ARMENIAN RED CROSS SOCIETY COMPLETES CONCERTS-ON-WHEELS ACTION IN SUPPORT OF ANTI-AIDS FIGHT

ArmInfo. The Armenian Red Cross Society (ARCS) is completing the
Concerts-on- Wheels action in support of anti-AIDS fight, which aims
to raise the public awareness of HIV/AIDS problem.

The ARCS press service told ArmInfo that concerts have already been
held in Hrazdan, Ijevan and Kapan. On July 29 the last concert will
be held at the Lovers’ Park in Yerevan. The concert will also cover
social video-clips and films telling about the problem of AIDS,
and the spectators will receive booklets and condoms.

As of 31 May 2010, a total of 874 HIV cases were revealed among
Armenian citizens. Since 1988 over 200 HIV/AIDS patients have died
in the republic, among them women and children.

ArmInfo. A number of public figures of Armenia have sent a letter to
Education and Science Minister Armen Ashotyan asking him to investigate
the situation at Nubarashen special school N11.

To remind, the inspection held at the school in 2008 under the UN
“10 Best Schools” program detected a number of gross violations: poor
nutrition and sanitary conditions, bad treatment, exploitation and
even sexual harassment of children. May 24 2010 the Armenian language
and literature teacher of the school Levon Avagyan was sentensed to
two years in jail for sexual harassment of his pupils.

The authors of the letter say that those who, according to the
children, humiliated and harassed them or closed their eyes on such
behavior by their colleagues continue working at the school. The
former director of the school Meruzhan Yengibaryan – who persistently
ignored the pupils complaining of Levon Avagyan – has even asked the
Administrative Court to give him back his office.

“So, we urge you to investigate the situation at the school and to
effect staff changes,” say the authors of the letter: Artak Kirakossyan
(Civil Society Institute), Avetik Ishkhanyan (Helsinki Assembly of
Armenia), Veronika Melikyan (Foundation Against Violation of Law),
Mariam Sukhudyan (Green Movement).

ArmInfo. “The Armenian-Ukrainian relations could developed much better
but for the financial crisis, due to which the parties have lost
about 30-40% of the commodity turnover”,- said Ukrainian Ambassador
to Armenia Alexander Bozhko, who is completing his diplomatic mission
in the republic.

He pointed out that when he took office in Armenia in 2005, the
commodity turnover between the two countries was 118 mln USD, and
three years later it amounted to 310 mln USD.

“This proved that our relations were developing quite dynamically, and
we could have good prospects but for the global financial crisis”,-
he said. At the same time, he stressed that the Ukrainian embassy in
Armenia was actively working at reduction of the negative effect of
the crisis on the bilateral relations and worked out a social program,
which envisaged not only neutralization of possible threats, but also
ensuring of worthy future in the economic sphere.

As regards the inter-regional cooperation between Armenia and Ukraine,
Bozhko said that in autumn 2009 a delegation headed by the Governor
of Kharkov region of Ukraine visited Armenia and discussed possible
cooperation in the given field with the country’s authorities. In
addition, he stressed that cooperation in agriculture has already
been launched and is being promoted.

ArmInfo. Last week the International Court of Justice in the Hague
declared that Kosovo’s 2008 declaration of independence from Serbia
is legal, writes Yuri Roks, Nezavisimaya Gazeta correspondent, in
his item “Waiting for Honesty”.

He brings the words by Philip Crowley, U.S. Assistant Secretary of
State, saying that “Now is the time for them – for Kosovo and Serbia
to put aside their differences and move forward, working together
constructively to resolve practical issues to the betterment of the
lives of the people of Kosovo, Serbia, and the region.” However,
Crowley did not say how to do that in practice, for sovereignty is
the very stalemate in the relations of Belgrade and Pristina.

Nevertheless, Crowley highlighted that it is not applicable to any
other situation and cannot trigger more nationalistic movements in
the rest of Europe.

“Crowley as any other American official may speak of everything. After
bedlam made in Iraq by Washington, statements by American officials
no longer surprise anyone. Of course, one can say like Crowley
that the decision by Hague Court will have no impact on Abkhazia
and South Ossetia or Nagorny Karabakh and Transdniestria. One can
pretend not seeing the high response to that decision. For instance,
one can neglect the call of the Nagorny Karabakh Republic to Armenia
to recognize sovereignty of the NKR and speed up the process of
international or at least partial recognition of the republic
patronized by Armenia,” the author writes.

As regards inadmissibility of making Kosovo a precedent, the authors
of the project say that conflicts are different. In particular,
they say that in the post-Soviet area the centralized authorities
lost jurisdiction over the autonomous regions that later declared
independence and now demand the world community to recognize
their independence as a fair solution to the situation as they
think. One can share this thesis partially. It is not important
that the Abhkazian-Georgian or Moldavian-Trasndniestrian conflicts
might be provoked by a third party that wanted to retain power in
the post-Soviet republics-“colonies.” The matter is that there was
favorable situation for such provocation, especially when a nation
or part of the society had a hidden or open desire to dominate over
the other more than it was laid in the history of relations of those
antagonists. Therefore, having gained de-facto independence from the
center, these regions will not refuse their proclaimed sovereignty.

Especially, when this sovereignty has already been recognized once.

For instance, Abhkazia and South Ossetia were recognized by Russia
and Venezuela, Nicaragua and Nauru. Hence, such a differentiated
approach to separatist problems when Kosovo can because :but others
cannot because:is becoming archaic. And the following statement
by the Nagorny Karabakh Foreign Ministry seems quite legitimate:
“By its resolution of July 22, 2010, the International Court of
Justice confirmed and legally endorsed that the right of nations to
self-determination and its realization do not violate any principle
or norm of the general international law, including the principle of
territorial integrity.This resolution is of extremely legal, political
and moral, as well as universal precedent-related significance and
cannot be limited just with Kosovo’s example.”

The peoples that declared independence and have been living in freedom
for almost 20 years do not care for legal, political, economic nuances,
combinations and expediencies. They have much simpler approach:
Kosovo was pressed, but gained independence and we did so.

They suffered thousands of victims and we did, so why they are allowed
to be sovereign but we are not, despite our centuries-long history?

ArmInfo. The verdict of UN International Court, according to
which the independence of Kosovo does not conflict with the rules
of international law, has confirmed that the peoples’ right for
self-determination may not be prejudiced by other principles of
international law, Chairman of European Integration organization,
political expert Karen Bekaryan said at today’ s press-conference.

According to him, the statements saying the Hague Court’s decision
has created a precedent to further promote fair solution of the
Karabakh problem are true, however, one should not overrate the
verdict’s abilities.

“Finally, the Court’s decision does not envisage legal consequences,
it is not binding to application. Nevertheless, due to the verdict,
the chances of Nagorno Karabakh to lobby its interests to prove that
is an international subject essentially increased”, Bekaryan said. On
July 22, UN International Court confirmed that declaration of Kosovo
independence did not conflict with international laws. In particular,
according to the decision, unilateral declaration of independence
cannot but be legal.

To recall, independence from Serbia was declared by Kosovo parliament
on February 17, 2008. Before declaration of independence, Kosovo was
under UN administration from 1999 to 2008.

ArmInfo. Delegation led by Defense Minister of Armenia Seyran Ohanyan
was on a working visit to Afghanistan on July 24-26. The Armenian
Ministry of Defense reported that on July 24 Minister Ohanyan visited
the Armenian peacekeeping union under the German command in NATO
ISAF North Command in Afghanistan, Kunduz, and got first hand view of
the service of Armenian peacekeepers at the strong points of Kunduz
Airport. RA Armed Forced spiritual leader Vrtanes Bishop Abrahamyan
blessed the chapel built by Armenian peacekeepers and named after St.
Tadevos Apostle.

The delegation met with ISAF Afghanistan commander, US AF general David
Petreus, the North Command of ISAF Afghanistan and the leadership of
the Kunduz province restoration group. The parties discussed security
atmosphere in Afghansitan and in the region, challenges connected
with the procedure of transferring responsibility for security of
the region from ISAF to Afghan armed forces as well as the results
of the Summit in Kabul and the prospects of cooperation.

ISAF leadership thanked Minister Seyran Ohanyan for perfect and
exemplary service of the Armenian peacekeepers and the important
contribution to security of the strategic areas in the north of
Afghanistan. Heinz Werner Fritz, the North Command of ISAF Afghanistan,
briefed on the security situation in the north of Afghanistan, the
strategy of actions, the command structure, achievement and challenges.

On July 25 Minister of Defense of Afghanistan Abdul Raheem Wardak,
chief of the AF GS of Afghanistan, lieutenant-general Sher Mohammad
Karim received the Armenian delegation. Service of the Armenian
peacekeeping union in Kunduz was highly appreciated during the
meeting. Minister Wardak said that as compared to last year, the
growth of incidents has objective reasons: the number of ISAF and
Afghan security forces sharply grew and security measures embraced the
regions where security actions were impossible before. He said that
despite many problems public and economic growth was registered in
Afghanistan since 2002 also thanks to efforts of the world community,
statistical data say.

ArmInfo. July 28 the SOS Tekhut group will hold a protest action
in front of VTB Bank. The protesters will speak against the bank’s
financing the ACP’s Tekhut project.

VTB Bank is planning to provide $280mln for the development of the
Tekhut copper-molybdenum deposit despite ecologists’ warnings that
this project will damage the ecology of the area and the health of
the local population. The protesters say that the ecological risks
specified in the ACP’s project are seriously understated. Besides,
the Tekhut project runs counter to Armenia’s legislation and the
international conventions the country has signed.

Tekhut is the second biggest deposit in Armenia after Kajaran with
estimated reserves of 450mln tons of ore, 1.6mln tons of copper and
99,000 tons of molybdenum. The ACP’s project was approved by the
Armenian Government in Nov 2007.

Armenia — A court in the town of Hrazdan holding the trial of four
police officers accused of ill-treating a man who died in police
custody, 27July 2010.

The recently sacked police chief of the central Armenian town of
Charentsavan on Tuesday continued to avoid testifying at the ongoing
trial of his former subordinates accused of ill-treating a man who
died in local police custody.

Norik Heboyan is regarded by both the defendants and the victim’s
relatives as a key witness who could shed more light on the
circumstances Vahan Khalafian’s death.

Khalafian, 24 was among several local residents arrested by the
Charentsavan police on April 13. He was hospitalized with severe
injuries and died several hours later.

State prosecutors say Khalafian stabbed himself to death after being
tortured by Major Ashot Harutiunian and the three other police officers
standing trial. Khalafian’s relatives, backed by some human rights
activists, insist that he was tortured to death and that investigators
have failed to hold accountable all local police officials responsible
for his brutal treatment.

Heboyan was sacked as head of Charentsavan’s police department in
late May. The chief of the national police service, Alik Sargsian,
accused him of “negligence” and said he has “no right to continue to
work in the department.”

Nonetheless, both Heboyan and his deputy Samvel Tonoyan avoided
prosecution. Unlike his boss, Tonoyan was not sacked despite being
linked with the incident by the dead man’s relatives. According to
some media reports, Khalafian was found dead shortly after Tonoyan
arrived at the Charentsavan police station.

The police official denied any involvement in the torture when
he testified at a court in the nearby town of Hrazdan on July
21. Heboyan was also due to give testimony on that day but failed to
show up without any explanation. The presiding judge, Mesrop Makian
interrupted court proceedings as a result.

Heboyan also failed to attend the next court session held on Tuesday.

In a letter to the judge, he claimed to have left Armenia on July 22
in order to receive medical treatment in an unnamed foreign country.

He said he will stay there for an “indefinite period of time.”

Heboyan also told the court that he stands by his pre-trial testimony
and wants it to be read out during the trial. Both the defendants
and the Khalafian family demanded, however, that he testify in person.

“There is no proof that Heboyan is in need of treatment,” said Artak
Zeynalian, one of the family’s legal representatives. “His behavior
suggests that he is guilty.”

Seda Safarian, the main defendant’s lawyer, likewise suggested that
the former Charentsavan police chief knows more about the custody
death. “I just want to clarify whether his subordinates had the
audacity to commit so many violations on that day [without his
approval,]” she told RFE/RL’s Armenian service.

Judge Makian responded by adjourning the trial until August 18. He
ordered court officials to ascertain whether Heboyan is indeed sick
and, if necessary, ensure his presence at the trial.

Heboyan is not the first witness in the case to leave the country in
suspicious circumstances. Two Charentsavan residents, who were among
those detained on April 13, emigrated to Belgium and Russia just days
after Khalafian’s death.

Artur Sakunts, an Armenian human rights campaigner who met both men
before their departure, claims that at least one of them was also
beaten up in detention. Sakunts has also accused the police of forcing
them to go abroad to avoid more embarrassing accounts of torture. The
police and prosecutors deny these allegations.

right the Kosovo precedent is very beneficial for us in respect of the
solution of the Artsakh issue,” political analyst Levon Shirinyan told
Armenpress, pointing out that the NKR has established state on its
historic territory. “We must get use of this convenient opportunity
but we must also be alert in respect of diplomatic and international
right,” the political analyst said.

“The first is the army, the strong state, keeping high the mood of the
people, and stemming from all this continuatively defend Artsakh’s
issue in the international instances,” he expressed opinion, noting
that we must have mood for a long way. He said the Artsakh issue will
not be solved quickly, in this region the conflicts and conflict
of interests are very sharpened and the big states will not reach
agreement in the near future.

“The USA backs Kosovo and we must keep breath for a long run, improve
the economy, increase the level of livelihood of the people, etc.,”
Shirinyan said, adding that it would have been right if the Artsakh
issue, as Kosovo one, enters court as our stance is powerful and in
legal respect is clean.

of the independence of the Nagorno Karabakh first of all serious
financial investments are necessary, deputy head of the Russia’s
geo-political affairs academy Ara Sargsyan said, informing that for
reaching Kosovo’s independence the oligarchs of that country invested
millions of dollars thanks to which different international diplomats
and experts carried out extended propaganda work throughout the world.

“Only Albanian oligarch Khashim Tacin paid well-known diplomat Machti
Akhtisarii 250 million USD,” Ara Sargsyan said.

In his opinion the key to the settlement of the NK issue is in the
hands of West. “If the USA wished the NK issue would have been settled
long ago. The way of the settlement of the NK issue as well as the
South Caucasus are under the control of the USA, France and Great
Britain. Russia too has ways to settle the Karabakh issue but it does
not do that waiting for returning its full influence on the South
Caucasian countries which sooner or later will take place,” he said.

According to the analyst, Armenia must start active diplomatic work
with Balkan countries – Former Yugoslav Republic of Macedonia which
is going to recognize Kosovo’s independence in the near future. “We
must work with such countries who accept and consider the principle
of self-determination a prior one,” Ara Sargsyan said.
