de
vie. Astrig Siranossian (23 ans) qui a débuté le violoncelle à l’ge
de 4 ans est une véritable révélation qui a affirmé ses talents au
cours de ces dernières années. Les `uvres de Beethoven furent
également exécutées avec dextérité par l’orchestre remarquablement
dirigé par Hermann Ostendarp.

Mais l’originalité de la soirée musicale résidait surtout dans « Nanor
» de Parsegh Ganatchian pour c`ur et orchestre transcrite par le
compositeur Garbis Aprikian avec Clara Guiragossian (soprano) et
Tigran Guiragossian (ténor). Cette `uvre sera dirigée magistralement
par Alexandre Siranossian ex-directeur du Conservatoire de Romans,
avec Lévon Chatikyan au duduk ainsi que la chanteuse Chaké Donoyan,
une révélation. Au terme de « Nanor », le public, debout réserva une
vibrante ovation à Alexandre Siranossian, et à tous les musiciens et
artistes acteurs de la merveilleuse soirée musicale. Henri Bertholet,
le Maire de Romans remercia Alexandre Siranossian « sans lequel la vie
musicale de Romans ne serait pas ce qu’elle est aujourd’hui », Astrig
Siranossian « pour son immense talent », l’orchestre « Il mosaïco » et
son chef Hermann Ostendarp et Gérard Cattant le directeur de
l’Ensemble vocal de Romans.

Hier 19 mai au mémorial du génocide arménien à Dzidzernagapert sur les
hauteurs d’Erévan fut commémoré l’anniversaire du génocide des Grecs
du Pont. De 1916 à 1923 la Turquie coupable du génocide de 1,5 million
d’Arméniens avait également procédé au génocide des Assyro-Chaldéens
et des Grecs pontiques. 353 000 grecs avaient alors péri dans ces
massacres. Edouard Charmazanov le vice-Président du Parlement
arménien, de nombreux députés, l’Ambassadeur de Grèce en Arménie
Vassiliki Dikopoulo, Arkady Kidarov le représentant de l’association
des Grecs d’Arménie et de nombreuses personnalités politiques et
religieuses ont assisté à la commémoration de Dzidzenagapert.

Le vice-Président du Parlement arménien a affirmé dans son discours
que « les autorités d’Arménie feront tout pour que la communauté
internationale condamne le génocide des peuples chrétiens dans
l’Empire ottoman. Le Parlement arménien a dans un texte le 24 avril
appelé la communauté internationale à condamner le génocide non
seulement des Arméniens mais également celui des Grecs et des
Assyro-Chaldéens. Nous devons unir nos forces dans ce sens car le
négationnisme et aujourd’hui aussi dangereux que le génocide. (…) la
Turquie doit tôt ou tard reconnaitre le génocide des Arméniens, des
Grecs du Pont, des Assyro-Chaldéens et d’autres minorités nationales
car c’est uniquement en condamnant et en se réconciliant avec son
Histoire que la Turquie pourra prouver qu’elle porte des valeurs
européennes..ce que je doute fortement ! ».

Yerevan,/Mediamax/. Head of the Operational Safety Review Team (OSART)
Mission of the International Atomic Energy Agency (IAEA), Gabor Vamos,
does not comment on the opinion of the European Union over the
necessity of earliest closure of the Armenian Nuclear Power Plant in
Metsamor.

`My task in 2011 was to serve as team leader for the OSART Mission at
the Armenian NPP. The team made 14 recommendations and 12 suggestions
to improve operational safety and identified 7 good practices at the
plant. The report of the mission is public. The IAEA will perform an
OSART Follow up mission in 2013 to check the progress of the plant in
implementing the recommendations and suggestions made in 2011,’ Gabor
Vamos said in the interview to Mediamax.

`It does not fall under my duties to comment on a statement of EU,’ he added.

EU believes the Armenian NPP `cannot be upgraded to meet
internationally recognized nuclear safety standards’.

Committee, the state budget revenues were inadequately collected in
the first four months of this year, Haykakan Zhamanak daily writes.

“The growth was a mere 3.1 percent as compared with January-April of
last year.

This year’s state budget revenues must increase by at least 11 percent,
as compared with the year past, but the growth was 3.1 percent.

It is noteworthy that the value-added-tax revenues in these four
months were lot lower than the same time period last year.

And if we convert the revenues into dollars, it will turn out that the
budget revenues have reduced in the first four months of this year,
as compared with the year past.

As it seems, Armenia’s economic situation is worse than could have
been imagined,” Haykakan Zhamanak daily writes.

YEREVAN, MAY 19, ARMENPRES: Two sufferers of the incident taking
place in the Republic Square due to balloons charged with the gas,
have been operated in the radiation medicine and burn center. Shushan
Hunanyan Press Secretary of the Ministry of Health informed Armenpress
that the operation is scheduled on May 19.

By the instruction of the President of the Republic of Armenian Serzh
Sargsyan German Heidelberg city University’s Plastic, Reconstructive
Surgery and Burns Clinic Professor Adrian Dayglere was invited to
carry out the operation.

Over fifty sufferers of May 4 incident are still in hospitals, two
of which are in the intensive care department. Eighty-five patients
receive ambulatory treatment reportedly under the responsibility
of the doctors. There are patients who need long -term and highly
specialized treatment. Two citizens have got third degree burn.

The treatment and the operation of the sufferers is conducted in the
frame of state order.
