The due announcement was made by Kazakhstan’s ambassador to Azerbaijan
Serik Primbetov.

Touching upon Kazakhstan’s demonstration of neutral position on the
resolution, adopted by the UN General Assembly, the ambassador noted
that despite that, our friendly relations between the two countries
will always exist-this is a priority and they are more important than
any resolutions.

"Kazakhstan has repeatedly taken part in the missions on the peaceful
resolution of the said problem and I think the world community will
find the way out of this situation", Primbetov said.

He noted that Kazakhstan is for the friendly relations both with
Azerbaijan and Armenia.

"I will do everything possible for strengthening friendly relations
between our peoples", the Kazakh ambassador said.

Armenia’s parliament at an extraordinary session has started discussing
a bill amending the law "On holding meetings, rallies, marches, and
demonstrations." According to parliament speaker Tigran Torosyan, the
bill has been introduced by four parliamentary factions. Speaking as a
lead speaker, member of the ruling Republican Party Rafik Petrosyan
stated that the amendments are necessary in order to "learn the
lessons of the past." In his words, the recent events have shown that
"life is much richer than the legislation field."

The amendments, in particular, provide that a responsible body,
the mayor’s office, in particular, can decline a request to hold a
rally if it has reliable information on the public action’s aiming
to overthrow a constitutional order, inciting racial, national,
or religious hatred, propagating violence and war, or endangering
national security, public order, morality and health of the people, and
infringing on constitutional rights and freedoms of other individuals.

Another amendment provides that official findings of the police
and National Security Service can be sources of such reliable
information. The same agencies are supposed to have a right to decide
on annulment of such grounds. The amendments also provide that, in
cases when mass public actions transform into mass riots, leading to
deaths of people, a responsible agency can temporarily ban holding
mass public events, until all circumstances and persons involved in
the crimes are established.

The amendments also stipulate that a responsible agency examine a
request for holding a public event for 72 hours. Requests are to be
submitted 5 days prior to the date of holding a public event.

ARF Dashnaktsutiun faction member Vahan Hovannisyan has suggested that
part 2 (temporary ban to hold public events) is amended so that it
is applied not to everybody but to those who have already committed
crimes. The lead speaker argued that "this is done to ensure that
everyone has equal rights before the law."

Member of opposition Heritage faction Zaruyi Postanjan remarked that,
if police agencies and NSS do actually possess information on events’
aiming at overthrowing a constitutional order, they should not give
an official conclusion, based on which a responsible agency will
ban a public action, but initiate criminal proceedings, since these
actions fall under criminally prosecuted activity.

If passed, the bill will be enacted five days after its official
publication.

The Constitutional Court will decide within 10 days whether to take
up a request from a state prosecutor to shut down the ruling Justice
and Development Party (AK Party), one of the court’s 11 judges said
on Monday.

A state prosecutor on Friday filed a motion with the Constitutional
Court, the highest court in the country, seeking to close the party due
to alleged anti-secular activities. The prosecutor who filed the case,
Supreme Court of Appeals Chief Prosecutor Abdurrahman Yalcýnkaya, also
demanded that 71 party members, including Prime Minister Recep Tayyip
Erdoðan and President Abdullah Gul (who served as foreign minister in
the previous AK Party Cabinet), be banned from politics for five years.

The AK Party, at a press conference held on short notice on Friday
night, called the suit "an attack on Turkish democracy and the
Turkish people." Deputy Chairman of the AK Party Dengir Mir Mehmet
Fýrat termed it "the worst injustice against our country’s interests,
peace and stability as well as its reputation in the world."

The indictment has raised the prospect of prolonged political turmoil
in Turkey and has rattled financial markets already badly jolted
by the global credit crunch and fears of a deep recession in the
United States.

The Constitutional Court is now in the process of naming a rapporteur
for the case. The first investigation will not take more than 10 days,
Osman Paksut, deputy chief justice and spokesman for the court, told
reporters yesterday. He also advised reporters not to wait in front
of the court expecting a major story to emerge every hour.

According to Paksut, the first investigation will establish whether
the dossier is correctly formatted so that the Constitutional Court
can examine its contents. When the court has agreed to examine the
case, it will have to determine whether the accusations themselves
are sufficiently serious and plausible to be investigated. If it does,
the AK Party will then have to provide arguments in its own defense.

A final verdict could take many months.

Erdoðan, who was barred from politics once before for reciting a poem
deemed too Islamist by Turkish authorities, has vowed to fight the
lawsuit, calling it an attack upon democracy.

Supreme Court of Appeals responds

A myriad of protests and statements of condemnation have been made by
politicians, civil society groups, foreign diplomats and academics
in Turkey since the prosecutor filed his case against the governing
party on Friday. Supreme Court of Appeals’ President Hasan Gerceker
told critics in a statement made on Monday "not to push the boundaries
of criticism too hard."

In the written statement, released in the afternoon, he said,
"The evaluation and the final decision on this issue lie with the
Constitution Court."

"The boundaries of criticism should not be pushed too far, and making
or writing comments, articles and news that fall slightly short of
insult should be avoided. The duty of the media is to inform the
society without crossing legal or ethical boundaries. We believe the
Turkish press will show the utmost care in this issue."

Turkish newspapers have speculated that the AK Party, which has
presided over strong economic growth and political reforms since
taking power in 2002, could ask opposition parties to help push
through constitutional changes to thwart the prosecutors.

A serious allegation against the prosecutor came yesterday from Culture
and Tourism Minister Erturðrul Gunay, who said in remarks to news
channel NTV that the case was launched with the purpose of covering
up an incident known to the public as Ergenekon — a gang suspected
of serious crimes, including the assassination of ethnic Armenian
journalist Hrant Dink, in hopes of creating chaos and preparing the
groundwork in Turkey for a military takeover.

Ergenekon’s plans were unearthed in a police operation a few months
ago. Noting that the investigation into the gang members was ongoing,
Gunay said: "Things were forced to develop in such a way that I think
that perhaps Mr. Chief Prosecutor was led to act in this way. True,
the people always make the ultimate decision on every particular
subject, but there is a milieu that they are part of that leads to
a particular decision."

Meanwhile, the Monday edition of daily Taraf asked its readers to
file complaints against Yalcýnkaya for "abusing his authority." In a
sample petition the daily argued that the evidence in the indictment
was entirely unsubstantiated, given that some of the accusations were
based on cases already dealt with at different courts.

A coup d’etat from neo-nationalists

Ahmet Gundul, a retired Supreme Court of Appeals prosecutor, shared
his opinions on Yalcýnkaya’s indictment with the press yesterday,
saying it was "thought provoking" that such charges were being
pressed against the AK Party for no apparent reason. He said he
believed the primary purpose was to wear the government out and
damage Turkey’s European Union process. "Backstage, behind this case,
there are segments calling themselves neo-nationalists. This [case]
is a neo-nationalist attempt to overthrow the government."

He said it was wrong to interpret the case’s repercussions in "legal"
terms alone, underlining that the case was mostly political.

"Everyone who believes in democracy, whether they voted for the AK
Party or not, should show their reaction in the strongest way."

Members of judiciary, politicians continue to protest

Legal professionals continue to protest the attempt to prosecute the
AK Party over alleged anti-secular activities. Ayhan Cabuk, head of
the Van Bar Association, said yesterday that the Constitutional Court
had to reject the indictment because it sought to try the president,
who under Turkish law can only be tried on charges of treason. Cabuk
also said that the evidence presented by the prosecutor was not nearly
sufficient to close a party down.

The Republican People’s Party (CHP) has not as a party openly protested
the attempt to shut down the AK Party. Its leader has not commented
so far, while one of its deputy chairmen, Hakký Suha Okay, said:
"We wouldn’t like for a party to be shut down. But some parties are
taking their revenge on the revolution of enlightenment," referring
to the introduction of Turkey’s secular system.

CHP Deputy Chairman Mustafa Ozyurek said in response to Nationalist
Movement Party (MHP) leader Devlet Bahceli’s proposal to act quickly
and change the Constitution to protect political parties from closure
that "there is currently an ongoing judicial process that was launched
in accordance with the current law." He said trying to change the
current rules of the game would not be right in a state where the
rule of law prevailed.

News reports announced yesterday, however, that CHP leader Deniz Baykal
would speak on the issue for the first time on private news channel
Star TV Monday night in an interview with news anchor Uður Dundar.

Head of the Grand Unity Party (BBP) Muhsin Yazýcýoðlu said in a
statement made to the press on the closure case on Monday that the
Constitutional Court should reject the indictment from the outset.

Businessmen’s associations from across the country continued to issue
statements condemning Yalcýnkaya’s indictment. Southeastern Young
Businessmen’s Association head Abdulkadir Akboz said, "We don’t think
that an attempt to shut down a party in a country that calls itself
a democracy is right."

Batman Chamber of Commerce head Mehmet Teymur remarked that the case
was "very unfortunate," adding: "Nobody would have expected this.

Everybody is pleased with the government. Stability has been
established, the economy is on a good track. It is not right to close
down a party in a democracy."

Erzurum Chamber of Trade and Commerce Chairman Muammer Cindilli said,
"You won’t be doing something right if you are repeating an earlier
mistake knowing that you will get the exact same results as before."

The Van Chamber of Trade and Commerce, the Diyarbakýr Entrepreneurs
and Businessmen’s Association (DÝGÝAD), the Diyarbakýr branch of
the Legal Research Center (HUDER), the Diyarbakýr Bar Association
and academics from Dicle University also released statements in
condemnation of what they viewed as an anti-democratic attempt to
shut down the governing party.

In Elazýð province, Anatolia Alevi Bektashi Culture Promotion
Association President Ali Coban said the case aimed to harm peace in
the country. Saying that the AK Party was elected by the people, Coban
asserted that to ensure a bright future for Turkey, the party should
not be closed down. "I believe that Turkey will eventually overcome
all of these [obstacles] and that bright days will arrive," Coban said.

YP Northern California "Winter Gala Weekend" Attracts Hundreds, Raises
$5,000 for AGBU Hye Geen Women’s Centers in Armenia

Over 200 Armenian young professionals from around the globe gathered in
San Francisco for the 9th Winter Gala Getaway Weekend on February 15,
2008. The annual affair, organized by AGBU Young Professionals of
Northern California (YPNC), raised $5,000 for the AGBU Hye Geen Pregnant
Women’s Centers in Armenia.

Beginning with a sold-out Friday night mixer at the downtown Element
nightclub with DJ Raffy, the Winter Gala is an opportunity for friends,
new and old, to network with fellow professionals of Armenian descent in
a friendly social setting.

On Saturday, most guests enjoyed San Francisco’s eclectic landmarks and
basked in the sunny weather. Some young professionals planned a daytrip
to Napa Valley to experience the West Coast’s world-renowned wine
region.

After a day of relaxation and exploration, guests headed down to the
city’s Financial District for the Winter Gala Dance at the Merchant
Exchange. Against the backdrop of the San Francisco skyline, Father
Mesrob Sarafian of St. Vartan Armenian Church said a blessing before
dinner, which was followed by a warm welcome from Gala Chairman Emily
Kluczynski.

"The Winter Gala is, hands down, the most incredible Armenian event I
have ever attended," she said. "It brings Armenians from around the
world together for an amazing weekend and unites them under a shared
purpose – support of an Armenian cause."

Back by popular request, Khatchig Jingirian and his band kept the dance
floor full all night. The party continued with a post-dance event at the
trendy SOMO loft. Weekend festivities officially concluded with a
private brunch at Anzu restaurant in the Hotel Nikko on Sunday morning.

"There is real joy in bringing Armenians together in our gorgeous city
for a really great cause," exclaimed Gala committee member, Alison
Ekizian. "It’s exciting to draw our community together and twice as
rewarding to do it in the spirit of philanthropy."

Proceeds from this year’s Winter Gala benefited the AGBU Hye Geen
Pregnant Women’s Centers in Armenia. With the goal of improving the
health of expecting mothers and reducing the alarming rates of pregnancy
complications in Armenia, AGBU Hye Geen established their first Pregnant
Women Project in the country’s second largest city, Gyumri, in June
2002, and a second center in Vanadzor was established four years later.
Since then, participating women have benefited from substantial
pre-natal care and vital medical exams, while also creating a unique and
strong bond among each other.

Eastern Region Anti-Genocide Activists Visit Hundreds of
Congressional Offices During Advocacy Days in Washington, DC

–ANCA and GI-Net Team up for Second "End the Cycle of Genocide"
Grassroots Lobbying Campaign

Washington, DC- Over 100 anti-genocide activists from across the
nation joined the Armenian National Committee of America (ANCA) and
the Genocide Intervention Network (Gi-Net) for their second annual
"End the Cycle of Genocide" campaign held in Washington, DC from
March 12-14th.

The three day program, hosted for the second year in a row by the
ANCA and the GI-Net, puts community human rights advocates directly
in touch with dozens of legislators and every single Senate and
House office in support of practical legislative initiatives to
stop the genocide in Darfur and end Turkey’s ongoing denial of the
Armenian Genocide.

"It was so wonderful to participate with the Genocide Intervention
Network once again this month to advocate on these important human
rights issues," commented ANCA Eastern Region Executive Director,
Karine Birazian. "It was exciting to see new and familiar faces
throughout the region participate. We will continue to work to
build momentum and push genocide legislation forward in Congress."

Birazian, along with activists from the Eastern Region, spent three
days on Capitol Hill meeting with various members of Congress as
well as distributing informational folders on the Armenian Genocide
and the genocide taking place in Darfur, and highlighting
legislation pertaining to these matters. Eastern Region activists
including those from Georgia, Illinois, Maryland, Massachusetts,
New Jersey, New York, Pennsylvania, Rhode Island, Tennessee, and
Virginia visited close to 300 offices in the House of
Representatives and over 60 offices in the Senate.

First time participants of the "End the Cycle of Genocide" Advocacy
Days included several youth activists and professionals. Arin
Vartanian, an Armenian Youth Federation (AYF) member from the New
Jersey Arsen Chapter commented: "Participating in this past week’s
Advocacy Days has definitely left me with a greater understanding
of what it means to fight for genocide recognition. After making
countless phone calls to my senators and representatives over the
years, it was unbelievable to have the opportunity to speak to my
congressmen in person rather than over a receiver. Lobbying on
Capitol Hill with the ANCA, GI-Net, and my fellow AYF members was
an amazing and unforgettable experience and I would like to
participate again." Vartanian, a constituent of Cong. Gary
Ackerman (D-NY-5) also had a chance to meet with the office to
thank the Congressman for his support on human rights issues and
his leadership during the October 10, 2007 markup of H. Res. 106,
the Armenian Genocide Resolution, in the House Foreign Affairs
Committee.

Eastern Region activists met with over 50 congressional offices,
including Members of the House Committees on Foreign Affairs,
Intelligence, and Homeland Security many of whom are cosponsors of
H. Res. 106.

Those in attendance took part in a reception on Wednesday evening
during which several representatives spoke out on this important
issue and stressed the need to continue to lobby and push forward
for genocide recognition. At the close of the Advocacy Days,
activists were invited to tour the United States Holocaust Memorial
Museum in Washington, DC.

agreements on construction of an enterprise worth 1.7 million USD for
electricity generation from methane at Nubarashen dump in Yerevan with

now being revised, the head of the environmental protection department

to start either this or next year.

The most unexpected point of the UN vote on Occupied Territories of
Azerbaijan is certainly that OSCE Minsk Group co-chairs – US, Russia
and France, which are directly involved in the problem, voted against
the document.

In fact the document demolished illusions around the solution of
Nagorno Karabakh conflict and clarified the issue. The question is
that OSCE Minsk Group Co-Chairs directly involved in the regulation
of Nagorno Karabakh conflict voted against the resolution, which
is recognizing territorial integrity of Azerbaijan and demanding
solution of the conflict on the basis of this principle. It provokes
a fair question: "If OSCE Minsk Group Co-Chairs votes against the
resolution, which recognizes territorial integrity of Azerbaijan,
how objective mediators can they be?" One of the interesting moments
is that the co-chair countries did not only vote against, but also
actively campaigned against the adoption of this document. This
situation clarifies two important results:

1) OSCE Minsk Group co-chairs are not neutral mediators, they are
concrete SIDES. Their position coincides with the position of occupier
Armenia, but not Azerbaijan, whose rights have been violated as a
result of the conflict.

2) Solution models proposed by the co-chairs cannot be based on the
principle of territorial integrity of Azerbaijan. Their position shows
that co-chairs are trying to solve the conflict not on the basis of
territorial integrity, but on the principle of self-determination,
or mixed formula of both principles.

Both results show that OSCE Minsk Group Co-Chairs will lose confidence
of Azerbaijani community. Even without that, the community has no
simple attitude to the Minsk Group, which couldn’t achieve any result
toward the solution of the conflict over the years. However the Minsk
Group Co-Chairs lost sight of one factor- their position in the UN
General Assembly has complicated not the situation of Azerbaijan,
but OSCE Minsk Group.

Certainly one of the decisive moments of regulation process, not
depending on the results, will be preparation of both communities for
the compromises. The Co-chairs have made statements on this issue for
many times and underlined the importance of public communities in
Azerbaijan and Armenia for the compromises. In current situation,
the co-chairs are restricting Azerbaijan’s opportunity to make
a compromise and not giving a chance to the community to accept
existing compromises.

Logic is simple – if the mediators do not recognize Azerbaijan’s
territorial integrity, avoid the settlement of the conflict basing on
this principle, the society will reject any proposal of the co-chair
countries, thinking that their proposals meet Armenia’s interests.

Thus, the co-chairs, with their position in UN General Assembly expose
the society’s confidence to risk.

Can Azerbaijan refuse mediation mission of OSCE Minsk Group? It does
not seem real after the adoption of the resolution in UN. Even the
resolution supports the activity of OSCE Minsk Group and Deputy Foreign
Minister Araz Azimov said Azerbaijan was interested in continuing
the process of negotiations with mediation of OSCE Minsk Group. But
assessing both the resolution and official statements, we come to the
conclusion that Azerbaijan wants important changes in the negotiations.

However, if Azerbaijan really wants to achieve progress in the
process of negotiations and make use of the essence of the resolution
adopted in the UN General Assembly, then it should lay down a concrete
condition before the co-chair countries – settlement of the conflict
within the framework of the countries’ territorial integrity should
be determined and the negotiations should be carried out basing on
this concrete principle. The resolution adopted in the UN General
Assembly enables to lay down such a condition. The further stage
of the negotiations on the settlement of Nagorno Karabakh conflict
depends on the acceptance of this condition by the co-chairs. It is
not convincing that the result of the negotiations, which do not base
on the principle of the countries’ territorial integrity, will differ
from the hitherto results.

The outcome of the vote to the resolution on Nagorno-Karabakh in
the UN "was a peculiar barometer of the mood of the international
community," runs the release of the Armenian ministry of foreign
affairs on the resolution presented by the Azerbaijani side. "Only
39 states voted for the resolution which represented GUAM and the
Islamic Conference Organization. The OSCE Minsk Group co-chairs on
behalf of the United States, France and Russia, as well as Armenia
and a number of other countries voted against the resolution, over
150 countries abstained or did not participate in the vote at all,"
runs the release of the ministry.

"I hope the outcome of the vote will be a signal to Azerbaijan from
the international community," said the Armenian foreign minister
Vardan Oskanyan, adding that the majority of the UN countries reject
one-sided approach to this issue. The Armenian foreign minister
described the resolution of Azerbaijan as hypocritical. On the
one hand, the document presented by official Baku is an effort
to misinform the international community, on the other hand, the
resolution includes a provision which endorses the efforts of the
OSCE Minsk Group co-chairs who had spelled out disagreement with the
resolution and voted against it. The foreign minister of Armenia is
now interested in further actions of official Baku. The question is
whether Azerbaijan will continue to hinder the peace process or will
sit at the table of talks. The head of the Armenian foreign ministry
reasserted the readiness of the president elect of Armenia Serge
Sargsyan to meet with the head of Azerbaijan Ilham Aliyev in case
the latter and the OSCE Minsk Group agree. "There is a possibility,"
said Oskanyan, adding that by rejecting the resolution presented by
Azerbaijan the international community showed that they support the
document which is on the table of the talks and which allows bringing
closer the right of people for self-determination and territorial
integrity which seem controversial at first sight. "This document
allows Armenian and Azerbaijan advancing in the talks," says the
minister of foreign affairs of Armenia, Arminfo reports.
