RA NA MP Vahagn Aleksanyan proposes to make an amendment to the RA Criminal Code and establish criminal liability in the cases of refusal or evasion of a health condition examination or examination by a citizen during the criminal proceedings initiated for evasion of mandatory military or alternative service or conscription or training camp, as well as refusal to give a sample for examination within the framework of the prescribed examination or examination. A sentence of one to three years in prison is recommended.
The author of the legislative initiative stated that there is a need to resolve the existing problem legislatively regarding the cases when the citizen was exempted or postponed from the relevant military draft or training camp on the basis of false medical documents regarding the health condition and refuses to undergo additional examination and expertise or to give a sample for examination in order not to reveal this circumstance. The proposed legislative solution will contribute to the reduction of the cases of dismissal or postponement of compulsory military service on false grounds, as well as provide an opportunity to give a fair criminal assessment to such former actions of persons who have not completed military service on false grounds.
Armen Khachatryan, the deputy chairman of the commission, attached importance to the proposed regulation.
The Government presented proposals on the draft law. They will be discussed between the first and second reading.
The commission voted in favor of the draft law. It will be discussed in the extraordinary session of the National Assembly to be convened in the near future, in a 24-hour mode.
The issue was discussed at the special session of the Standing Committee on Defense and Security Issues on July 1.
