On October 28, a delegation of Armenian police headed by police chief,
Lieutenant General Alik Sargsyam left for a two-day visit to Tehran at
the invitation of the chief of Iranian police Ismail Ahmadi Moghaddam.

Chief of the Armenian police plans to hold meetings with Ismail
Ahmadi Moghaddam, Hamid Reza Hossein-Abadi, commander of the anti-drug
squad of the Law Enforcement Forces, as well as the representatives
of local Armenian community, RA police press service informed NEWS.am.

The NKR current status obliges us to observe the human rights more
strictly. The European human rights convention, which was adopted
after the World War II, proclaimed the basic human rights and
freedoms, which are the necessary conditions for real democratic
development. Currently, our Republic follows this convention. We have
also created the human rights, or Ombudsman Institute, which is firm
in its development process, though overcoming certain difficulties. It
proves the international community that after the collapse of the
Soviet rule the tendency of democratic development in the NKR is
obvious, so our country can introduce itself to the world with
the proper level of self-rule and self-government. Following is our
interview on human rights issues with NKR Ombudsman Yuri Hairapetian: –
Mr. Hairapetian, the Human Rights Institute has occupied its place
in the state system. It is fairly considered an attribute of an
established state. What are the achievements of the Ombudsman Institute
in the NKR and what development level have you personally fixed? – Yes,
you are right in noting that the Ombudsman Institute is considered an
attribute of an established state. This was the reason that, following
the sample of the overwhelming majority of the world states, it was
created in our country on April 16, 2008, and the NKR NA elected the
Ombudsman. This was also an unprecedented step, as there is no state
in the world, which created a similar structure in the conditions
of martial law, while just the contrary is conceded – restriction of
some human rights and freedoms. The Ombudsman Institute creation is
a component of the democratic processes in the NKR, which is aimed at
improving the statehood and creating an open society. Our achievements
can be divided into two basic groups – domestic and foreign. The
basic domestic achievement is the citizens’ trust in the Institute,
which is testified by the considerable increase of their applications
number and the significance of the raised issues. I also consider
it important that in spite of the opposition of the Azerbaijani
authorities and ombudsman, our Institute was privy to international
cooperation in the human rights sphere. The NKR Ombudsman has been a
member of the European Ombudsman Institute for two years; in May 2010,
the NKR Ombudsman and the human rights delegate of the Transdniestrian
Moldavian Republic signed a cooperation agreement. Also, we cooperate
with the Ombudsmen and other human rights structures of some CIS
states. Besides, we have started the process of joining the trilateral
cooperation agreement between the Transdniestrian Moldavian, Abkhazian,
and South Ossetian Republics. – People apply to your service with
hope and trust. How can you satisfy their applications and when do
you face certain obstacles?

If you have any statistic data, please introduce them briefly. –
I didn’t face any grave obstacles within my activity. Surely, there
were rare cases when the Ombudsman’s proposals were rejected. But,
it wasn’t caused by any confrontation; it was caused by the fact that
our Institute and any other structure have differences in interpreting
the same law regulating legal relations. But, similar cases find their
solution as well. With our corresponding legal support, the citizens
applied to the court and the applicant’s request was always satisfied.

There were also cases when I applied to the state’s leadership,
following the corresponding legal procedure, and the raised issue
got its positive solution. As of the statistic data, within May 20,
2008 and October 6, 2010, 950 citizens submitted 650 applications
to the NKR Ombudsman Office, and the rights of over 200 persons were
rehabilitated. – The Ombudsman Institute is the structure reflecting
the job of the judicial power. The people are surely interested in
your assessment of the independence level of our courts. – I have
repeatedly referred to the activity of the judicial power related
to the citizens’ applications, including complaints about different
judicial levels. The analysis based on the citizens’ complaints is
comprised in the Ombudsman’s 2008 and 2009 annual reports. As of
the courts’ independence, we haven’t received any complaint from
the citizens. In any case, the NKR Constitution and laws provide
the courts’ independence. Along with the legislation improvement,
the recent structural and personnel reforms, as well as those
related to the judges’ financial support let us hope for the actual
independence of the courts. – The Republic’s legal field is still far
from perfection, and the issues of deleting the differences between
the acting laws, bringing the legislation in correspondence with the
Constitution are still pending. And all this, surely, relates to
human rights. – Let me disagree with you in this issue. After the
NKR Constitution adoption, the issue of bringing the acting laws
in correspondence with the state’s Basic Law was raised. I think
this process is quite efficient and successful. The legislative
activity related to human rights and freedoms, proceeding from the
constitutional requirements, can be considered accomplished, and it
can be stated that the rights fully correspond to the international
standards. As of the differences between some laws, they really exist.

It should be noted that improvement of laws is a long process existing
in almost all, especially young and democratic states of the world. –
In the West, Ombudsman is an indisputable authority. You once noted
this fact. What do you think is needed that our society may fully
realize the role of the Ombudsman Institute? – Your question can be
certainly answered in the following way: only time is needed.

Generally, the Ombudsman Institute has decennial and centennial history
in the world. It was formed between the 19th and 20th centuries
in Sweden and later spread in other western states. The national
institutes of the states’ Ombudsmen passed a long and difficult way
of self-affirmation and their today’s high authority is the result
of the decades-long democratic and open society development. It’s
clear that the NKR current status obliges us to develop more
rapidly in any sphere, including strict observance and protection
of human rights, than it is done in Azerbaijan. For achieving the
abovementioned in a short period, we have the most important thing:
the structure’s institutional efficiency is equally in the interest of
the Ombudsman, the state’s top authorities, all the power branches,
and the grass-roots, including the mass media, which is hopefully
testified by this interview. P.S. – While preparing this interview,
we were informed that the NKR first-level court had rehabilitated
the violated right of another citizen.

On October 27, the opposition Armenian National Congress (HAK) led
by the country’s first President Levon Ter-Petrosyan paid tribute to
the victims of the 1999 terrorist attack in Yerablur.

Both the Pantheon and Yerablur were overcrowded today. It reminded
the presentees of the excitement raised during the formation of
“Miasnutyun” (Unity) Alliance.

“The terrorist attack of October 27, 1999, and the post-election
clashes of March 1, 2008, frustrated people’s hopes for positive
changes,” Aram Sargsyan, the brother of slain Vazgen Sargsyan,
told A1+.

Karabakh Committee member Ashot Manucharyan says in 1998-99 Armenia
sharply deviated from the development set in the 88s. “Miasnutyun”
attempted to recover the situation but the parliamentary carnage of
October 27 hindered the swing.

Mr. Manucharyan says the October 27, 1999 events were planned and
organized by outside forces.

“Armenia has become a marionette for foreign countries. This was one of
the main goals of the October 27 attack,” Ashot Manucharyan told A1+.

“I do not know whether the terrorist attack was plotted by inside
or outside forces but it was the antics of the devil,” said Vazgen
Sargsyan’s brother Armen Sargsyan.

Andranik Kocharyan believes that the perpetrators of the terrorist
attack would be revealed on day.

“Our country cannot prosper without the disclosure of October 27.”

Turkey Seeks To Boost Investment In Nakhichevan

BAKU (APA)-Nakhichevan has a ‘special place’ in Turkey’s foreign
policy as a territory that isolates Armenia from the rest of the
region, Turkey’s State Minister for Foreign Trade Zafer Caglavan
said Wednesday speaking at a Turkish-Azeri business forum hosted in
Kahkichevan , the Azeri Press Agency reported.

“Armenia has been stuck between Nakhchivan and the rest of Azerbaijan
with access only to Iran and Turkey,” Caglavan said. “Nakhchivan has
a special place in the foreign policy of our government. That’s why
we are here today.”

The forum attracted influential businessmen from Turkey and Azerbaijan
and presented them with information about Nakhichevan’s history, its
course of economic development, and various business and investment
opportunities in the area.

According to APA, the meeting will end with the signing of a series
of cooperation documents.

Speaking to reporters during the event, Caglayan said Turkish
businessmen have a “serious” interest in making investments into the
Azeri controlled territory. He added that discussions were ongoing
to establish the Nakhchivan-Turkey Business Council.

“We want to establish a council that will help the businessmen. One
should take advantage of bordering Nakhchivan. It would be better to
create free trade zone on the border. It would increase mutual trade,”
said Caglayan. “We can create a region without customs and trade
with every part of the world. I gave necessary instructions. Turkey’s
General Directorate of Free Trade Zones will study the issue. It will
be possible to set up this system without losing time.”

Caglayan said he had already appealed to Nakhichevan’s authorities
to support the endeavor.

Armenia on Tuesday accused Azerbaijani forces of killing an ethnic
Armenian soldier in the breakaway Nagorny Karabakh region in a bid
to disrupt peace talks on the eve of a summit.

Russian President Dmitry Medvedev is to host the summit in the city
of Astrakhan Wednesday with Armenian President Serzh Sarkisian and
Azerbaijani President Ilham Aliyev to push for a resolution to the
longstanding conflict over Karabakh.

Ethnic Armenian separatists backed by Yerevan seized control of
Karabakh from Azerbaijan during a war in the early 1990s that left
an estimated 30,000 dead and the region remains outside Azerbaijani
control.

Armenia’s defence ministry said in a statement that a 20-year-old
soldier with Karabakh’s defence forces had been killed Tuesday after
Azerbaijani forces opened fire along a ceasefire line.

“The defence ministry of Armenia strongly condemns another step by
Azerbaijan aimed at destabilising the situation before the meeting
of the presidents of Armenia, Azerbaijan and Russia,” the ministry
said in a statement.

“All responsibility for such provocations lies with the Azerbaijani
side,” the ministry said.

Tensions over Karabakh have been increasing this year amid stalled
peace talks, with the number of deadly skirmishes along the ceasefire
line on the rise for months.

At least 20 soldiers on both sides have been reported killed in
clashes this year, including eight soldiers killed last month alone.

Armenian and Azerbaijani forces are spread along a ceasefire line in
and around Nagorny Karabakh, often facing each other at close range,
and shootings are common.

Computer Virus "Mastermind" Arrested In Armenia: Netherlands

Dutch authorities announced Tuesday the arrest in Armenia of the
alleged mastermind behind a computer virus crime group whose server
network was dismantled in the Netherlands a day earlier.

“At the request of the national (Dutch) prosecution service, a
27-year-old Armenian believed to be the brains behind the notorious
Bredolab network, was arrested at the Yerevan international airport
last night,” the prosecution service said in a statement in The Hague.

Investigators said they dismantled a criminal network on Monday that
had used computer servers in the Netherlands to infect at least 30
million computers worldwide with a virus that allows others to obtain
information like bank passwords from infected computers.

The network was capable of infecting three million computers a month
and was sending an estimated 3.6 billion virus e-mails to users daily
by the end of 2009.

A total of 143 computer servers were disconnected in the Netherlands
on Monday, the prosecuting service said.

Since the Netherlands have no extradition agreement with Armenia,
“we are discussing the possibility of the suspect being put on trial
there”, prosecution spokesman Wim de Bruin told AFP.

An ageing American hippie known as “Eight Finger Eddie” who was famous
across India’s resort state of Goa as a relic of its drug-fuelled,
drop-out culture of the 1960s has died.

The 85-year-old, whose real name was Yertward Mazamanian, died in
the former Portuguese colony after a long illness on October 18,
according to online tribute web sites.

His cremation was streamed live on the user-generated content site
The video showed his body covered in flowers and
burning incense sticks, next to a black and white photograph of him
from the early 1970s.

One post on a Facebook site tribute page read: “He more than anyone
put Goa on the Map”. Others called him “the original freak”.

“Anjuna Beach has lost its Goa Hippy Tribe father!” said another. “All
of us over the decades who have shared precious moments with Eddie
will miss his smile, his energy, his love for Life and Dance.”

“Eight Finger Eddie” was a US expat of Armenian heritage who came to
Anjuna Beach in 1965 at the age of 40 and never left.

The secluded sands of north Goa became the sun-kissed final destination
for the beatniks and drop-outs on the Hippie Trail from Western Europe
to Asia.

With a culture based on drugs, free love and music, the hippies
found the beach a haven but it has since become overcrowded, with a
reputation for drug- and alcohol-fuelled excess and crime, as foreign
tourism has increased.

Eddie began the popular Anjuna flea market in 1975, originally as a
place for tourists to sell or exchange their belongings.

The open-air bazaar still exists but is mainly a place for tie-dyed
clothing, ornaments and sometimes stolen goods.

He also ran a soup kitchen for foreign visitors who had lost their way,
money — or occasionally their minds.

London, 26 October: Turkey’s ambassador in London has rejected a
European perception that his country’s relations with countries to
the East posed a threat for the West.

“If Turkey’s vision on the East is seen as a threat for the West,
then this is called purblindness. If the European Union wants to be a
global power, it definitely needs Turkey’s partnership,” Unal Cevikoz
told reporters when responding to questions in a London conference
on Turkey-Azerbaijan relations.

Cevikoz said the EU should develop an understanding that Turkey’s
growing relations with its neighbours in the region was an asset for
the EU itself.

Cevikoz also rejected claims that Turkey’s course of foreign policy
shifted to the East from its traditional Western orientations, saying
Turkey aimed at establishing a “zero-problem neighbourhood policy”.

Touching on Turkey’s EU prospects, Cevikoz said the Cyprus issue
was one of the obstacles against Turkey’s accession, adding that the
union “made a huge mistake by saying ‘yes’ to the EU membership of
the Greek Cypriot side, which said ‘no’ to the Annan Plan in 2004”.

“However, Turkey should pursue the EU goal with more determination. We
have embarked on this journey 47 years ago and we can wait for a few
more years,” he said.

On Turkey’s relations with Armenia, Cevikoz said Turkey’s efforts
for the normalization process with Armenia had aimed at adding a new
momentum to talks over the Karabakh issue, as well as maintaining
a regular and sustainable course of relationship between Ankara
and Yerevan.

“Turkey’s efforts for normalization with Armenia should be considered
within this framework. Nothing can negatively affect the brotherhood
and understanding between Turkey and Azerbaijan,” Cevikoz said.

Nakhichevan, 26 October: Turkey will not open its border and develop
commercial relations with Armenia unless a solution to Karabakh problem
is found, Turkey’s foreign trade minister said on Tuesday [26 October].

Zafer Caglayan, who is in Nakhichevan for talks, said that Nakhichevan
was really important for both Azerbaijan and Turkey.

“That’s why we have to develop Nakhichevan,” Caglayan said. “We will
do it by the help of trade. We will sign deals. The size of our trade
with Azerbaijan is around 2bn dollars but this is not enough. We have
to make it 5bn dollars.”

On opening of Turkey’s border with Armenia, Caglayan said, “Our
commercial relations cannot develop and the border cannot open unless
the Karabakh problem is resolved. Our president and prime minister
have made it clear. And now, I am repeating it here. We will neither
do business with Armenia nor open the border unless Armenians withdraw
from the territory they occupied.”

Turkey shut down its border and cut off diplomatic ties with Armenia
in 1993, after Armenian army forces occupied Azerbaijan’s Karabakh
region. Turkey and Armenia signed two protocols in October 2009 to
normalize relations, reopen their border and restore diplomatic ties.

However, protocols have yet to be ratified by both parties.

Trial Of Armenian Journalist’s Suspected Killer In Turkey Monitored

TRIAL OF ARMENIAN JOURNALIST’S SUSPECTED KILLER IN TURKEY MONITORED CLOSELY BY EU

The trial of Ogun Samast, the main suspect in the murder of journalist
Hrant Dink, is now to be transferred to a juvenile court. Yesterday,
an Istanbul court ruled that Samast was under the age of 18 at the
time of the murder. Dink, a Turkish journalist of Armenian descent,
was the editor of the weekly Armenian and Turkish publicationAgos.

According to his colleagues and family, he was murdered for his
criticism of the government and calls to look into the killings of
1.5 million Armenians in Ottoman Turkey during 1915-17, something the
Turkish government continues to deny. He was murdered in front of
the newspaper’s headquarters in Istanbul in January 2007. However,
lawyers and Dink supporters argue that hearing the evidence in a
juvenile court fails to address the full scope of the case. Despite
the seriousness of the crime, the Istanbul court ruled unanimously
to transfer the case under the recently adopted law number 6008 on
minors’ legal status in adult courts. Samast will now be tried at
the Istanbul Sultanahmet Juvenile Court.

Significance:Nearly four years have passed since Dink’s murder in
January 2007, and the case still appears no closer to resolution.

Dink’s family lawyers have alleged that some of the evidence has been
covered up in the intervening period. The 14 September 2010 European
Court of Human Rights (ECHR) decision on Dink’s murder found the
Turkish state guilty of failing to protect Dink’s right to life,
freedom of expression, and right to due legal process in the murder
investigation. Nonetheless, the state officials who were allegedly
negligent in failing to protect Dink will not be included in the new
court setting. Dink’s lawyers argue that officials, from the police
and gendarmerie to governors, had been warned of threats on Dink’s life
before the time of his murder. They have also pointed to the decision
of the ECHR and argued that the Turkish government has blocked attempts
at more thorough investigations into the murder. The case is being
monitored closely by representatives from a number of European Union
(EU) law associations, as well as the ECHR. It is an important test
for the Turkish judiciary, which saw a raft of changes introduced by
the September 2010 constitutional referendum. The trial will also
have a wider implication for Turkey’s image in the European bloc,
which the country is keen to join as a full member. Freedom of speech
is an area in which the Turkish government has to improve dramatically
and bring up to EU standards, something that the current Justice and
Development Party government has pledged to do. Dink’s case will be
a great opportunity for the Turkish political establishment to prove
its commitment to those reform plans.
