Armenian National Congress member, freedom-fighter Zhora Sapeyan was
released from “Artik” penitentiary after serving full time in prison.

Sapeyan warmly greeted the HAK members, combat friends and relatives
and assured that “either in prison or in liberty, in Armenia or abroad,
he will do everything for the freedom of each citizen.”

Zhora Sapeyan is sorry for the political prisoners who are still in
prison, especially his friend in combat, Sasun Mikayelyan. “Sasun
Mikayelyan is in critical condition. He has very strong willpower
and doesn’t show that he is sick. If the authorities were at least
a little humane and had some common sense, they would have to send
him to the city hospital.” After his release, Zhora Sapeyan rushed
home to see his parents. Then, he plans to visit the area near Saryan
statue and Myasnikyan statue to lay flowers at the memorial dedicated
to the 10 victims of the events of March 1.

Let us remind that the authorities had not only sentenced Zhora
Sapeyan, but his brother Mkrtich Sapeyan and other relatives after
the incident that took place in Talin during the 2008 RA presidential
election campaign.

The Sapeyans were charged under Part 3, Article 258 of the Penal Code
for hooliganism and Ter-Petrosyan’s pre-electoral headquarters had
named it as an intrigue.

"Gazel" And "Zil" Clashed

“GAZEL” AND “ZIL” CLASHED

On July 28 at 15:16 p.m. a car accident took place on the 13th km of
Yerevan-Sevan highway.

A rescue team from Abovyan city left for the scene.

In unknown circumstances, the “Gazel” car with license numbers 1677 L
and “ZIL-130” with license numbers 069 SL 65 clashed, leaving driver
of the “Gazel” car Karo Hakobyan (born in 1958) with physical injuries
of different degrees.

Rescuers and firefighters helped bring Hakobyan out of the car and
transferred him to the ambulance employees, as reported by Armenia’s
Rescue Service.

Two Black Swans

TWO BLACK SWANS

Two black swans were transferred from Yerevan Zoo to Swan Lake by
the assignment of the Mayor of Yerevan.

There is a separate place for the pair of swans to rest after swimming
in the heat.

The zoo experts will be in charge of feeding and taking care of
the swans. The experts call on those visiting Swan Lake to not feed
the swans.

The Co-Chairs of the OSCE Minsk Group, Ambassador Igor Popov of Russia,
Bernard Fassier of France, and Robert Bradtke of the United States,
released the following statement today:

The OSCE Minsk Group Co-Chairs (Ambassador Bernard Fassier of France;
Ambassador Robert Bradtke of the United States; Ambassador Igor Popov
of the Russian Federation) met with the members of the Minsk Group
July 28 in Vienna, Austria.

They briefed the Minsk Group on recent developments in negotiations on
the peaceful settlement of the Nagorno-Karabakh conflict, including:
discussions held in St. Petersburg June 17, 2010 by the presidents
of the Russian Federation, Armenia, and Azerbaijan; the meeting of
the Heads of Delegation of the OSCE Minsk Group Co-Chair countries
with the Foreign Ministers of Azerbaijan and Armenia July 17, 2010;
and the joint statements issued by the Minsk Group Co-Chair countries
in Muskoka and Almaty.

The Co-Chairs stressed that the efforts made so far by the sides of
the conflict have not been sufficient to overcome their differences,
and that additional actions are needed to reinforce the ceasefire and
demonstrate a spirit of compromise. To assist the parties in their
efforts, the Co-Chairs plan to visit the region in early September.

LOS ANGELES, Calif. – Armenian-Americans have filed a lawsuit in Los
Angeles against the Turkish government and two major Turkish banks
for alleged damages dating back nearly a century.

Attorneys say heirs of Armenians killed and driven out of Turkey in
1915 are entitled to billions of dollars for property seized from
their ancestors. They are seeking class-action status for the case
filed Thursday.

Attorneys say the case is the first Armenian lawsuit directly naming
the Turkish government as a defendant. Also named are the Central
Bank of Turkey and T.C., Ziraat Bankasi. Emails to both banks were
not immediately returned.

The lawsuit says the property taken includes businesses, bank deposits
and vast amounts of land. Lawyers say some priceless artifacts seized
are now on display in Turkish museums.

LOS ANGELES-Armenian-American lawyers filed a federal lawsuit Thursday
against the Turkish government and two banks seeking compensation for
the heirs of Armenians whose property was allegedly seized nearly a
century ago as they were driven from the Turkish Ottoman Empire.

Lawyers were seeking class-action status for the suit, a process that
attorney Brian Kabatek said could take as long as three years.

“We are rolling up our sleeves and are going forward,” he said.

The suit was filed on behalf of plaintiffs Garbis Davouyan of Los
Angeles and Hrayr Turabian of Queens, N.Y. It alleges breach of
statutory trust, unjust enrichment, human rights violations and
violations of international law.

It seeks compensation for land, buildings and businesses allegedly
seized from Armenians along with bank deposits and property, including
priceless religious and other artifacts, some of which are now housed
in museums in the Republic of Turkey.

Attorney Mark Geragos said it was the first such lawsuit directly
naming the government of the Republic of Turkey as a defendant.

“All of the lawyers involved have relatives who perished or fled the
Armenian genocide, which gives it a special poignancy for us,” he said.

The lawsuit claims more than a million Armenians were killed in
forced marches, concentration camps and massacres “perpetrated,
assisted and condoned” by Turkish officials and armed forces.

The U.S. government does not recognize

the mass killings of Armenians during World War I as genocide.

Also named in the lawsuit were the Central Bank of Turkey and T.C.,
Ziraat Bankasi, the largest and oldest Turkish bank with origins
dating back to the 1860s.

The lawsuit claims the government of Turkey agreed to administer the
property, collect rents and sale proceeds from the seized assets and
deposit the receipts in trust accounts until the property could be
restored to owners.

Instead, the government has “withheld the property and any income
derived from such property,” the lawsuit said.

A message left with the Turkish Consul General’s office in Los Angeles
was not immediately returned. After-hours e-mails seeking comment
from both banks were not immediately returned.

Lawyers for the plaintiffs believe records of the properties and
profits still exist, and they are seeking an accounting that could
reach billions of dollars.

Geragos said the biggest issue in Armenian communities is seeking
recognition for the ethnic bloodshed that allegedly claimed the lives
of as many as 1.5 million Armenians between 1915 and 1919.

In 2000, the California Legislature recognized the deaths as genocide
when it allowed heirs to seek payment on life insurance policies of
dead relatives.

The 9th U.S. Circuit Court of Appeals later invalidated the law.

Geragos has appealed that ruling.

Still, the heirs were paid nearly $40 million by New York Life
Insurance Co. and French insurer AXA.

One of the key elements in opposing President Barack Obama’s
ambassadorial nominee to Azerbaijan, Matthew Bryza, is the glaring
conflict of interest his wife’s position at the Hudson institute
poses to the highest US post in Baku.

During last week’s Senate Foreign Relations confirmation hearings,
Bryza went to great lengths to ensure senators that his wife, Turkish
activist Zeyno Baran’s position at the Hudson Institute would not
pose a problem. In her professional capacity, Baran advocates for
Caspian energy issues and interests.

“…we [Bryza and Baran] have also made a choice, made a decision 10
years ago-we’ve been together a while-to separate our professional
and private lives. So while our thinking may sometimes coincide,
and while Zeyno’s positions that she’s advocated in the past, do
often reflect U.S. interests, that’s a positive, because that’s her
natural way of thinking and again that’s one of the reasons why we
came together, we see the world in a similar way,” Bryza told the
Senate panel in response to an inquiry by Sen. Jeanne Shaheen (D-NH)
who was chairing the session.

“That said, Zeyno has undertaken a pledge to refrain from bringing any
issue related to the Hudson Institute before the bureau of European
and Eurasian affairs at the State Department or before the Embassy of
the United States in Baku if I am confirmed. And I, of course, would
maintain the highest ethical standards as I have throughout my career
and would not take up any issue related to the Hudson Institute without
proper authorization of course – if there is some reason for doing
that, but I would have to be authorized from Washington,” added Bryza.

In an April 2008 interview with Day.az, Baran proclaimed that one’s
“personal life should not be confused with state policy,” calling
Armenian concerns of conflict of interest that were expressed back
then “groundless.” Yet, in the same interview, which is peppered with
pro-Azeri posturing she proclaimed that “even if Armenia recognizes
independence of Nagorno Karabakh, none of the countries, including
its ally Russia, will support it.” She also claimed that primarily
“hundreds of Azerbaijani refugees and IDPs would win,” in the event
of a resolution to the Karabakh conflict.

What Bryza failed to explain during the July 22 Senate committee
hearings was that between 2002 and 2008, he and his wife have either
worked together or have appeared on the same panels (some funded by
energy corporations and interests in Azerbaijan and Turkey), among
them a 2006 Assembly of Turkish American Associations conference in
Washington and another one the same year organized by the US-Azerbaijan
Chamber of Commerce.*

So, the “decision” that the couple made 10 years ago, as Bryza
testified last week, seems to fraught with exceptions, as the
aforementioned examples are merely a scratch of the surface of their
pro-Turkish/Azeri collusion.

Bryza is not the person who should represent the interests of the
United States in Azerbaijan. He was less than forthcoming during his
hearing and failed to provide concrete responses to concerns voiced
by senators Shaheen, Robert Menendez and Barbara Boxer. His attempts
to circumvent justified concerns of conflict of interest demonstrate
his inability to be forthright and trustworthy-a clear detriment to
US interests abroad.

For all the effort to undo the mistakes of his predecessor, it was
unclear why Obama chose a Bush-era vestige as his choice to lead US
interests in Baku, but now the Senate has the opportunity to correct
that misguided error.

* The list below is a mere representation of their joint work
that clearly contradicts their claims separating their private and
personal lives:

October 2008 Baran interviewed Bryza for her paper, titled, “Security
Aspects of the South Stream Project” advocating the Nabucco energy
pipeline.

Needham – It is incredible that New England Anti-Defamation League
board Chairman Michael Sheetz claims the “controversy that led to (No
Place for Hate’s) demise in Needham” has “been over for a long time.”

Nothing has changed since Needham took a principled stand in support
of universal human rights and withdrew from NPFH, due to the ADL’s
denial of the Armenian Genocide.

The official ADL statement on the Armenian Genocide is worded to
actually contravene the international legal definition of genocide
and is remarkably similar to Turkey’s pronouncements.

Armenians did not protest simply because “the ADL national leadership
did not fully recognize the Armenian Genocide.” The ADL for years
actively lobbied on behalf of the Turkish government to prevent U.S.

recognition of the Armenian Genocide. The ADL continues to speak out
against U.S. affirmation of this crime against humanity. In March,
ADL national director Abe Foxman called the current Congressional
resolution “a counterproductive diversion,” adding, “We oppose it.”

Many in the Jewish community strongly disagree with the ADL’s position,
and have joined with Boston-area Armenians to work toward Armenian
Genocide recognition. (See )

Genocide denial is hate speech. The ADL does not “secure justice for
allpeople” and should not be permitted to instruct others.

Needham Letters: Returning to the ADL’s noble mission

Needham – I was appalled to read Michael Sheetz of the Anti-Defamation
League stating, “I think the controversy that led to the [No Place
for Hate] program’s demise in Needham is over and been over for a
long time.” (“Needham man, Michael Sheetz, joins ADL New England
leadership,” July 21.)

Let me set the record straight. The ADL not only continues to deny the
veracity of the ongoing Armenian Genocide, but also supports passage
of congressional resolutions on all genocides except the Armenian one.

In fact, the ADL’s most recent formal statement (Aug. 21, 2007) on the
Armenian Genocide employed language deliberately designed to contravene
Article II of the U.N. Genocide Convention of 1948, which defines
genocide as “the intent to destroy, in whole or in part, a national,
ethnical, racial or religious group.” The ADL statement said that
“the consequences of those actions [by the Ottoman Turkish Empire]
were indeed tantamount to genocide.” The ADL knows full well that
“consequences” is the functional opposite of “intent,” the latter of
which is required for an action to legally be termed genocide.

Thus, the ADL statement was the very opposite of a genocide
acknowledgment. Under these circumstances, no program sponsored by
the ADL or any other genocide-denying entity is welcome in our town
or in any other city or town nationwide and worldwide.

There is nothing more appropriate on this the 95th anniversary of
the start of the Armenian Genocide than for the ADL to steadfastly
return to its noble mission of stopping “the defamation of the
Jewish people and [securing] justice and fair treatment to all”
and to forthrightly recognize the Armenian Genocide and openly back
congressional legislation on this genocide. By doing so, the ADL will
not only restore its moral credibility as a human rights organization,
but also become a leading international partner in genocide prevention
and restorative justice.

As the esteemed Rabbi Hillel advised centuries ago, “What is hateful
to you, do not do to your neighbor … If I am not for myself, then
who will be for me? And if I am only for myself, then what am I? And
if not now, when?”

Six Armenian army servicemen have been reportedly shot dead this week
in two separate non-combat incidents highlighting lingering abuse
and other serious problems within the country’s armed forces.

The Armenian Defense Ministry reported on Thursday evening that an
“incident” involving “use of firearms” and resulting in an unspecified
number of casualties took place at one of its military bases on
Wednesday. It gave no details, saying only that military investigators
have received “strictest orders” to clarify all circumstances of
the incident.

A source close to the Armenian government told RFE/RL’s Armenian
service that it occurred at an Armenian army unit in Nagorno-Karabakh.

The source said a soldier serving there shot dead four officers before
turning his gun on himself.

Artur Sakunts, an Armenian human rights campaigner, gave similar
information to the Lragir.am news service. But he cautioned that it is
“preliminary and unconfirmed.”

Armenia — A photograph of Artak Nazarian, an army officer found dead
in Tavush region.

The shooting was reported two days after another officer was found
dead in at an army outpost on Armenia’s border with Azerbaijan. Citing
“preliminary information,” the Defense Ministry said Lieutenant Artak
Nazarian shot himself for unknown reasons.

Nazarian’s relatives swiftly rejected the official theory and accused
the military of a cover-up. “He believed in God and knew that suicide
is a great sin,” his grief-stricken mother, Hasmik Hovannisian,
told RFE/RL on Thursday. “He could not have committed suicide. They
savagely slaughtered my boy.”

“He was safe and sound when I gave him [to the army,]” she cried.

“What are they giving me back?”

Nazarian’s elder sister, Sona, was convinced that the 30-year-old was
either forced to commit suicide or killed by fellow servicemen. “If
it was a suicide, just imagine how much suffering and humiliation
he endured before resorting to that,” she said. “If it was a murder,
just imagine what predators live among us.”

Nazarian’s cousin Narek Gharibian was present at a forensic
examination of his body that was conducted at a Yerevan morgue on
Wednesday. Gharibian told RFE/RL that forensic medics found numerous
injuries on the dead officer’s face, hands, shoulders and feet and
believe that they were inflicted several hours before his death.

The medics will formally present their finding within a month, added
Gharibian. An official death certificate given to the family on
Thursday contains no definitive cause of the death. Nazarian’s face
was heavily made up when his body was brought home and lay in state
later on Thursday.

The relatives also said that Nazarian complained of having difficult
relations with his commanders and other officers shortly after
enrolling in contractual military service and being sent to an army
unit in the northeastern Tavush region last November. They said he was
treated as a “weak” officer who can not impose his will on soldiers.

“The death of our Artak must be a lesson to others,” said Sona
Nazarian. “We’ll go to the end in order to identify the guilty and
have them punished with all the strictness of the law so that there
is no repeat of such cases.”

Sources told RFE/RL that military investigators, who are subordinated
to Defense Minister Seyran Ohanian, have questioned several officers
from Nazarian’s unit. None of them has been arrested or charged so far.

The Armenian Armed Forces have been plagued with hazing and other
abuses resulting in at least a dozen non-combat deaths each year
ever since their establishment in 1992. Senior and mid-ranking army
officers have rarely been prosecuted in connection with those crimes.

Those who are put on trial usually get off with short prison sentences.

In a June 2008 statement cited by the U.S. State Department earlier
this year, families of soldiers who died during military service
between 2005 and 2008 accused authorities of systematically conducting
false investigations into those deaths and destroying or tampering
with evidence in order to disguise homicides as accidents, suicides,
or the results of sniper attacks.

The Armenian military insists that it is doing its best to address the
problem in earnest. It says the number of such incidents has steadily
and significantly declined since the late 1990s. According to Defense
Ministry data, at least seven Armenian soldiers died due to abuse
and mistreatment and eleven others committed suicide last year.

On Nkr And Regional Issues

ON NKR AND REGIONAL ISSUES

As it is known, right after the meeting of the presidents of Armenia,
Azerbaijan and Russia on June 17 in St. Petersburg, I.Aliyev left
Petersburg and on June 18 in the NKR Armenian side suffered losses
after the subversive act of Azerbaijani forces. It is less known that
this incident was followed by the equal actions of our armed forces.

Any way, those events were received rather sharply in our society
and they activated the discussion of various military scenarios. In
addition all that was followed by various information flows –
with the approval of great powers the “conventional” war will take
place in the NKR and the parties will be separated by the Russian,
Turkish and American (or NATO) peacekeeping forces, Israeli and Iranian
bombers were redeployed from Georgia (!!) to Azerbaijan and are ready
to hit Iran and the later, in response, concentrates troops at the
Iranian-Azerbaijani border. Even the moment when scandal connected
with the “Russian spies” in the US was aroused in the media was
interpreted by some foreign analysts as an attempt to divert the
attention of the international community from the “Iranian” war.

The overwhelming majority of those information messages, as it is
well known to the expert community, are obvious disinformation. But,
taking into consideration the sources of those large-scale information
actions and the fact and time of emerging of such a disinformation in
general, one should state that a little morbid interest in the region
has considerably increased and this is not only conditioned by the
NKR issue. Such a process comes to prove that the regular qualitative
changes and rearrangements are taking place in the region. Let us
try to describe previous stages in order to understand their content
and orientation.

The stages of negotiation process The negotiations on international
recognition of the NKR within the OSCE Minsk group and other formats
has been going on since the early 90s and since that time the military
and political logic in the region has undergone serious changes as
a result of global geopolitical shifts.

At the first stage of Armenian-Azerbaijani military confrontation
the mediatory mission was undertaken mainly by Russia and partially
by Iran and this was ended by the conclusion of a truce in 1994 in
Bishkek. One may say that at that stage the important but gradually
decreasing role of the RF on the post-Soviet territory was decisive.

At the next stage the initiative belonged to the Minsk group but
within that format the most active parties were the US and France. The
meetings between presidents of Armenia and Azerbaijan were held in
Europe or the United States (the most remarkable is the 2001 meeting
in Key West). Despite the traditional pressure by the great powers
and the non-less traditional optimistic prospects and statements
of the Minsk group co-chairmen, the most important result of that
stage was the clarifying of the positions of the parties to the
conflict which is also rather serious result in the context of the
negotiations process. It is remarkable that that stage lay within
the logic of setting and further establishment of one-polar world
system, the resumption of the Cold war between the US and Russia
(in the later context it is remarkable that since 2003 the decrease
of American activity in the NKR issue has been observed).

The Georgian-Russian war in South Ossetia in August 2008 may be
conventionally considered the beginning of the current stage. The
later is a result of the geopolitical shifts which are conditioned
by the formation of the multi-polar world. As a result the role of
the US in our region reduced and the influence of the Russian factor
has considerably increased. One can state that today, according to
classical formulation, Russia has acquired the “status of the equal”
in the Minsk group and it tends even more to consolidate its positions
in South Caucasus where Armenia is its main base station and the
only territory where Russian forces are stationed. In this aspect
it is not a mere chance the meetings of the presidents of the RA
and AR are held under the patronage of Russia and the last meeting
in Petersburg (after a long interval) is the evidence of that. By
the way, it is possible that the demonstrative departure of Aliyev
from the conference in Petersburg was conditioned not so much by the
well-known stance of the president of the RA but by the new proposals
made by the Russian president. Let us also mention that the possible
meeting of the presidents of the RA and AR in Almaty is outlined which
proves that the process of negotiations is continuing and Aliyev’s
demarche is nothing else but a diplomatic trick and not a stance
based on principles or ultimatum. At the same time, it is necessary
to state that not only Russia has become active in the region.

Other regional actors If Iran’s regional policy is characterized by the
consistency and stability, the same cannot be said about Turkey which
demonstrates diplomatic and information activity. It is characteristic
that over the years of the American dominance that country clearly
carried out its “duties” in regard to the US, but the formation of
the multi-polar system has considerably increased the level of the
“autonomy” of Turkey and Ankara, taking abrupt steps, started searching
its place in the new system. There is an impression that Turks’
actions are not efficient enough under the new conditions. There is
an aggressive ideological symbiosis of Neo-Ottomanism, Pan-Turkism and
Eurasianism formed in the country1, which incites Ankara to take steps
which sometimes seem to be rather hasty. They are manifested in both
factual failure of the Armenian-Turkish negotiations and provocations
against its former ally Israel2. Let us mention that anti-Israeli
actions, despite the official denouncements by some countries, were
not taken unambiguously by the western community. But the US, which
attach importance to the logistic and communication role of Turkey
(and Azerbaijan) in the war in Afghanistan, is not only worried by
deterioration of the relations between Turkey and Israel but also
by the stance of that country on the Kurdish issue and attempts to
develop the relations with Iran3 and some Arab countries.

Russia is not indifferent to the Turkish activity too. If the
contradictions between the US and Turkey are advantageous for
Moscow from the geopolitical point of view, the later cannot
tolerate the coordinated actions of Turkey and its “small brother”
Azerbaijan in Transcaucasia which has traditionally been considered
by Russian strategist as “their territory”. It should also be taken
into consideration that though Russia concludes energy agreements
and develops trade relations with Turkey and Azerbaijan, but the
geopolitics has always prevailed over the economic categories.

It is remarkable that the Azerbaijani aggressiveness as well as
the Turkish one, is a derivative of the ideology. It is known that
Azerbaijan and Azerbaijanis as a state and nation are rather newly
formed entities and they need nation forming ideology. Today they
took as a basic provisions not the civilizational ideas and values
(maybe due to their absence) but extreme anti-Armenian moods. Today,
as a result of the totalitarian propaganda of Aliyev’s administration
Azerbaijan has turned into a territory with very bellicose and
intolerant population. This takes Azerbaijanis to the trap, i.e. they
have difficulty in getting out of the ideological doctrines they
have invented, because anti-Armenian moods have turned into official
doctrine, perception of the world and policy.

Conclusions About 16 years has passed since the conclusion of the
truce; in the NKR status quo has preserved till now, and from some
point of view this fact can be regarded as achievement. At the same
time the current state contains some risk among which the following
can be mentioned:

Relative retreat of the US from the region and due to that reason
the reduction of the general level of political “order”.

Formation of the nationalist ideological environment in Turkey and
acquiring of the political “autonomy” by that country, which is
particularly manifested in the claims to South Caucasus.

Establishment of the anti-Armenian ideological field in Azerbaijan
and development of the strategic cooperation with Turkey.

Among the positive factors the following items can be distinguished:

Establishment of the NKR as a state and particularly consolidation
of that fact in the consciousness of the international community.

Acquiring of the diplomatic maturity by the Armenian political elite,
Geopolitical rehabilitation of Russia and aspiration of the authorities
of that power to be main “regulator” in the region (without Turkey),
Strategic and world-view contradictions between Turkey and US, Israel
and some European countries (in particular Germany) and formation of
the negative perceptions of Turkish factor in the European community.

At the same time, it is obvious, that the solution of the NKR issue
in accordance with our perceptions mostly depends on the level of the
preparedness of the all-Armenian community. It should be taken into
consideration that the political situation in the region can change
qualitatively at some stage. According to the political conception of
the so-called “characteristics of the self-organizing criticality” 4
the military and political system may develop evolutionary till some
“critical condition”, in which even the most insignificant events
may cause rapid chain reaction changing quality of the whole system.

Previously such critical condition was formed as a result of the
collapse of the USSR and two-polar world. In present rather painful
process of the multi-polar system formation is going on in which
consequence a kind of “critical condition” can also be reached and
after that the events will develop rapidly or, in other words, they
will be of non-linear character. In order to be prepared for such
a situation the RA and NKR should solve many topical problems among
which the following can be mentioned:

Elaboration and implementation of the realistic strategy of the
all-Armenian development, because in future the general level of the
society development will be decisive in the possible confrontations.

Formation of the component which will be directed to lobbying our
state and national interests by the Armenian organizations in the US,
and initiating the activity in that sphere in Europe and Russia.

“Peace flotilla” is interpreted by some analysts from the point of
view of “conspiracy”. They state that this operation was elaborated
by the leaderships of two countries and is directed to consolidation
of Turkey as a leader of Islam world. However this is perfunctory

was conventional”). The contradictions between Israel and Turkey are
of along-term and objective, one may even say, of world-view character
