Mr. President, On behalf of the Armenian National Committee of
America’s Western Region, an organization that has fought to keep
policy makers informed of concerns of Armenian Americans for over
60 years here in the west, I am happy to share with you the thoughts
and concerns of our community.

In September, a nationwide poll was conducted representing a
statistically sound and geographically diverse sample from over 100,000
Armenian Americans households in the United States. The results of
the poll revealed that over 90% of Armenian Americans oppose the
adoption of the proposed Turkey-Armenia Protocols.

A have a copy of that poll and its results here which I am happy to
share with you.

Our organization has always advocated for and supported the Armenian
nation’s right to security, justice, economic welfare, and democratic
aspirations however we find ourselves in the unenviable role of having
to counsel Armenia’s government as to why these protocols do not serve
the Armenian nation’s short nor long term national interests. Just
as the do not serve American long term national interests because
they reward the perpetrator while punishing the victim of the gravest
international crime.

In your explanation you expressed many things that simply are not
reflected in the text of the agreement. The most glaring of which is
your insistence that there are no pre conditions laid out in this
protocol; That is only establishes a mechanism; That Karabakh is
not effected by this document; And that this agreement somehow opens
new opportunities for the Diaspora to interact and persuade Turks of
the genocide.

As to the pre conditions I should first say that I am a lawyer by
training and practice government law so please excuse me if I venture
into a bit of legal parlance from time to time but since this is a
legal document it must be understood within that paradigm otherwise
we are merely fooling ourselves.

I would like to address four significant clauses in the document that
I would like to draw attention to in this short period of time I have:

First. It references itself as a bilateral agreement yet it imposes
obligations outside the bilateral realm in paragraph 3. It states :
"Reconfirming their commitment in bilateral and international relations
to respect the principles of sovereignty and non intervention in the
internal affairs of other states, territorial integrity and inviobility
of frontiers."

Why does a bilateral agreement talk of international obligations
of these two states towards others? The only other states that
frontier Armenia are Iran, Georgia and Azerbaijan. This clause can
have catastrophic consequences to Karabakh, since Armenia has not
formally recognized Karabakh’s independence, yet in this agreement
it confirms the principle of territorial integrity and inviobility of
frontiers. By signing onto this clause the Republic places itself in
a bind if it is to express or be active in Karabakh’s security and
if it ever intends to recognize Karabakh independence those action
are prohibited by this clause.

Second, in clause 5 it states "Confirming the mutual recognition
of the existing border between the two countries as defined by the
relevant treaties of international law"

If no preconditions were actually true Armenia could simply recognize
the existing de facto frontier period. Why was this phraseology
included which adds permanent legal significance to this de facto
delineated border and recognizes the border as defined by international
treaty and law. This is an unacceptable way of resolving Armenia’s
legal title to territories that had been part under the jurisdiction
of the first independent Republic’s such as Kars Ardahan, Igdir and
Surmalu, and territories that Republic arguably still legally holds
title to. Why to are you rejecting the Wilson Arbital Award granted
by the Paris Peace Conference to Armenia. Why are we granting dejure
status to the de facto border? And if there are no preconditions will
you remove those last nine words?

Why will you not simply leave it at that and allow the Republic
the opportunity to seek legal adjudication of its frontiers to the
international court of justice. It is a legal issue not a diplomatic
issue Armenia can win through shrewd bargaining with Turkey. Why
would you prefer to summarily capitulate to Turkey’s number one
foreign policy goal vis a vis Armenia?

Finally the clause on the second page item 2 whereby "the parties
agree to implement a dialogue on the historical dimension with an
aim to restore mutual confidence between the two nations, including
an impartial scientific examination of the historical records and
archives to define existing problems…."

Certainly the drafters did well to attempt to veil what this means to
the ignorant and unassuming 3rd party’s, but it is clear on its face
that this clause achieves Turkey’s 2nd foreign policy goal and that
it to take the political controversy of the Genocide and turn it,
for the first time ever in any country anywhere outside of Turkey,
into an historical controversy.

This clause is not just offensive to any Armenian who has fought for
the universal recognition and justice for the Armenian genocide but
just last night United States Senator Robert Menendez (who exposed and
prevented U.S. Ambassador Richard Hoagland from being confirmed as US
Ambassador to Armenia because he called into question the historical
veracity of the Armenian Genocide), Menendez stated last night in
New York that he found this clause in your proposed protocols to be
"frankly absurd" and "against Armenian national interests" and "an
insult to the Armenian People". Frankly Mr. President how did you
expect we here in this room to see it any differently that that?

Now of course I am reading the English version but that is the
only legally significant version since the last line stipulates that
though it is written in Armenian, Turkish and English…in case of any
dispute regarding its interpretation the ENGLISH text shall prevail.

Mr. President what team of international legal experts fluent
in English advised you on this document? What concerns if any did
they express to you about the significance of the phraseology I have
identified to you? How can you possibly stand here in front of us and
tell us with a straight face that there are no pre conditions herein ,
that this is only establishing a mechanism?

All of Turkey’s final political objectives are met with the adoption
of this document? None of Armenia’s are met.

Tomorrow assuming the border is opened and Armenia economy
somehow miraculously survives in spite of what the experts have
projected. Those projections are that Armenia’s fledgling, little
protected and non subsidized industries will collapse in the face of
a well subsidized and supported Turkish economy. Assume that Turkey
closes the border 6 months after opening it ….will you add a clause
in here to make all provision herein null and void? If not why?

Finally, how is it that you state that you value the Diaspora and find
it to be an indivisible part of the nation yet, when your counter
part in Turkey conferred repeatedly with Pres. Aliev in Baku to set
his mind at ease prior to the public announcement of this protocol,
you made no effort to do the same with you "indivisible Diaspora" a
Diaspora that was ostensibly so important to you that you established a
Ministry of Diaspora with great pomp and circumstance last year. Your
Minister visited communities around the globe to extol the importance
of our unified past and destiny. How can it be that Gul thought more
of a foreign president than you did of your own dispersed nation by
seeking to confer and set Aliev’s mind at ease while the Diaspora
stood dumbfounded and in disbelief by this announcement in late August.

Mr. President this community is unified in its opposition. All three of
the traditional Armenian political organizations as well the younger
recent immigrant community from Armenia stand together against these
protocols. Last week 10000 took to the streets to send you a wake
up call.

You are right that Armenia greatest natural resource is its large
Diaspora which comprises more than two thirds of the Armenian
nation. Please do not sacrifice Armenia and its Diaspora for these
protocols.

Relations with Turkey can and should be established but it was
not Armenia who shut the border and blockaded its neighbor it
was Turkey. Armenia has never taken a belligerent stand against
Turkey. Turkey has laws on the books still making it a crime to utter
the words Armenian and Genocide together . Yes turkey needs to evolve
but these protocols do nothing but reward their belligerence towards
Armenia and Armenians. It bolsters their campaign of drawing the
veracity of the genocide into question and finally isolating Karabakh
from Armenia and preventing Republic of Armenia’s participation in
the security and self determination of Karabakh.

Please stop this madness. Save your legacy. Save our legacy.

Armenian men’s team Mika scored 3,5:2,5 against PVK – Kievchess in
Round 3 of European Club Cup in Ohrid. Levon Aronian, Vladimir Akopian
and Arman Pashikian played to draw with Alexander Onischuk, Evgenij
Miroshnichenko and Alexander Beliavsky respectively. Gabriel Sargissian
won against Alexander Areshchenko, Tigran Petrosian gained a victory
over Spartak Vysochin. Zaven Andriasyan lost to Vladimir Baklan. Now 6
teams have taken lead at the tournament list, Baden-Baden, to compete
against the Armenian Mika in Round 4, being among them.

Armenian women’s team Mika lost to Polonia Votum Wroclaw
1,5:2,5. Harika Dronavalli and Lilit Galoyan lost to Jolanta Zawadzka,
Monika Krupa respectively. Elina Danielian ended in draw against Iweta
Rajlic, Nino Khurtsidze gained a victory over Szczepkowska-Horowska.

Recent comments by Armenian President Serzh Sargsyan on the status of
the disputed territory of Nagorno-Karabakh suggest that the peace
process remains at an impasse. That, in turn, could complicate
Armenian-Turkish reconciliation efforts.

In a September 21 interview with the Russian state-run RTR television
channel, Sargsyan for the first time publicly voiced Yerevan’s
interpretation of the so-called Madrid Principles, which contain a
framework for an Armenian-Azerbaijani peace pact on Karabakh.

The Principles, first proposed in late 2007 by mediators Russia,
France and the United States, call for the return of Armenian-occupied
regions surrounding Karabakh to Azerbaijan control; the return of
Azerbaijani Internally Displaced Persons (IDPs) to Karabakh; and,
finally, an agreement on a mechanism, likely a referendum, to decide
on the territory’s future status.

Sargsyan made clear that Armenia sees these steps happening in the
reverse order; namely, that both the handover of regions bordering
Karabakh to Azerbaijan and the return of Azerbaijani IDPs can occur
only after Karabakh’s final status is determined. To support his
position, Sargsyan argued that allowing IDPs to return before a
determination of the territory’s status was made "would cause new
clashes."

Sargsyan described the Madrid Principles as "the holding of a
referendum to define the final status of Nagorno-Karabakh, the
return to Azerbaijani control those territories which you named [as
under Armenian army control] and which Karabakh and we both call the
‘security zone,’ and the normalization of all our relations."

"My position has been expressed many times, including to [Azerbaijani
President] Ilham Aliyev and to the co-chairs [of the Minsk Group
overseeing the talks], and it amounts to the following. Of course, the
Azerbaijani refugees from Karabakh have the complete right to return
to their native places, their places of residence, but they can do
this after the final definition of the status of Nagorno-Karabakh,"
Sargsyan said. "Why? Because there has not yet been a single similar
conflict where the return of refugees ahead of time did not cause new
clashes. And we are heading toward a resolution — for the purpose
of what? For the purpose of peace, of stability, so that each person
will know where he will live."

Sargsyan expressed thanks to Russian President Dmitry Medvedev,
who, according to Sargsyan, had helped President Aliyev and him
"almost agree on the first point," which the Armenian leader earlier
listed as "the holding of a referendum to define the final status
of Nagorno-Karabakh."

How Sargsyan’s comments will impact Armenia’s budding reconciliation
with Turkey remains unclear. Turkish officials have repeatedly
stressed that Turkey will reopen its border with Armenia only if
progress acceptable to Baku is made on a Karabakh peace pact. Ankara
closed its border with Armenia in 1993 to support Azerbaijan in its
war with Armenia over the territory. [For background see the Eurasia

"We will not take steps contradicting Azerbaijan’s interests," Turkish
Prime Minister Recep Tayyip Erdogan said in a September 28 interview
with Azerbaijan’s Trend news agency. "We can accelerate the process
of the adoption of the agreement [with Armenia], but that will depend
on the resolution of the Nagorno-Karabakh conflict."

On October 10, Turkish Foreign Minister Ahmet Davutoglu and Armenian
Foreign Minister Eduard Nalbandian are scheduled to sign protocols
that set the stage for reopening the Turkish-Armenian border and
reestablishing diplomatic ties. [For background see the Eurasia

Turkish officials, to date, have not reacted publicly to Sargsyan’s
RTR comments.

Azerbaijani leaders, however, have indicated that Sargsyan’s position
is a non-starter with Baku. In an interview with RTR during the summer,
Azerbaijani President Ilham Aliyev asserted that if the issue of
Karabakh’s final status "is brought up again as a precondition for
coordination of positions, we will not achieve anything."

Aliyev named the withdrawal of Armenian troops from the regions
bordering Karabakh as "the first step." Discussion of Karabakh’s final
status can occur only after Azerbaijani IDPs return to the territory,
he emphasized.

Armenian officials have long insisted that the two issues — the
Karabakh peace process and Turkish reconciliation efforts — are
separate. The Minsk Group, the triumvirate of Russian, American and
French envoys overseeing the Karabakh negotiations, has echoed that
assessment.

Armenia’s Ministry of Foreign Affairs declined to comment on
Sargsyan’s comments to RTR. "I can only remind you that Armenia
has always stressed that the core of the Karabakh problem is the
issue of Nagorno-Karabakh’s status," said ministry spokesperson
Tigran Balaian. The idea that a withdrawal should take priority over
determining Karabakh’s status is only the Azerbaijani point of view,
and one that is "not necessarily shared" by Armenia, he added.

Many Armenians continue to worry that the agreement on reconciliation
with Turkey includes a "hidden" condition that Armenia makes Karabakh
concessions. Sargsyan has dismissed that fear as groundless.

One political analyst termed Sargsyan’s interpretation of the Madrid
Principles "quite natural."

"The Madrid Principles by themselves are a very vague document and
allow [for] different interpretations," said Alexander Iskandarian,
director of Yerevan’s Caucasus Institute. "There is no surprise that
the sides interpret it in such a different manner."

"I think that the Karabakh settlement process has its own logic,
and it can be accelerated or delayed artificially," he continued.

Other aspects of the Karabakh talks also appear open to differing
interpretations. Speaking with members of Armenian Diaspora in Paris
on October 2, President Sargsyan stated that finding a resolution to
the Karabakh problem "still requires significant work." Reason exists
"to believe that signing an agreement about the resolution of this
problem is not realistic," Armenian news agencies quoted him as saying.

On the same day, speaking in Nakhichivan City in Azerbaijan,
Azerbaijani President Aliyev told Turkish President Abdullah Gul,
Kazakhstani President Nursultan Nazarbayev and Kyrgyz President
Kurmanbek Bakiyev that talks with Armenia about Nagorno-Karabakh
"are in their final stage."

The two leaders will meet on October 8 in Chisinau, Moldova, for
additional discussions on the Karabakh issue.

second and final reading amendments to laws "On education" and "On
Higher and Post Graduate Education". Author of the law, MP from the
"Prosperous Armenia" party Naira Zohrabyan earlier familiarized the
deputies with the amendments, which ensure the same tuition fees for
all Armenian students enrolled in local universities: either from
Nagorno-Karabakh, Samtskhe-Javakheti, Kvemo Kartli or Armenia.

According to a PanARMENIAN.Net reporter, Armenia’s parliament also
adopted bills on making amendments to RA law "On Central Bank, the laws
"On remunerating civil servants" and "On mental health".

Besides, it was put to a vote and adopted the agreement "On cooperation
and mutual assistance in customs between Armenia and Italy, signed
on March 6, 2009.

of production of purified, clean copper in Kajaran is being implemented
by the "Chronomet" company which is the main shareholder of "Zangezour

Head of the industry department of the Armenian Economy Ministry
Hayk Mirzoian told Armenpress that establishment and exploitation of
the factory will give an opportunity to restore the production of
wires in Armenia. The volumes of the investments necessary for the
implementation of the project reach nearly 100 million Euros. The
Company intends to get a part of the sum as credit from the European
Bank of Reconstruction and Development.

According to H. Mirzoian the production of copper wires must be
organized in new, yet untested technologies during the conduction of
which all the possible risks are taken into account. Construction
of the factory will be finished in 2010. From 2011 pure copper and
copper wires will be produced in Armenia. With it Armenia will also
start to export a ready made product, meanwhile by now only copper
row material is exported.

"The foreign investors are also interested in the deepening of the
procession phase of the mine resources of Armenia," Hayk Mirzoian said.

"Chronimet" is also conducting works towards organization of production
of electric batteries in the Yerevan "Electron" factory which will be
the only one in the republic in its types of production and standards.

The Azerbaijani Ecology and Natural Resources Ministry held a
monitoring to study level of pollution of transboundary rivers.

The Azerbaijani Ecology and Natural Resources Ministry held a
monitoring to study the level of pollution of transboundary over the
third decade of September.

According to the monitoring, the water waste in the Kur River
transbordering with Armenia was 218 cubic meters per minute with an
increase of 94 cubic meters per minute.

The ministry revealed out that the level of pollution the Kura and
Aras Rivers by Georgia and Armenia exceeded the norm. Amount of
nutrients in the waters of Kura exceeds the norm numerously due flow
of domestic and industrial wastes from Georgia and Armenia to water
facilities without preliminary purification

Composition of specific contaminants of phenol and copper compounds
exceeded the allowed density norm in water.

In the Shikhly-2 area content of phenols, one main pollutants of
water exceeded the allowed density by 7 times, ammonium ions by 6
times and copper compounds by 6. Content of phenols exceeded the
allowed density by 6 times and copper by 6 times in the Agstafachay
area and 6 times in Agstafachay reservoir.

According to the monitoring, the water waste in the Aras River
transbordering with Armenia was 163 cubic meters per minute and content
of copper in the water exceeded the allowed density by 4 times and
phenols by 3 times in Horadiz section of the Aras River. Content of
phenols exceeded the allowed density by 2 times and copper by 3 times
the Shahsevan I and 2 times in Bahramtapa.

The oxygen regime of the water was 4.35-6.53 milligram per liter in
all areas and changed within sanitary norm.

Diaspora Has No Right To Criticize Armenian President: Abrahamyan

U.S., French and Lebanese citizens must not make assessments of the
Armenian president, Armenian local daily Aravot Chief Editor Aram
Abrahamyan stated.

According to Abrahamyan, the Diaspora responds negatively to his
articles; they blame him for splitting the nation.

However, Aravot’s chief editor repeated his opinion that citizens
of the forementioned countries must make assessments of their own
country’s presidents.

"I can say that human rights are violated in Finland, but I will
not allow myself to say ‘Barack or Sarkozy, you are a traitor’,"
he emphasized.

Speaking about the establishment of Armenian-Turkish relations and
the protest demonstrations organized in different parts of the world,
Abrahamyan emphasized that he is more interested in the fact that
people still continue to remain in prison because of their political
views rather than in Armenian-Diaspora negotiations.

"I suppose that readers of my articles are also of the same opinion,"
he said.

Abrahamyan stated with regret that the topic of the establishment of
Armenian-Turkish relations prevails in the Armenian press. "I think
there are inner problems of more importance, which are connected with
fair elections, corruption, democracy, political prisoners and other
occurrences, which were placed on the back burner in connection with
these events," Abrahamyan concluded.

Fundraiser for FAR’s Gyumri Information Technology Center Successful
Nine years ago Elena Sarkissian and her brother Patrick
Sarkissian visited the city of Gyumri in Northern Armenia with the
Hayastani
Kidak Society (former Young Professional Trips) of the Fund for
Armenian Relief
(FAR) – What they saw there, from the
destruction of the 1988 earthquake, led them to seek proactive ways to
make progressive change possible for Armenia while getting the word
out to
Armenian-Americans, encouraging collective action.
Their efforts culminated in the creation of GTech Committee
three years ago – a board actively focused on fundraising and
communication
efforts to support FAR’s Gyumri Technology Center ("GTech"). Ms
Sarkissian, as
chair, along with her brother and eight committee members of all
professional
backgrounds are the core energy center behind donor events,
multi-media
marketing promotions and GTech’s distinct branding.
Most recently, Ms Sarkissian and the GTech Committee (Talene Baroyan,
Greg Bazarian,
Martha Mensoian, Patrick Sarkissian, Shant Madjarian, Marina Sarian,
Rafi Hovsepian,
Melanie Dadourian, and Kirk Hourdajian) spearheaded a fantastic
fundraising event
– "GTech: The Future of Hye-tech" –
for friends, colleagues, Armenians and non Armenians alike at Soho
House in
Manhattan’s Meatpacking District. Their aim, achieved successfully,
was to
spread the word on the GTech cutting-edge IT education, its benefits
to
Armenia’s labor force, and the progress of its graduates since 2005,
the
school’s first operating year.
As Patrick Sarkissian put it in the evening’s opening
remarks, "There is a brain drain in Armenia, and we need to help
Armenia keep
its talents at home." His words conveyed a concern to create a middle
class in
Gyumri and Armenia by giving opportunities to young talent to advance
and
practice their professions in their hometown region.
To follow, the committee presented a USAID video, edited by
committee member Melanie Dadourian, on Gyumri and GTech. With emphasis
on high
unemployment rates even now 20 years after the earthquake and the
subsequent
loss of college-educated professionals from the region, the importance
of
keeping up a post-graduate IT professional school competitive with
current
global market trends shined through.
Mr. Sarkissian is clear about the Committee’s role in making
the necessary changes: "Our goals are to expand the program and build
a
permanent, self-sustaining IT school with hundreds – if not thousands
– of
graduates who will substantially contribute to the revitalization of
Gyumri and
in return Armenia at large. We are working towards achieving
self-sustainability within the next three to five years."
Elena Sarkissian’s dedicated efforts as chair are key to
keeping a school like GTech alive. Students’ tuitions are primarily
donor
funded, and events such as these spread the word of GTech’s mission,
successes,
and needs. Without Ms Sarkissian’s ability to gather new and concerned
individuals to the cause, many talented students would lose this
lifetime
opportunity.
In closing remarks, Ms Sarkissian encouraged guests to get
to know 16 current students whose pictures and biographies the
committee
displayed around the room. Bringing individuals in New York up close
to
individuals in Gyumri created a special connection bridging two
worlds. Her
heartfelt words expressed how everyone’s involvement helps these
students help
Armenia progress.
"GTech – The Future of Hye Tech" was no ordinary event.
Elena and Patrick Sarkissian’s unique brand of initiative not only
focuses on
fundraising but communicates new ways to get involved. They have
opened up
unique avenues by which Armenian-American professionals can connect
their talents
and energy to the talents of their less-fortunate Armenian
peers. Thanks to
these untiring efforts, Gyumri’s talented youth now has more
opportunity than
ever to advance and practice their professions in their own hometown,
materializing once-impossible dreams.

YEREVAN, October 6, /ARKA/. Armenian President Serzh Sarkisian had a
telephone conversation with U.S. President Barack Obama while visiting
Los Angeles, Sarkisian’s press office said in a statement. President
Sarkisian was in Los Angeles in the third leg of his pan-Armenian
tour of major Armenian communities to discuss and promote his plans
of normalization of relations with Turkey.

A joint statement issued late on August 31 by Turkey and Armenia,
together with mediators from Switzerland, said Ankara and Yerevan
will conduct six weeks of diplomatic consultations before signing
two protocols that establish formal diplomatic ties and help develop
bilateral relations.

The statement issued by the Armenian presidential press office said
the telephone conversation was initiated by Barack Obama. "During
the conversation Obama expressed his support for Armenian president’s
efforts directed towards normalization of Armenian-Turkish relations,’
the statement said. It also said that Obama has reconfirmed the United
States’ official position that Armenia and Turkey should normalize
their relations without preconditions and that it must not be linked
with the Nagorno-Karabakh peace process.

The statement said Armenian president thanked his U.S. counterpart
for his support for the Armenian-Turkish reconciliation process and
shared his impressions about his pan-Armenian tour.

"The president of Armenia stressed that the concerns of worldwide
Armenians over the reconciliation process is normal regarding that
Armenians were subjected to genocide by the Ottoman empire which
president Obama mentioned in many of his speeches,’ the statement said.

President of Armenia also thanked Barack Obama for the huge mediation
work being done by the USA within the frameworks of the OSCE Minsk
Group towards peaceful settlement of the Nagorno-Karabakh conflict,
emphasizing Armenia’s willingness to move on towards a peaceful
settlement of the conflict. The statement quoted Serzh Sarkisian as
saying that the decision of the people of Nagorno-Karabakh on their
final status through expression of their will is key to finding a
long-lasting and peaceful solution to the conflict, as it is spelled
out in the Madrid Principles.

Turkey and Armenia have had no diplomatic ties since Armenia became
independent from the Soviet Union in 1991. Turkey closed its border
with Armenia in 1993 in a show of support for its ally, Azerbaijan,
which had a dispute with Armenia over Nagorno-Karabakh, the ethnic
Armenian enclave of Azerbaijan.

There are several sensitive issues complicating the establishment of
normal relations between the two countries, particularly, Ankara’s
blatant support of Azerbaijan in the Nagorno-Karabakh conflict
resolution process and Turkey’s refusal to acknowledge the mass
killings of Armenians in20the last years of the Ottoman Empire as
a genocide.

The thaw in the strained relations began in 2008 September after
Turkish president Abdullah Gul arrived in Armenia, at his counterpart’s
invitation, to watch together with Serzh Sargsyan the 2010 World Cup
qualifying football game between the two countries’ national teams.

During that visit the two presidents discussed prospects for engaging
in dialogue and normalization of relations.

Sargsyan received today head of the OSCE Yerevan Office Sergey
Kapinos. Governmental press service told Armenpress that the prime
minister referred to the activity of the OSCE Yerevan Office in
Armenia which includes different spheres and wide circle of issues.

During the meeting the head of the office spoke about the programs of
the office in the anti-corruption policy, economic, nature protection
and human rights spheres.

The interlocutors also spoke about the opportunities of expansion of
cooperation in a number of spheres.
