Mihran Poghosyan is said to be cause of minister’s firing

Rouben Grdzelyan, spokesman for the Judicial Acts Compulsory
Enforcement Service (CES), has told Hetq that he had only heard about
the directive of now former Minister of Justice Gevorg Danielyan to
discipline CES head Mihran Poghosyan by visiting the website.

Mr. Grdzelyan also said he had no idea what violations had been
committed by Poghosyan that ultimately lead to the firing of
Danielyan. (The minister was fired today on charges of official
negligence; i.e. he failed to discipline Poghosyan as directed.)

Our sources at the CES say that Poghosyan showed up at work today
feeling out of sorts and left after a few hours.

The Ministry of Justice website will face disciplinary sanctions.

Ashot Yeghiazaryan to maintain his mandate

Russian State Duma’s committee on ethics and mandates has rejected the
claim on stripping MP Ashot Yeghiazaryan off his mandate.

The committee also ruled that Yeghaizaryan will continue receiving his
monthly salary of 160,000 Russian roubles, Russian newspaper Vedomosti
reported.

The argument behind such decision was that a parliamentarian’s
activity is regulated by the Labor Code, hence sacking a member of
parliament or depriving him/her of salary could be possible only after
changing the law on the status of parliamentarians.
Igor Lebedev of the Liberal-Democratic party said Yeghiazaryan was
ready to return to Russia provided the law enforcement agencies
guarantee his and his family’s security. He also said that the MP does
not avoid criminal liability as the case against him was fabricated.

Earlier, Alexander Khinshteyn of Edinaya Rossia party requested the
committee to consider the salary clause, claiming that Yeghiazaryan
was abroad for several months and didn’t attend the parliament
sessions.

On November 3, the State Duma passed a decision on stripping
Yeghiazaryan off his mandate. Later a criminal case was filed against
him under Section 4, Article 159 of the Russian Criminal Code
(swindling at large scales). If convicted, Yeghiazaryan may face
imprisonment for up to 10 years.

Police are currently investigating a burglary that took place sometime
last night at the St. Gayaneh Church in the town of Etchmiadzin.

Initial reports say that the robbers broke the church door and then
removed two church donation boxes from inside. Father Vahram Melikyan,
a press spokesman for the Holy See, confirmed that a robbery has taken
place and that police are conducting an investigation.

While inaugurating the hall today Ameriabank’s CEO Artak Hanesyan said
that premium customers will be provided with Ameria Premiums cards as
a key to the services of the Ameria Premium hall. The card will also
allow them to use discounts.

In the hall VIP customers will be able to make deals and negotiate and
will be able to receive high quality services at any time and even in
their offices.

Hanesyan said that premium customers should comply with specific
criteria and should be loyal to the bank. The bank will show
individual approach to them. As of today Ameriabank has almost 220
customers that can be qualified as premium.

Retail Banking Manager of Ameriabank Vazrik Sekoyan said that premium
customers will enjoy preferential quality and time conditions.

The majority shareholder of Ameriabank is TDA Holdings Limited,
affiliate of Troika Dialog.

On 8 December President of the Artsakh Republic Bako Sahakyan signed a
decree on the results of considering pardon applications.

According to the Presidential decree 20 convicts were granted pardon.
Twenty two individuals were granted partial pardon.

Pardon applications of 103 convicts were turned down due to the
previously committed crimes, negative characteristics from places of
imprisonment, nature and gravity of the committed crimes.

COMPLICATIONS IN ASTANA AND AT HOME

The long-awaited summit of the heads of OSCE states took place in
Astana on December 1-2. As we had expected, the summit did not bring
any breakthrough decisions on the Nagorno Karabakh conflict
settlement.

In the run-up to the summit, there was unprecedented diplomatic
activity over the negotiating process, the documents and the
obligations of the sides.

On the one hand, that activity was promoted by the Russian foreign
ministry headed by Sergei Lavrov. According to official information,
Moscow apparently made much effort to prepare for the signing of the
document which was to become a breakthrough in the conflict settlement
process. Evidently, the mission of Secretary-General of the Collective
Security Treaty Organization (CSTO) Nikolay Bordyuzha in Yerevan (that
mission was unprecedented by its duration – 4 days!) as well as the
visit that the head of the Russian presidential administration Sergei
Naryshkin paid to Yerevan – the mission and the visit took place ahead
of the Astana summit – aimed to back the efforts of the Russian
foreign minister. The penultimate period in that process was
apparently to be put on November 27 during the announced meeting of
the foreign ministers of Azerbaijan and Armenia, again through the
mediation of Lavrov.

However, the mission of N. Bordyuzha and S. Naryshkin was not
crowned with success, and the meeting in Astrakhan did not take place
or was torpedoed by skilful actions of the American side.

In Astana, everything went in quite a rapid and uninteresting
way. The five-party statement on Nagorno Karabakh was already signed
at the beginning of the first day of the summit activities. The
statement was signed by the presidents of Azerbaijan, Armenia, and
Russia, the French Prime minister, and U.S. secretary of state. To all
appearances, the text of the document was coordinated in detail
beforehand and, as far as we know, Russian President Dmitry Medvedev
was the last one of the mentioned `five parties’ to sign it.

Russia failed to bring its mediation up to the necessary mark,
although over the past two years it managed to organize 7 presidential
meetings and the signing of two declarative documents (in Moscow in
2008 and in Astrakhan in 2010). Thus, on the whole, we believe that
this diplomatic round was won by the West, first of all by the United
States.

Below is what follows from the Astana statement, that in many
respects reiterates the provisions of the document signed by the
presidents of Russia, the U.S. and France in Canada in the summer of
2010.

Yerevan in the person of President Serzh Sargsyan declaratively
agrees:

– to represent Nagorno Karabakh at the negotiations and therefore
it does not give up the policy of R. Kocharian who consented to
Stepanakert’s isolation from the participation in the
negotiating process – despite the fact that by a 1994 decision
of the OSCE, Nagorno Karabakh can participate as a fully-fledged
party in the negotiating process conducted within the framework
of the OSCE Minsk Group,

– that the Nagorno Karabakh conflict should be resolved de jure
within the framework of Azerbaijan’s territorial integrity,

– to the withdrawal of Armenian military units from
Armenian-controlled regions of the `security zone’ outside the
boundaries of the former Nagorno Karabakh Autonomous Region of
Azerbaijani SSR,

– that there is no clarity over issues of lifting the blockade of
Armenia and Nagorno Karabakh,

– to the use of the term `occupied territories’ when the matter
concerns the regions of the `security zone’,

– that the term `land corridor’ linking Armenia and Nagorno
Karabakh can be used instead of the previously used term `Lachin
corridor’.

Baku in the person of President Ilham Aliyev declaratively
agrees:

– that the term `self-determination’ can be used for determining
the status of Nagorno Karabakh,

– that the procedure of `will expression’ shall be held in
determining the status.

Both sides also formally agreed that the conflict should be
resolved only by peaceful means, that is, without use of force or
threats to use force.

Yet the undisguised unwillingness of the mediators to implement
the agreement on strengthening the ceasefire regime in the Nagorno
Karabakh conflict zone which was signed in 1995 under the aegis of
OSCE also hinders the conflict settlement and the domination of
the principle of non-use of force. In this context the threat of a
resumption of hostilities in the Nagorno Karabakh conflict zone
remains quite considerable. Unfortunately, the Astana summit did
not produce any positive changes in that important direction. It
gave another thing instead: the formal consent of the major
external players to prolongation of the frozen situation in the
conflict zones in the territory of the OSCE, including Nagorno
Karabakh.

The response of Yerevan and Stepanakert to the outcome of the
Astana summit was rather lukewarm. In both Armenian capital cities,
the `parties in power’ presented the five-party statement as a
document which is, on the whole, advantageous to the Armenian side.
Most likely, a thorough analysis of what happened is still to be made.

The step-down of the Yerevan Mayor Gagik Beglarian and then the
resignation of Justice Minister Gevorg Danielian proved much more
sensational for the president.

A good deal of information points to the gross exaggeration of
several facts relating to the incident which occurred between the
mayor’s wife and the presidential administration official Aram
Kandayan during the December 3 concert of Placido Domingo. The same is
true concerning the facts relating to the subsequent showdown between
mayor Beglarian himself and Kandayan. Particularly, to all appearances,
Beglarian did not kidnap Kandayan, nor did he beat him up at Metax
Plant. Nevertheless, following the `news leak’ from the presidential
residence and the formation of the relevant public moods, Beglarian
had to hand in his resignation, while after a meeting of party
activists of the Republican Party of Armenia, the press reported that
criminal proceedings had been brought against the already ex-mayor of
Yerevan.

Based on the press reports, we present the current situation in
the following way: most probably, the Armenian presidential
administration’s members supporting the pro-Western political
orientation have convinced the president of the necessity to take some
steps in order to give the current regime a more acceptable and
presentable appearance before Washington and Brussels. For this
purpose, it would be a good thing to remove a familiar figure (or two
figures) from the political and, perhaps, business arenas – to remove
those who, to put it mildly, do not enjoy popularity of the public.
They chose the Yerevan mayor who, to be quite frank, did not always
consider the `recommendations’ and demands of high-ranking officials
of the presidential administration when carrying out his
administrative and business activities. Then the appropriate pretext
was used, and the `talking heads’ on television and officials of
various levels began to speak about the inadmissibility of `such a
conduct’ and the non-fulfillment of the requirements of `government
ethics’.

The desired effect seems to have been achieved and such a powerful
man in the system of the `party in power’ as Beglarian was removed
from his position. This is a signal that the authorities may start
processes which will lead to the change of some characters and sets in
Armenia’s political arena, but they will by no means change the
essence of the regime of the president Serzh Sargsyan. Most likely, in
conducting its foreign policy, the regime will become much more
pointedly oriented towards Washington and Brussels. In our opinion,
this is the main outcome of the resignations of the Yerevan mayor and
the Armenian minister of Justice.

La majorité gouvernementale au Parlement arménien s’est abstenue jeudi
au cours d’un vote pour reconnaître l’indépendance du Nagorny
Karabakh, république séparatiste pro-arménienne d’Azerbaïdjan, faisant
ainsi échouer cette proposition et provoquant la colère de
l’opposition.

“C’est une erreur de la part de la coalition gouvernementale de même
refuser de discuter de la reconnaissance du Karabakh”, a déclaré
Larissa Alaverdian du parti d’opposition Héritage.

Seuls treize représentants de Héritage et du parti nationaliste
Dachnaktsoutioun, sur un total de 131 députés, ont voté en faveur de
la reconnaissance de ce territoire.

L’Arménie soutient financièrement et militairement le Nagorny
Karabakh, province azerbaïdjanaise peuplée majoritairement
d’Arméniens, depuis la victoire des séparatistes lors d’une guerre qui
a fait 30.000 morts et des centaines de milliers de réfugiés entre
1988 et 1994.

Erevan n’a cependant jamais reconnu l’indépendance du Karabakh, une
décision qui risquerait de provoquer un nouveau conflit avec
l’Azerbaïdjan.

Edouard Charmazanov, porte-parole du Parti républicain
(pro-gouvernemental) a jugé que le moment n’était pas “approprié” pour
un tel vote alors que des négociations de paix se poursuivent.

“Le processus de négociations serait dans l’impasse si le projet de
l’opposition était approuvé”, a-t-il dit.

Début décembre, le président arménien Serge Sarkissian a déclaré que
son pays allait reconnaître l’indépendance du Karabakh “si
l’Azerbaïdjan lançait une agression militaire”.

SAN FRANCISCO – A federal appeals court has reversed itself and now says
the heirs of Armenians killed in the Turkish Ottoman Empire can seek
payment from companies that sold their dead relatives life insurance.
In a rare and stunning move, the 9 U.S. Circuit Court of Appeals in
San Francisco on Friday changed its decision in the case.

At issue is a hotly debated law passed by the California Legislature
in 2000 that labeled the killings nearly a century ago a “genocide.”
That characterization is fiercely rejected by Turkey.

Last year, the 9th Circuit invalidated the law as an improper conflict
with U.S. foreign policy.

But in its reversal, the court said there is no conflict because the
federal government does not have a clear policy regarding the mass
killings of Armenians during the Turkish Ottoman Empire’s reign.

Le Parlement arménien a approuvé jeudi le budget du pays pour 2011,
qui table sur une croissance à 4,6%, poursuivant ainsi une reprise
modeste après une année noire en 2009 à la suite de la crise
économique et financière mondiale.

L’Arménie, qui a vu en 2009 son économie se contracter de 14,4%, a
connu un retour à la croissance en 2010. Selon le ministère arménien
des Finances, une croissance de 3,1% a été enregistrée sur les huit
premiers mois de l’année.

Pour 2011, le budget prévoit des recettes de 2,37 milliards de dollars
(1,79 milliards d’euros) et des dépenses de 2,78 milliards de dollars
(2,10 milliards d’euros). L’inflation est prévue à environ 4%.

L’Arménie a été l’un des pays les plus touchés par la crise
économique, notamment en raison de la chute des envois de fonds de sa
diaspora et d’une baisse des entrées de capitaux étrangers.

L’impact de la crise a néanmoins été atténué grâce à des prêts
internationaux, notamment celui du Fonds monétaire international
(FMI), qui a annoncé fin juin l’octroi d’un crédit de 394,8 millions
de dollars sur trois ans à l’Arménie.

«On n’a rien contre les Arméniens mais ce mémorial, on n’en veut pas Ã
côté de la tour de la Charité, symbole du grand passé hospitalier
lyonnais ». Depuis le début de l’affaire en 2005, la position de
l’association de défense et de protection des places Bellecour et
Antonin-Poncet n’a pas bougé d’un pouce. Cinq ans que ses adhérents,
menés aujourd’hui par Chantal Lefort, se battent pour retrouver leur
place dans son état d’origine. Cinq ans qu’un bras de fer l’oppose Ã
la communauté urbaine de Lyon. En l’installant le 24 avril 2006 au
cÅ`ur de Lyon, le maire Gérard Collomb avait voulu affirmer « le combat
universel pour la mémoire et la vérité de l’Histoire, comme élément
constitutif de l’identité même de notre ville », comme il l’a répété
dans son discours du 24 avril 2009. Une nouvelle manche de ce bras de
fer entre les opposants et la communauté urbaine s’est donc jouée hier
matin à la cour administrative d’appel de Lyon. Dans son jugement du 3
avril 2008, le tribunal avait annulé les deux arrêtés pris par Gérard
Collomb autorisant l’association du mémorial à occuper le domaine
public. Le Grand Lyon avait fait appel de cette décision, appel qui
était examiné hier. A la surprise des opposants au mémorial, le
rapporteur public n’a pas fait mention du défaut de permis de
construire, sur lequel la défense s’était basée lors de la première
audience. Pour le rapporteur public, si la place Antonin-Poncet
appartient bien au domaine public communautaire, elle ne dépend pas de
sa voirie. Il considère que le vice-président à la voirie qui a signé
l’arrêté, n’avait donc pas compétence pour le faire. Par conséquent,
il rejette la requête du Grand Lyon. Satisfaction de M e Vincienne,
l’avocat des opposants : «Si l’occupation de la place est jugée
illégale, le mémorial devrait être démonté ». Arrêt rendu fin
décembre.
