Two of three judges vote to nullify state law giving heirs the right
to sue for unpaid benefits.

DOWNTOWN — A state law allowing heirs of victims of the Armenian
genocide to sue in state courts for unpaid insurance benefits was
deemed unconstitutional last week by a federal appeals court, setting
off a wave of local reaction.

A divided three-judge panel of the U.S. 9th Circuit Court of Appeals on
Thursday nullified the state law that allowed descendants of Armenian
genocide victims killed by the Ottoman Empire to request payment on
the life-insurance policies of relatives.

The panel said in its 2-1 decision that the law amounted to
unconstitutional interfering in U.S. foreign policy. The same panel
one day prior used similar reasoning to strike down a state law meant
to aid the inheritors of artwork allegedly stolen by Nazis. Both
of the laws extended the statute of limitations to file claims to
Dec. 31, 2010.

Thursday’s decision was based on a 2003 U.S. Supreme Court ruling
that invalidated a state law designed to help Holocaust survivors
collect on World War II-era insurance policies.

Three times Congress has considered resolutions in the last decade
that would have provided recognition of the Armenian Genocide. But the
White House each time urged that the bills be foiled, fearing that
their passage would damage relations with Turkey, whose government
denies that a genocide took place.

"Our position is it’s not just a stretch, it’s bordering on ludicrous,"
said Brian S. Kabateck, a Los Angeles lawyer representing the
plaintiffs, and whose maternal grandparents died in the genocide. "I
think these judges — the two judges that ruled against us — saw
it wrong."

Prior Armenian genocide cases yielded significant agreements, including
a 2004 settlement in which New York Life Insurance Co. agreed to pay
$20 million and a 2005 settlement in which AXA S.A. agreed to pay
$17 million.

Armenian descendants last year filed a class-action against Aviva PLC,
a British firm, and another suit is pending against Deutsche Bank.

Glendale priest Vazken Movsesian of St. Peter Armenian Church —
joined by the thousands of Armenians whose relatives were among the
1.5 million killed between 1915 and 1923 — filed their case six years
ago. The group sought a settlement of claims under policies issued by
German insurers Victoria Versicherung and Ergo Versicherungsgruppe,
as well as parent company Munchener Ruckversicherungs-Gesellschaft AG.

The plaintiffs scored a partial victory two years ago when
U.S. District Judge Christina A. Snyder said the law passed in 2000
by the California Legislature gave the descendants standing to sue.

The appellate court, however, reversed that decision.

"The federal government has made a conscious decision not to apply
the politically charged label of ‘genocide’ to the deaths of these
Armenians during World War I," said Judge David R. Thompson, who
wrote the majority opinion in Thursday’s rulings. "Whether or not
California agrees with this decision, it may not contradict it."

Neil Soltman, lawyer for one of the insurance companies, maintains the
ruling was consistent with past decisions overturning state efforts
to adopt legislation that interferes with the national government’s
foreign policy.

Because the ruling does not apply retroactively, none of the California
residents paid as part of earlier settlements must refund the money.

Genocide of Armenians during World War I has yet to be recognized
by the federal government, despite recognition by 42 states. The
Turkish government has made no official objection to any of the
states’ resolutions.

Rep. Adam Schiff, who as an assemblyman co-wrote the overturned
law, said he found the court’s reasoning perplexing. "It’s very,
very peculiar logic," he said. "I was very distressed to read the
opinion, and I think it’s an awful result." Kabateck, who indicated
he would appeal, said there is no conflict between the state law and
federal policy.

Local members of the Armenian community expressed dismay.

"The state has the right to reflect the will of its citizens, and in
this case it has already reflected that with laws that were passed,"
said Zanku Armenian, chairman of the Armenian National Committee
Glendale chapter. "A crime was committed back in 1915. What we are
trying to do is make sure that the U.S. government does not outsource
its foreign policy to a foreign government, in this case, Turkey. The
judges’ decisions in essence make the same mistake as the president
and the State Department."

The panel Thursday said the issue was defined by George W. Bush and
Bill Clinton when they warned that recognizing the Armenian Genocide
would damage U.S.-Turkey relations.

President Obama, who on the campaign trail said the nation deserves
"a leader who speaks truthfully about the Armenian genocide," stopped
short of using the term during a trip to Turkey in April and has not
taken a position on the court case.

"Clearly there was political pressure brought on these judges to
rule the way they did," Armenian said. "If the U.S. says ‘enough,’
what’s going to happen? The Turkish denial machine would crumble;
it would force them to start dealing with the truth."

U.S. Circuit Court of Appeals created Code of Civil Procedure which
extended the deadline for suing on life insurance policies issued to
"any person of Armenian or other ancestry living in the Ottoman Empire
during the period of 1915 to 1923, inclusive, who died, was deported,
or escaped to avoid persecution during that period," and expanded
state court jurisdiction over such claims.

Today, the director of Oriental Studies Institute Ruben Safrastyan
told at news conference that he has been informed that the two judges
were pro to the previous decision but the ruling judge was against.

"We could say that this is attempt to give political coloring to the
process of recognizing Armenian Genocide, which is done by a court
representative," expert said.

Expert says American disposition upon Armenian Genocide has nothing
to do with that decision. But the expert has also stressed that the
U.S. strategy in South Caucasus has much changed getting different
direction. OSCE Minsk Group American co-chair Matthew Bryza’s
statements have much to do with it, as well as U.S. President Barack
Obama’s decision to relate ties with Muslim world.

For Roman Catholics, August 24th is the day to celebrate Saint
Bartholomew. (Orthodox Christians honor the saint on June 11th.)

Bartholomew appears only four times in the Christian Bible, and even
then he is only mentioned as one in the list of the twelve apostles
(Matthew 10:3, Mark 3:18, Luke 6:14, Acts 1:3). Scholars typically
identify Bartholomew with Nathanael, one of Jesus’s followers who is
mentioned only in the Gospel of John. Some explain that the confusion
results simply from the author of the Gospel of John referring to
the apostle by his given name, Nathanael, while the other books use
his surname, Bartholomew, from the Hebrew Bar-Tolmai, meaning "son
of Tolmai."

The identification of Bartholomew with Nathanael sheds more light on
the saint’s life and works. A resident of Cana in Galilee, Nathanael
met Jesus through the intercession of his friend and fellow apostle,
Philip. Upon meeting Jesus, Nathanael identified him as "the Son
of God… the King of Israel" (John 1:49). The Biblical record also
notes that Nathanael saw Jesus after the resurrection (John 21:2).

Biblical commentators and local traditions describe Bartholomew’s work
after Jesus’s ascension into heaven. Records note that the apostle
traveled east to India, in order to baptize new Christians and to
exorcise demons. Bartholomew also traveled to Asia Minor with fellow
apostle Thaddeus to preach Christianity. Both were martyred around 60
AD after laying the foundation for the Armenian church. Records are
unclear on the method of Bartholomew’s martyrdom, but he is sometimes
depicted in art as having been flayed alive, as in Michelangelo’s Last
Judgment in the Sistine Chapel. Others suggest that Bartholomew may
have been crucified or beheaded. Regardless, Christians celebrate
Saint Bartholomew as a model of faith, unwilling to denounce his
message even in the face of his own death. August 24th serves as a
time for Roman Catholics to celebrate Bartholomew’s faith and ministry,
and for Armenian Christians to honor their patron saint.

Plenipotentiary of Armenia to Egypt Armen Melkonian handed over the
copies of his credentials to Foreign Minister of Egypt Ahmed Aboul
Gheit on August 20.

During the conversation following the ceremony of handing the
credentials A.

Gheit hoped that the ambassador will contribute to the deepening and
development of Armenian-Egyptian relations during his tenure. He highly
assessed the cooperation between the two countries and underscored
the necessity of continual contacts at different levels. The Minister
also pointed out the role of the Egyptian-Armenian community both in
the domestic life of the country and in deepening Armenian-Egyptian
relations.

A. Melkonian expressed his willingness in bringing to life the
mentioned programs and further expanding the mutually beneficial
cooperation. At the request of A. Gheit he presented the last
developments in the Nagorno Karabakh conflict settlement process and

Armavia and the Russian Aeroflot to prepare "Superjet-100" for
operation, Ekaterina Petrova, representative of the company said.

"Our company will help Aeroflot and Armavia to prepare the
commissioning of the aircraft Sukhoi Superjet-100, representative of
Thales said. We will also help the "Sukhoi Civil Aircrafts" company
to get the Russia’s civil certification, and then the certification
of the European Aviation Safety Agency.

As it was reported earlier Aeroflot and Armavia will be first airlines
to receive serial Superjets, which is expected in early 2010, Itar-Tass
reports .

"The Sukhoi Superjet 100 program is one of the major projects of
Thales in Russia. The French group provides a full set of on-board
radio-electronics, including devices to display information in the
cockpit, an integrated modular platform of on-board radio-electronics,
communications, navigation and surveillance.

Armavia, a member of the International Air Transport Association,
have 250 flights a month to over 30 destinations in the CIS countries,
Europe and Middle East. In 2008, the airline carried almost 647,000
passengers. Air fleet consists of the company has aircrafts of A-319
(3), A-320 (2), IL-86, TU-134 types.

Professional German Boxer Susianna `Susi’ Levonovna Kentikian, known
as the Killer Queen, will make her first appearance at the Rostocker
Stadthalle on October 10th to fight Julia Sahin.

Susianna Levonovna Kentikian Biography
As a biography Susianna `Susi’ Levonovna Kentikian is a Professional
German Boxer who was born on September 11, 1987 in Yerevan, Armenian,
SSR. Due to the the Nagorno-Karabakh War Kentikian and her family
moved around alot. She used boxing as an outlet during a period of
total chaos. In 2001 through 2004 Susi won the Hamburg Junior
Championships as well as the International German Women’s Amateur
Championships.

In 2005 Susianna Levonovna Kentikian turned professional signing with
Hamburg boxing promoter Spotlight Boxing. She is coached by Magomed
Schaburow. To date in Kentikian’s pro career she has won twenty-five
with sixteen by way of knock-out.

Susi Kentikian has defeated boxers like Iliana Boneva, Daniela Graf,
Carolina Alvarez and Sarah Goodson. She has won several awards:
Hamburg’s sportswoman of the year in 2007, WBA Best Female Boxer in
2007 and 2008’s Germany female boxer of the year.

Gov’t postpones the date for construction of Meghri hydropower plant

Armenian government postpones the date for construction of Meghri hydro
power plant

YEREVAN, August 21, /ARKA/. Citing the political situation in Iran the
Armenian government has decided at its regular session today to
postpone the date for construction of a hydro power plant near the town
of Meghri, on the River of Arax, separating Armenia from Iran.

Armenia and Iran had agreed to build two power plants on the Arax River
which are supposed to become the most powerful hydro power plants in
the South Caucasus. On the Armenian side the plant will be near the
town of Meghri and on the Iranian side near the town of Karachilar.
Each will have the capacity to produce 800 million KWh of power
annually.

Armenian Energy Minister Armen Movsisyan said today the decision was
forced because the administration of Iranian president Mahmoud
Ahmadinejad, following the latest presidential election, has not yet
formed a new government.

The minister said the deadline for selecting an investment company,
signing a relevant contract with it, as well as allocation of a land
plot for the future plant, that were originally scheduled for the third
quarter of 2009, will be extended into the fourth quarter. The license
will be granted to the power plant in 2010.

Prime Minister Tigran Sargsyan suggested that a protocol be passed in
addition to the decision to ensure the financial stability of the power
grid sector.

0We need to pass the protocol to not allow rise of electricity price
for end consumers and besides, it is necessary to cover financial gaps
in the sector at the expense of government-run power plants in Vorotan,
Yerevan and the nuclear power plant,’ he said.-0-

OSCE U.S. co-chairman prefers not to comment on Armenian politician’s
statement

U.S co-chairman of OSCE Matthew Bryza prefers not to comment on
Armenian politician’s proposal to declare him "persona non grata" in
Armenia.

"I’d prefer not to comment much on the statement by one or a few
Armenian politicians. I only wish to note that all the people involved
with the Minsk Group negotiations, and I myself, know how fair I have
always been in negotiations on Nagorno-Karabakh, offering countless
ideas on how to resolve the differences between the parties,"

Chairman of the Constitutional Right Union party Aik Babukhanyan
criticized sharply Bryza’s recent statements on the Nagorno-Karabakh
conflict and proposed to declare him "persona non grata" in Armenia,
Armenia Today news agency said.

"About a year ago I said that the Armenian authorities should declare
Bryza "persona non grata", and still I hold the same opinion. That is
what a person, a foreign diplomat, who does not respect the Armenian
nation, the state and the authorities deserve," Babukhanyan said at a
news conference.

The conflict between the two South Caucasus countries began in 1988
when Armenia made territorial claims against Azerbaijan. Armenian
armed forces have occupied 20 percent of Azerbaijan since 1992,
including the Nagorno-Karabakh region and 7 surrounding
districts. Azerbaijan and Armenia signed a ceasefire agreement in
1994. The co-chairs of the OSCE Minsk Group – Russia, France, and the
U.S. – are currently holding the peace negotiations.
