Les quotidiens d’opposition rendent compte de l’agression du militant
d’opposition, Vilen Gabrielian, blogueur connu pour son franc-parler,
qui a été agressé par quatre inconnus masqués le week-end dernier à
Erevan tard dans la soirée . Celui-ci avait été hospitalisé avec
plusieurs blessures. Il a accusé le chef de la Police Vladimir
Gasparian et son adjoint, Lyova Yeranossian, d’avoir donné l’ordre. La
police, bien qu’elle l’ait interrogé, semble ne pas être pressée pour
ouvrir une enquête selon Haykakan Jamanak. Hraparak reproduit les
commentaires >, voire les > de ce blogueur sur
les réseaux sociaux à la suite de la tragédie de Gumri à l’encontre du
chef de l’Etat et du chef de la Police. Hraparak remarque que les cas
d’agressions de militants d’opposition, de plus en plus fréquents ces
derniers temps, ne sont généralement pas élucidés.

TURKISH RIGHTS GROUPS TO JOIN PREINCEK CASE IN FAVOR OF ARMENIA

The Human Rights Association from Turkey and The Center for Truth
Justice Memory will present legal briefs in favor of Armenia

ISTANBUL–Two prominent human rights groups in Turkey have announced
that they will take part in the pending Armenian Genocide denial case
at the European Court of Human Rights, known as the Perincek Case. The
Human Rights Association from Turkey and The Center for Truth Justice
Memory will partner with the Toronto-based International Institute
for Genocide & Human Rights Studies to present legal briefs against
Perincek and in favor of Armenia.

Below is the text of the announcement issued Friday on behalf of the
two Turkish human rights groups.

On January 28, 2015, the lawsuit Dogu Perincek v. Switzerland will
begin retrial in the Grand Chamber, which acts in the capacity of
court of appeals for the European Court of Human Rights.

It is now common knowledge that in 2005, Dogu Perincek traveled to
Switzerland, which has officially recognized the Armenian Genocide and
passed a law criminalizing its denial, in order to issue declarations
in Bern and Lausanne where he impugned the Armenian Genocide as
a fabrication. In 2007, Perincek was found guilty of deliberately
violating national law and convicted by the court of Lausanne. Upon
Perincek’s appeal, the European Court of Human Rights ruled in his
favor in 2008 and found that the court of Lausanne had violated the
freedom of expression principle enshrined in the European Convention
of Human Rights, article 10.

The Human Rights Association sent a letter to the Swiss Federal Office
of Justice in 2014, demonstrating in detail how the denial of the
Armenian Genocide incites hostility toward Armenians and imploring
Switzerland to appeal the ECHR decision. Switzerland’s subsequent
appeal and request for retrial were accepted in June 2014.

The first hearing of the said retrial will take place on January
28, 2015.

The Human Rights Association from Turkey joined The Center for
Truth Justice Memory and the Toronto-based International Institute
for Genocide & Human Rights Studies to appeal to the ECHR in July
to present a Third Party Opinion File, i.e., to be accepted as
intervening party. The ECHR approved this request by the three human
rights organizations.

We have explained in this file that the denial of the Armenian
Genocide provokes ethnic hatred in Turkey and encourages anti-Armenian
elements. Neither the ECHR ruling and nor the file we have presented
as third party concerns itself with the historical reality of the
1915-1917 massacres or their precise legal definition. The crux of the
issue lies in the fact that Perincek’s declarations are conducive to
racism and discrimination. In this sense, the retrial in the Grand
Chamber carries special significance as a precedent in addressing
denial, minimization, and justification in a context outside of
the Holocaust.

The ECHR decision had restricted denialism and discrimination to their
effect on Swiss Armenians and disregarded Perincek’s leadership of
the Talat Pasha Committee, as well as the fact that his refutations
of the genocide as an international lie have direct bearing on the
Armenians of Turkey even if they were pronounced in Lausanne. We
have therefore argued in our file that Perincek’s declarations do
not only concern the definition of events, but also commit the crime
of discrimination; that the ruling must take into account Perincek’s
position as a prominent politician from Turkey, the head of the Labor
Party, and the leader of the Talat Pasha Committee–as well as that
Committee’s objectives and operations.

Yes, the act that was found criminal according to the Swiss law
was committed on Swiss soil, but the Talat Pasha Committee and its
leaders, including Perincek, have been conducting operations in Turkey
and targeting Turkish society. The recipient of their message–that
those who listen to Armenians will be subject to intervention and
retribution, even if they are at the other ends of the world–was
Turkish society. The same Turkish society that is being targeted by
this message has been fueled by hostility toward Armenians and other
non-Muslim peoples for generations. Anti-

Armenian sentiments and thoughts have been exacerbated throughout
Republican history by the constant dogma, mass media dissemination
and educational indoctrination of the notion that the eradication of
the Ottoman Armenian population and civilization is a lie.

Denialism does not simply consist of declarations along the lines of
“no genocide has taken place.” Denialism requires the justification of
the irreversible and inexpiable eradication of a people: The notion
that “it is Armenians who are responsible for the events,” namely
that Armenians had deserved eradication, that they had “stabbed Turks
in the back” and collaborated with the enemy, has always been and is
still perpetually reiterated in classrooms, university conferences,
TV series and programs, and books.

Hostility toward Armenians is not confined to mere words but also
takes lives. In this context of discrimination and ethnic hatred,
Armenians were attacked and Hrant Dink, the founder and director of
Agos, was the victim of an assassination whose perpetrators have yet
to be brought to justice.

Armenian private Sevag Å~^ahin Balıkcı was shot dead in 2011 by
another soldier in Batman, where he was on military duty, specifically
on the day of April 24, the universal commemoration day marking
the beginning of the Armenian Genocide. Court proceedings have met
with significant public distrust, while the press has indicated
that commanders pressured privates to testify that the incident was
“an accident.”

Furthermore, the “Hodjali Protests” of February 27, 2012, which took
place in the central Taksim square and featured as a speaker the
Minister of Internal Affairs, displayed banners proclaiming “You Are
All Armenians, You Are All Bastards.” Within the span of two months
from 2012 to 2013, the Samatya district of Istanbul, which is densely
populated by Armenians, saw similar and successive attacks on elderly
Armenian women–among them the murder victim Maritsa Kucuk, whose bones
were smashed and entire body relentlessly stabbed. And on February 23,
2014, banners saying “Long Live Ogun Samasts, Damned be Hrant Dinks”
were displayed, unprohibited, in front of the newspaper Agos.

In sum, genocide denial is the chief, most fundamental basis for
the state-sanctioned threat to existence under which Armenians
continue to live in Turkey. As two human rights associations that
have witnessed first-hand and up close the provocation of ethnic
hatred by anti-Armenian acts and declarations, we, the Human Rights
Association and the Center for Truth Justice Memory, consider it
our natural duty, as per our raison d’être and field of operation,
to present our observations to the European Court of Human Rights in
order to contribute to the making of a fair and just decision.

Finally, we insist yet again: Denial causes hatred and hatred kills.

We defend the inalienability of the right to live in safety, unafraid
of tomorrow, and hope that the European Court of Human Rights will,
in the name of the universal law of human rights, obstruct discourses
that incite acts in violation of this inalienable right.

Harut Sassounian est une des betes noires de la diplomatie turque. En
1985, ce natif d’Alep (Syrie) a joue un rôle important pour qu’un
organisme de l’ONU reconnaisse que le massacre des Armeniens par
l’Empire ottoman en 1915-1916 etait un genocide (lire ci-dessous,
>). Durant la première guerre mondiale,
au moins 1,2 million d’Armeniens disparurent du fait de deportations
et d’executions sommaires massives ordonnees par le gouvernement au
pouvoir a Istanbul. Mais depuis lors, les autorites turques rejettent
la qualification de genocide et exercent de fortes pressions pour
que la communaute internationale ne la reprennent pas a son compte.

La diaspora armenienne, a l’inverse, est soudee pour obtenir cette
reconnaissance, avec une determination renforcee cette annee, qui
marque le centenaire des massacres. Pour Harut Sassounian, toutefois,
cette campagne doit etre completee par une autre. Personnalite
influente de la diaspora aux Etats-Unis, il estime que les Armeniens
doivent demander justice, notamment en multipliant les procedures
judiciaires pour spoliation. Une strategie decryptee vendredi 23
janvier lors d’une interview autour d’un jus d’orange au restaurant
Le Murat, et qu’il a presentee devant une assistance rassemblee samedi

COMMUNITY FOR HISTORIC YEAR

WASHINGTON, DC – On Saturday, January 17th, the Armenian Assembly of
America (Assembly) held its annual New Year Gathering in Southern
California at the home of Mr. and Mrs. Krikor and Marlene Yerevanian.
Organized by the Assembly’s Southern California Regional Council (SCRC) and
the Assembly’s Western Region Office in Glendale, California, this year’s
event drew Assembly members, friends and supporters from across the state.
Guests were briefed on a wide range of issues and activities on the
Assembly’s 2015 agenda by a variety of speakers.

`The Yerevanian family were gracious hosts who went beyond our expectations
and created an unforgettable evening for our members and guests,’ stated
Assembly Western Region Office Manager Aline Maksoudian.

Event host Krikor Yerevanian opened the program and welcomed the Assembly
membership to his beautiful home overlooking the San Fernando Valley.
During his introduction, Yerevanian recalled his decades-long friendship
with Mr. Hirair Hovnian, an original founder of and current Chairman of the
Board of Trustees of the Assembly. Yerevanian mentioned that back in the
early 1970’s Hovnanian sponsored his arrival to the United States and
helped him establish his real estate business, which he still operates
today.

After enjoying a delicious cuisine, Maksoudian opened the briefing and
recognized several guests in attendance, specifically Rev. Fr. Sarkis
Patoyan from St. Gregory Armenian Church and Mary Hovagimian, District
Director for Rep. Adam Schiff (D-CA). Assembly Board Member Lisa Kalustian
also thanked the event hosts and distinguished guests, and recognized SCRC
members Margaret Mgrublian, Jim Melikian, Talin Yacoubian, Al Cabraloff,
and Richard Mushegain who were all in attendance.

Kalustian introduced Talin Yacoubian, who serves as co-chair of the
Armenian Genocide Centennial Committee in California on behalf of the
Assembly. Yacoubian provided an update on current planning and announced
the dates and events that will take place throughout 2015 to commemorate
the Armenian Genocide.

Lastly, Kalustian introduced Assembly Communications Director Taniel
Koushakjian who provided an update on Armenian American issues in
Washington, DC. Koushakjian gave a brief overview of legislative
initiatives and events being planned on Capitol Hill. In that effort,
Koushakjian announced a special matching pledge by Hirair Hovnanian of up
to $500,000 on all new contributions to the Assembly in 2015. Koushakjian
also discussed the Assembly’s Terjenian-Thomas Summer Internship Program in
Washington, DC and highlighted the several alumni in attendance, including
himself and Western Region Manager Aline Maksoudian.

`From coast to coast, the Armenian Assembly is leading the fight for U.S.
reaffirmation of the Armenian Genocide,’ stated Talin Yacoubian.

A lecture by Dr. Ugur Umit Ungor

The Hague, 27 January 2015 – The first public event in the Netherlands this
year dedicated to the 100th anniversary of Armenian Genocide, will take
place on 30 January in Amsterdam. This event is organised by the Federation
of Armenian Organisations in the Netherlands (FAON) in cooperation with the
Armenian Students¹ Association Gladzor (ASV Gladzor) as part of Holocaust
Memorial Day (HMD) coordinated by the Dutch Institute for War, Holocaust and
Genocide Studies NIOD.

A lecture on “Causes and course of the genocide” will be given by Dr. Ugur
Umit Ungor Associate Professor of History at the University of Utrecht and
Researcher at the Dutch Institute for War, Holocaust and Genocide Studies
NIOD. The lecture is in Dutch.

The programme of the Armenian Genocide centennial events in 2015 in the

Armenian President Serzh Sargsyan had a meeting with His Holiness
Karekin II, Supreme Patriarch and Catholicos of All Armenian, and
His Holiness Aram I, Catholicos of the Great House of Cilicia.

Ahead of the expected meeting of the State Commission coordinating
the events dedicated to the 100thanniversary of the Armenian Genocide,
the interlocutors discussed the activities of the commission and the
participation of the Holy Armenian Apostolic Church in the activities
on the international and inter-religious arena and in the Diaspora.

Reference was made to state-church relations, the most significant
issues of the national-religious life and the existing challenges.

L’audience de ce mercredi 28 janvier devant la Grande chambre de la
Cour europeenne des droits de l’homme dans l’affaire Perincek c.

Suisse aura pour enjeu majeur de determiner si l’application de la
norme antiraciste suisse dans le domaine de la negation du genocide
des Armeniens constitue une violation de la liberte d’expression (art.

10 CEDH). À l’heure de la commemoration du centenaire de ce genocide,
la question est fondamentale.

Dans un premier arret du 17 decembre 2013, la Cour avait accueilli
le recours de M. Perincek – condamne en Suisse par trois instances
successives pour discrimination raciale – et juge que la condamnation
de M. Perincek par les juridictions suisses etait contraire a l’article
10 de la Convention consacrant le droit a la liberte d’expression. La
Cour a pris appui sur l’absence d’un > sur la
qualification juridique de genocide de l’experience armenienne ainsi
que d’un besoin social imperieux qui pourrait justifier l’incrimination
des propos negationnistes.

Pour rappel, M. Perincek s’etait rendu en 2005 dans plusieurs villes
de Suisse a la tete d’une organisation nommee Comite Talaat Pacha
(du nom du responsable majeur du genocide des Armeniens et pour cela
condamne a l’epoque par un tribunal militaire turc) pour repeter en
public, en six occasions differentes, que le >.

Dans le passe, la Cour europeenne avait deja pourtant clairement
indique que la negation d’un crime contre l’humanite constituait une
des pires formes de diffamation raciale et d’incitation a la haine
(Garaudy c. France).

En l’occurrence, dès lors que le Medz Yeghern a servi de base pour la
definition des notions juridiques de crime contre l’humanite d’abord
et de genocide ensuite, et dès lors que l’absolue majorite du monde
scientifique qualifie de genocide l’extermination des Armeniens de
l’empire ottoman pendant la Première Guerre mondiale, sa negation
et sa justification intentionnelles ne peuvent etre tolerees. En
condamnant M. Perincek, les juridictions suisses ont rappele cette
evidence. L’Association Suisse-Armenie (ASA), qui avait initie
l’affaire en Suisse en portant plainte contre le requerant, a ete
admise par la Grande chambre de la Cour europeenne des droits de
l’homme a intervenir dans la presente cause. À cette occasion, l’ASA
a tout d’abord tenu a rappeler la necessite de proteger la memoire
des victimes du crime perpetre en 1915 par l’empire ottoman. Ces
victimes ont ete oubliees par la Cour dans son precedent arret.

L’ASA a ensuite fait valoir que les juridictions suisses ont
soigneusement examine l’affaire et correctement apprehende le
caractère reprehensible des propos de M. Perincek. L’ASA deplore le
fait que la Cour se soit substituee aux juridictions suisses, en les
contredisant et en remettant notamment en cause le consensus autour
de la qualification des massacres de 1915.

Enfin, l’ASA a fait savoir qu’elle avait ete profondement meurtrie
par certains passages de l’arret du 17 decembre 2013 et notamment en
ce que la Cour a procede a une distinction entre genocides, laquelle
conduit a une difference de traitement malheureuse entre les victimes
des genocides.

Alors que le centenaire du genocide des Armeniens sera commemore
cette annee, l’ASA forme le voeu que la Cour europeenne des droits de
l’homme ne se meprenne pas sur la volonte de M. Perincek et confirme,
dans le cas d’espèce, le caractère reprehensible de ses propos.

If the Prosecutor General of Armenia Gevorg Kostanyan stated that
the suspect in the murder of the 7 members of the Avetisyan family
Valery Permyakov will be subject to criminal liability on Armenian
territory, then does that mean that the court decision related to the
case would convene at an Armenian court. The latter issue was raised
by lawyerHarutyun Baghdasaryan in an interview with Epress.am.

Baghdasaryan stressed that otherwise it would be considered a violation
of the Armenian constitution.

The lawyer cited the 91st article of the RA Constitution which states
that “In the Republic of Armenia justice shall be administered solely
by the courts in accordance with the Constitution and the laws. The
final acts of the court shall be adopted in the name of the Republic
of Armenia.”

The Constitution’s 92nd article defines which courts function on
territory of the Republic of Armenia: the Court of First Instance,
Court of Cassation, and Court of Appeals, while the law also specifies
specialized courts. The Constitution of the Republic of Armenia states
that establishing emergency tribunals is forbidden.

“Furthermore, articles 1 and 3 of the Criminal Judicial Code notes that
the definitive decision for events that take place on the territory of
the Republic of Armenia are to be tried in the Republic of Armenia’s
courts. While the 14th article of the Armenia’s criminal code clearly
defines that an individual who commits a crime on RA territory is
subject to liability of the RA criminal code. And it isn’t to be
forgotten that according to the 19th article of the RA criminal code,
that trials taking place in RA are conducted in Armenian language. In
fact, in relations to the Gyumri murder incidents, the Constitution
and judicial codes claims that trials taking place on RA territory
must only be implemented by a RA court,” said Harutyun Baghdasaryan.

The latter recalled that according to the 4th article of the August 29,
1997 agreement between Armenia and Russia, those Russian military base
members who commit crimes outside the military base are subject to
be investigated by Armenian law enforcement, while the 5th article
states that the Russian Federation investigates crimes that take
place in Russian military installations.

“However the 5th article of the agreement is also problematic and the
Constitutional Court must also deal with that and re-examine the issue
of the agreement’s constitutionality. The military base’s territory
is rented out by the Russian Federation, and that doesn’t mean that
that territory falls outside of the Republic of Armenia. The latter
is confirmed by the 31st article of the Constitution, which notes
that foreigners do not benefit from private land rights. In fact,
the 5th point of the article states that crimes that occur must be
investigated by the Armenian law enforcement and by Armenian courts,”
noted Baghdasaryan.

In relations to the Gyumri incidents, Baghdasaryan believes it is
important to stress the National Security Service’s (NSS) role or lack
there of. The latter importance is in regards to Valery Permyakov’s
attempt of crossing the Armenian-Turkish border, where he was supposed
to be subject to investigation by the NSS.

“If we, citizens of the Republic of Armenia, went to the border,
were located, threatened to be shot, and laid on the ground
(like Permyakov), would we have also been taken to the Russian
military base? The border guards are required to hand over the
suspect of crossing the border to the Armenian National Security
Service. Or how did they know exactly that the person was Permyakov,
who essentially had no personal identification on him. He could have
been an Argentinian,” said Baghdasaryan.

According to him, territorial jurisdiction and responsibility exists
on Armenian territory and it is not conditioned by the individual’s
residency or citizenship. The lawyer raised the issue of whether
the NSS opened a case against the attempt of illegally crossing the
border because judicial law (190 article) reserves that right to
NSS investigators.

“This is a fundamental issue. Maybe they did open a case, but they
haven’t stated it. While if they haven’t opened a case, then the
criminal code’s article 329.3 about illegally crossing the state border
needs to be implemented; “this Article is not extended to cases when a
foreign citizen or stateless person enters the Republic of Armenia to
enjoy the right for political asylum stipulated by the Constitution
of the Republic of Armenia.” Basically, if the NSS hasn’t opened a
criminal case, then it means that Permyakov has appealed for political
asylum,” said the lawyer.

LAKE SEVAN ENDANGERED WITH MERCURY POLLUTION

Lake Sevan in endangered with mercury pollution. Mercury demonstrations
were detected in the upper reach of Masrik river basin flowing into
Lake Sevan in the area of Sona spring and Verin Shorzha still in
1974-1978. Gold was also detected in the same area.

Currently ‘Alluvial Gold Mining’ CJSC has been issued a permit for
gold prospecting in the upper reach of the Masrik River, while
‘International Gold’ Company is undergoing the process of gold
prospecting permit.

‘Alluvial Gold Mining’ Company will carry out prospecting in 81.8 ha
area in Verin Shorzha community. ‘International Gold’ Company will
be carrying out prospecting in 695 ha of the administrative area of
Akunq community. It’s foreseeable that prospecting works will lead
to the leakage of mercury to the basin of the Masrik River.
