DEFENSE FEDERAL ACQUISITION REGULATION SUPPLEMENT: NEW DESIGNATED COUNTRY–ARMENIA

SUMMARY: DoD is issuing a final rule amending the Defense Federal
Acquisition Regulation Supplement (DFARS) to add Armenia as a World
Trade Organization Government Procurement Agreement (WTO GPA) country
and a designated country, due to the accession of Armenia to membership
in the World Trade Organization Government Procurement Agreement.

SUPPLEMENTARY INFORMATION: On September 15, 2011, Armenia became a
party to the World Trade Organization Government Procurement Agreement
(WTO GPA). The Trade Agreements Act (19 U.S.C. 2501 et seq.) provides
the authority for the President to waive the Buy American Act and
other discriminatory provisions for eligible products from countries
that have signed an international trade agreement with the United
States (such as the WTO GPA). The President has delegated this waiver
authority to the U.S. Trade Representative (see FAR 25.402).

On September 22, 2011, because Armenia became a party to the WTO
GPA and because the U.S. Trade Representative has determined that
Armenia will provide appropriate reciprocal competitive Government
procurement opportunities to United States products and services and
suppliers of such products and services, the U.S. Trade Representative
published a notice in the Federal Register (76 FR 58856) waiving the
Buy American Act and other discriminatory provisions for eligible
products from Armenia.

II. Discussion and Analysis

FAR 25.003 defines WTO GPA countries by listing the parties to the
WTO GPA, and defines “designated country” as a WTO GPA country,
a Free Trade Agreement country, a least designated country, or a
Caribbean Basin country.

Because Armenia is now a WTO GPA country and therefore also a
designated country, as determined by the U.S. Trade Representative,
this final rule adds Armenia to the lists of WTO GPA countries within
the definition of “designated country” at DFARS 252.225-7021, Trade
Agreements, and 252.225-7045, Balance of Payments Program–Construction
Material Under Trade Agreements. Conforming changes were also made
to the clause date at 252.225-7001(b)(12)(i).

III. Executive Orders 12866 and 13563

Executive Orders (E.O.s) 12866 and 13563 direct agencies to assess
all costs and benefits of available regulatory alternatives and, if
regulation is necessary, to select regulatory approaches that maximize
net benefits (including potential economic, environmental, public
health and safety effects, distributive impacts, and equity). E.O.

13563 emphasizes the importance of quantifying both costs and
benefits, of reducing costs, of harmonizing rules, and of promoting
flexibility. This is a significant regulatory action and, therefore,
was subject to review under section 6(b) of E.O. 12866, Regulatory
Planning and Review, dated September 30, 1993. This rule is not a
major rule under 5 U.S.C. 804.

IV. Regulatory Flexibility Act

The Regulatory Flexibility Act does not apply to this rule because an
initial regulatory flexibility analysis is only required for proposed
or interim rules that require publication for public comment (5 U.S.C.

603) and a final regulatory flexibility analysis is only required
for final rules that were previously published for public comment,
and for which an initial regulatory flexibility analysis was prepared
(5 U.S.C. 604).

Publication of this final rule for public comment is not required by
statute (41 U.S.C. 1707) because it recognizes actions taken by the
United States Trade Representative that do not have a significant
effect on contractors or offerors or a significant effect beyond
the internal operating procedures of the Government. Therefore,
publication for public comment under 41 U.S.C. 1707 is not required.

V. Paperwork Reduction Act

The Paperwork Reduction Act does apply because the final rule
affects the certification and information collection requirement in
the provisions at DFARS 252.225-7020, Trade Agreements Certificate,
currently approved under OMB clearance 0704-0229, DFARS Part 225,
Foreign Acquisition, and associated clauses. DFARS provision
252.225-7020 relies on the definition of “designated country” in
DFARS 252.225-7021, which now includes Armenia. The impact, however,
is negligible. Comments regarding the burden estimates or any other
aspect of this collection of information, including suggestions for
reducing the burden, in response to approved OMB clearance 0704-0229,
should be sent, not later than March 30, 2012 to Ms. Jasmeet Seehra at

Turkish Prime Minister Recep Tayyip Erdogan Monday slammed France
for the approval of an Armenian ” genocide” bill by its parliament,
saying that “France was forcing the door of a very dangerous process
by trying to write history at parliament.”

The mission of parliaments was not to write history, Erdogan said
in an address to the nation, adding that Turkey is expecting French
people to raise their voices against this.

“Today, France is using the language of separatism, racism and clashes
and Sarkozy’s France was based on dogmas, prejudices and delusions,”
said Erdogan.

Noting that Turkey made its warnings to France beforehand and Turkey
proposed to leave this issue to historians and scientists, but Sarkozy
did not hesitate to crush European values just to gain a few thousand
more votes in the upcoming elections, said Erdogan.

Again he said that this bill, which was adopted at French Parliament
and Senate, is null and void for Turkey.

“We pursue our initiatives for French senators to apply to French
Constitutional Council against the bill,” added Erdogan.

Turkish government spokesman and Deputy Prime Minister Bulent Arinc
said Monday that Turkey was following developments regarding the bill.

The French Senate voted last Monday 127 to 86 in favor of the draft
bill after hours of debate, making it illegal to deny as ” genocide”
the killing of Armenians by Ottoman Turks in 1915. The bill, yet to
be signed by French President Nicolas Sarkozy, has been passed by the
French National Assembly, the lower house of parliament, on Dec. 22
last year.

In France, even if a bill has been approved by the Senate, it can
still be appealed to the constitutional court if a large number of
parliamentarians file for it. The decision lies with the court to
decide whether the bill is compatible with French law or not.

Lucia Moon, an Armenian born in Baku currently living in the US, may
represent Armenia at the Eurovision Song Contest 2012, PanArmenian
reports.

Lucia grew up in Baku in the late 1980s. She moved to the US in 1992.

Lucia graduated at the University of California, received a master~Rs
degree of the Chicago School of Professional Psychology. She sung for
the Yerevan Chorus in Los Angeles. She released the Lvitsa Album in
2005, awarded as The Best International Album at the Armenian Music
Awards the same year.

Lucia returned to Armenia in January. Her producer David Yondem
recommended she take part in the Eurovision Song Contest 2012.

At the latest meeting [on 24 January] dedicated to the settlement
of Nagornyy Karabakh dispute, presidents of Russia, Azerbaijan and
Armenia discussed the whole range of issues still pending agreement in
the context of draft basic principles for the settlement of Nagornyy
Karabakh issue. The presidents exchanged views on the most complicated
issues and arrived at a common conclusion about the need to continue
the work.

The Russian Federation as a state mediating the dispute and a
member of the OSCE Minsk Group together with the co-chairs from
France and the United States will continue its efforts to promote the
rapprochement between the parties. According to the leaders of Armenia
and Azerbaijan supported by President Dmitriy Medvedev, they reached
a common understanding of the fact that to enhance the progress
that had obviously been made they should not be maximalists. The
joint statement adopted by the presidents today also reflects the
willingness to accelerate the elaboration of basic principles to be
used at a later stage as a basis for a legally binding agreement.

Furthermore, the presidents for quite a long time were discussing
the compliance with the agreement reached right here, in Sochi,
almost a year ago, last March, when the presidents expressed their
interest in creating a mechanism for the investigation of incidents
along the ceasefire line.

At the end of that meeting last year the co-chairs of the OSCE Minsk
Group, including Russia, France and the USA, came up with a document
describing a mechanism for the investigation of incidents along the
ceasefire line. Such document was submitted to the presidents today.

They noted the work done and asked to continue it, bearing in mind
already the need to prescribe specific procedures for taking certain
actions to investigate incidents.

According to the joint statement, the presidents of Azerbaijan,
Armenia and Russia are also convinced that direct humanitarian,
cultural, educational and other contacts – contacts between people –
are essential to restore trust and to enhance it, as well as to create
the most favourable conditions for taking political decisions as well.

Baku and Yerevan asked Russia to initiate such contacts. President
Dmitriy Medvedev, of course, agreed. We have always been in favour of
such humanitarian relationships and will play our role of a mediator
in that area as well.

A week after France passed a bill making it a crime to deny the
Armenian genocide of 1915, a group of French senators has taken the
law to the Constitutional Council. Turkey welcomed the senators’ move.

A group of French senators has appealed to France’s Constitutional
Council to block a law that would punish anyone who denied the massacre
of 1.5 million Armenians between 1915 and 1917 by Ottoman Turks.

France has considered the massacre as genocide for some time, but
last week, the French Senate angered Turkey when it passed a law
criminalizing denial of the Armenian genocide.

On Tuesday, however, a group of left-wing senators said they had
collected enough signatures to force the measure to undergo a review
of its constitutionality. Sixty signatures are needed to bring a
law before the Constitutional Council. The senators said they had
collected over 70.

Law could be rejected

Turkish Prime Minister Recep Tayyip Erdogan praised the senators’ move.

“This move is in keeping with what we would expect from France. I
hope the Constitutional Council will do what is necessary,” Erdogan
was quoted as saying on the private NTV station.

When the law was passed on January 23, Erdogan called the measure
“discriminatory and racist.” Ankara cancelled all economic, political
and military meetings with Paris in response.

France’s Constitutional Council has up to a month to reach a decision
on the law’s constitutionality, which could result in a rejection of
the law.

As it currently stands, the law punishes deniers of the Armenian
genocide with up to a year in jail and a fine of 45,000 euros
($57,000).

ISTANBUL, Jan 31 (KUNA) — Turkish Prime Minister Recep Tayyip Erdogan
made strong warning to France, stressing that Turkey would not accept
the practice of manipulative policy to gain votes in the upcoming
French elections.

In his monthly televised speech, Erdogan expressed exasperation
over French Senate’s adopting a bill that criminalizes the denial of
Armenian genocide of 1915 during Ottoman rule.

“France forgot the part it played in the 1915 incidents, where it
provided support to criminal groups back then,” Erdogan noted.

He urged for opening the archives in order to prevent any forging or
“rewriting” of history.

“We do not intend to cover up anything. And, we are not against
shedding light on historical facts. However, we are against rewriting
history,” the Turkish Prime Minister further voiced out.

In his speech, Erdogan also highlighted the situation in Syria by
saying that “Turkey’s stance to what is happening in Syria stems
from humanitarian solidarity,” adding that his government would keep
supporting the Syrian people until all injustices were resolved.

Finally, he drew attention to the gravity of sectarianism in Iraq
and that all sectors should practices some self-control to achieve a

A number of politicians on Tuesday formally requested France’s
Constitutional Council to examine the planned law which would punish
anyone who denies that the 1915 massacre of Armenians by Ottoman
Turks was genocide.

Two separate groups, including Senators and members of the French
lower house of parliament, say they have gathered more than the
minimum 60 signatures necessary to ask the council to test the law’s
constitutionality.

“This is an atomic bomb for the Elysee [Sarkozy’s office] which
didn’t see it coming,” said deputy Lionel Tardy, who also claimed
that most of the signatories from the lower house were like him,
from Sarkozy’s UMP party.

The council must make a ruling on the matter within one month.

Turkey’s President Abdullah Gul and Prime Minister Recep Tayyip
Erdogan immediately welcomed the news.

“I hope the council will do what’s necessary,” said Erdogan, while
Gul said he was “not expecting the French from the very beginning to
let their country be overshadowed” by the genocide law.

A club dedicated to the life and work of Vladimir Putin has opened
in the Armenian capital Yerevan, immediately sparking a satirical
backlash from critics mocking Russia’s strongman.

Admirers of Putin opened the club in Yerevan as a venue where young
people can take part in discussions, watch films and read books about
the Russian premier, his homeland and his idea for a ‘Eurasian Union’
of ex-Soviet states.

“We decided to name the club Putin because he is the strongest leader
in the post-Soviet region,” its manager, Ararat Stepanian, told AFP.

“He interests us not only as a political leader but as a man — how
he spends his free time, the types of sports he plays. He is worthy
of respect,” Stepanian said after the launch.

The club is decorated with a huge portrait of the Russian premier and
a photo display following his career in politics, and its backers from
several youth organisations say that a network of similar venues will
open in other cities.

But a group of young Armenian Facebook users staged a satirical parody
of the club on Tuesday at the rival Cluboratoria in Yerevan.

They played the Russian anthem, toasted Putin with vodka and chanted
the slogan: “He leads us down the shining path, he gives us hope,
we are for Putin — forward!”

“People are outraged and are calling the club idiotic and shameful,”
one of the protest’s participants, Edgar Barseghian, told AFP.

“We want to say that we will not allow someone, as a result of their
political interests, to come out in the name of society and Armenian
youth and disgrace our country,” he said.

Moscow is Yerevan’s main economic and military partner, and the
Armenian parliament last year agreed a deal to allow Russia to maintain
a military base in the country until 2044.

agency: “I have no doubt that the constitutional council will
eventually make an appropriate decision.”

Foreign Minister Ahmet Davutoglu also hailed the French senators’
move, saying that with this step France embraced its own values.

An Armenian citizen has been sentenced in West Virginia for his role
in a health care scheme intended to defraud more than $4 million
from Medicare.

A federal judge in Charleston on Monday sentenced the 42-year-old
defendant, Sargis Tadevosyan, to six years in prison. He was found
guilty in November on felony charges of conspiracy to commit health
care fraud and aggravated identity theft.

According to the government, the charges stem from a scheme involving
“false front providers.” That involves a company posing as a Medicare
health care provider and unlawfully billing Medicare as a legitimate
service.

Investigators say they discovered seven false front providers
established in and around Charleston.

U.S. Attorney Booth Goodwin said Monday’s prison term was likely the
longest involving health care fraud in the state.
