The Constitutional Court recognized the article of the Penal Code that
permitted quashing the criminal case on the grounds of insufficient
evidence as anti-constitutional and invalid.

The Constitutional Court took the decision today by examining the
appeals filed by Armenian National Congress representative Karapet
Rubinyan and "Hanrapetutyun" (Republic) party leader Aram Sargsyan
through a written procedure.

After March 1, 2008, a criminal case had been brought up against
Karapet Rubinyan and Aram Sargsyan under the charges of usurping state
power and organizing mass disturbances, but both were off persecution
in December 2008 on the grounds of insufficient evidence through the
application of Part 2, Article 35 of the Penal Code.

Artak Zeynalyan, representative of Aram Sargsyan and Karapet Rubinyan,
told "A1+" that they are dealing with a hypothesis: If there is
no evidence, there is no guilt and the case must be quashed on the
grounds of innocence.

"We think there is no need for Article 35. It goes against Articles
18 and 21 of the Constitution," said Artak Zeynalyan and informed
that they were going to appeal to the Cassation Court with the demand
to reconsider the appeals by which the grounds for quashing the case
against those persons was still in effect.

IMF Completes Third Review Under Stand-By Arrangement for Armenia
and Approves $73.6 Million Disbursement

The Executive Board of the International Monetary Fund (IMF) today
completed the third review of Armenia’s economic performance under
a program supported by a Stand-ByArrangement (SBA). The decision
enables the immediate release of an amount equivalent toSDR 48.485
million (about US$73.6 million), bringing total disbursements so far
an amountequivalent to SDR 350.425 million (about US$532.2 million).

The Executive Board also approved a request for a waiver of
nonobservance of the end-December 2009 quantitative performance
criterion on the net domestic assets of the CentralBank of Armenia
(CBA).

The 28-month SBA was approved for an amount equivalent to a total
of SDR 368.0 million (about US$558.9 million) on March 6, 2009 (see
Press Release No.

09/68), with a total amount of access augmented to an amount equivalent
to SDR 533.6 million (about US$810.4 million) on June 22, 2009 (see
Press Release No. 09/228).

Following the Executive Board’s discussion on Armenia, Mr. Murilo
Portugal, Deputy Managing Director and Acting Chair, stated:

"Armenia’s performance under its Stand-By Arrangement with the Fund has
been strong, andthe economic recession appears to have bottomed out,
aided by supportive monetary and fiscal policies. The challenge remains
to support the fragile recovery, address externalvulnerabilities,
and advance a credible fiscal consolidation plan over the medium term.

"Fiscal policy aims to continue to support the recovery, while
gradually starting fiscal consolidation in 2010. Social spending will
be protected. The authorities are committed to make good progress on
the reforms in tax policy and administration, as well as on public
expenditure and debt management.

"Monetary policy aims to move from an accommodative to a more neutral
stance, in order to head off potential inflation pressures. The
authorities are committed to a flexible exchange rate regime, and
aim to strengthen the monetary transmission mechanism to enhance the

effectiveness of monetary instruments, as well as improve the central
bank’s communication strategy.

"The financial sector remains sound and well capitalized, and
the authorities have strengthened their crisis preparedness and

reforms to enhance productive capacity and promote long-term growth
through an open trade regime, an improved business environment,

Today in Armenia, a presentation of the results of the study "Child
trafficking in Armenia" was held. Head of EU delegation, Raul de
Lyutsenberger noted that this study may be a good basis for the
Armenian authorities to formulate legislation and to further better
the existing legislation aimed at protecting children’s rights.

The study was carried out in October-December 2009 in 1200 households.

It polled 800 children from 5 regions for awareness about trafficking.

Among adults, the level of awareness is higher than among children.

More aware are girls than boys, wealthy families know more about
trafficking. 64.2% of students of grades 9-11 are aware of the
trafficking, said the study author Mira Antonyan.

About 60% said they were not afraid of trafficking, and it shows
our vulnerability. "They are even willing to send their children to
work outside their village, in case of a salary and normal working
conditions", says Antonyan. The study did not identify instances
of trafficking.

The project is financed by the European Union and the Czech government,
which allocated 448 454 Euros, 90% of which gave the EU.

with His Holiness Catholicos Aram I on March 25 The parties discussed
projects aiming at strengthening Armenia-Diaspora Relationships,
and advocating for the rights of the Armenian people in demanding
the recognition of the Armenian Genocide.

The following morning His Holiness Aram I received the Minister of
Diaspora of Armenia Mrs. Heranoush Hagopyan, accompanied by the
Ambassador of Armenia to Lebanon Ashot Kotcharyan. The Minister
discussed with His Holiness Armenia-Diaspora relations and specific
issues connected with her Ministry in the Republic of Armenia.

There are no monetary prerequisites for the devaluation of the dram,
said the former head of the Central Bank of Armenia Bagrat Asatryan.

He believes that under normal policy, dollar will not grow so quickly.

Bagrat Asatryan notes that there is a public expectation of
devaluation of the dram, because it does not trust the financial and
economic policy of the government, which leads to inflation. This was
facilitated by the gas price hike, which, according to the economist,
is an administrative decision. Bagrat Asatryan believes that in order
to stop the devaluation of the dram, CB will try to reduce the amount
of the dram in the market, and will hinder the economic development.

Devaluation of the dram is one of the reasons of the "escape" of the
capital of Armenia, as well as economic monopolies.

RA First President Levon Ter-Petrosyan, chairman of the People’s Party
of Armenia Stepan Demirchyan, chairman of "Hanrapetutyun" Party Aram
Sargsyan and others will speak at the rally to be held by the Armenian
National Congress at the Matenadaran on April 6 at 6 p.m.

The rally will be followed by a march that will end at Northern Avenue.

ANC press correspondent Arman Musinyan told "A1+" that the speeches
will be about the regime’s failed policies, social tension, inflation,
ongoing violations of human rights and political prisoners.

The ANC is certain that the current regime will once again use
administrative levers and repressive methods to impede the rally. With
that in mind, as always, the authorities will once again close down
roads, take out routes and set limits on people’s right to move freely.

According to Arman Musinyan, the regime has no alternative methods
of fighting against the opposition.

Musinyan informed that the ANC’s regional structures are active.

"The advocacy materials are ready and the region structures are
actively working on organizing the rally," said Arman Musinyan.

chaired by RA prime minister Tigran Sargsyan, coordinating cooperation
between Armenia and the EU was held in Yerevan, press office of the
RA government reported.

The Minister of Economy Nerses Yeritsyan made a report on the
implementation of measures ensuring the Armenia-EU Action plan for
2009-2011 in frames of European Neighborhood Policy.

RA Deputy Foreign Minister Karine Ghazinyan reported that the Italian
government submitted a proposal to expand bilateral cooperation
in frames of Eastern Partnership. Meeting participants identified
priority areas, in particular, SME development, energy, environment
and emergency situations.

Primary tasks aimed at development of state administrative bodies
were approved, as well as the schedule for preliminary talks on free
trade agreement between Armenia and the EU.

The meeting endorsed the National Indicative Program for 2011-2013,
discussed partnerships in frames of SIGMA, Twinning, TAIEX.

I heard about the Armenian genocide for the first time in Paris
during the 70s, and the very logical question I asked myself and also
expressed in my writing at that time (university papers, a reader’s
letter I sent to Le Monde newspaper, etc.) was the following: if the
Republic of Turkey is based on a rejection of the Ottoman Empire, then
why is the 1915 Armenian genocide not being dumped on the Ottomans?

Why is the Turkish Republic assuming responsibility for this scandalous
event, which is the 20th century’s first crime against humanity and
that century’s first genocide? Later, in my career as a journalist,
this question always remained on my agenda.

I am generally known as the journalist who explained Armenian terrorism
(ASALA) to Turkey during the years 1980 – 1984. I was a socialist,
but I was also opposed to terrorism, and my articles even lead to a
deterioration of relations between Francois Mitterrand’s socialist
government (which I supported) and Turkey.

Both myself and my family and friends suffered a lot from ASALA:
my friend Nazan Erez’s father, Turkey’s Ambassador to France Ismail
Erez was killed on duty in Paris; my friend Gokberk Ergenekon was
wounded in Rome; my name was put on ASALA’s hit list and removed only
after I met with ASALA’s then lawyer Patrick Devedjian, who is now
France’s Minister in charge of the Economic Recovery Plan (in 1982,
I did not see these events as genocide, but I did not accept Turkey’s
official version either); my cousin Sitki Sencer was caught up in
the shooting during ASALA’S attack on the Ankara Esenboga airport
and was shot 8 times by Turkish policemen (miraculously, he survived)
whereas my mother and her sisters, also present, came away uninjured
by the skin of their teeth.

In reality, the list is much longer, but the purpose in my mentioning
these is to indicate that I have worked a lot on the Armenian question,
I know quite a lot about it and I have suffered because of it,
and therefore I have the moral right to say the things I’m about
to say. In other words, the things I say here are the conclusions
an intellectual has reached after 35 years of engagement with this
issue and after repeated reassessments of his position.

If we go to the beginning… as the years passed, my reading
progressed and new documents and books came out, it was revealed
that the question I have been asking (to blame the genocide on the
Ottomans) was the product of sophistry and devoid of any meaning,
due to at least three reasons.

Firstly, even though Mustafa Kemal did not get along with the
triumvirate of Talat-Enver-Cemal and he did not take any part in the
Armenian genocide on account of being engaged in the fighting on the
Gallipoli front at the time (in a sense, these helped him be later
designated a leader), the genocide that had already been accomplished
served him very well structurally, because he based the Republican
regime on the Turkish race. During the years 1926 – 1927, discourse
on the Turkish race constituted the principal nationalist ideology of
the State (Turkish race = Turkish nation), and therefore Anatolia had
to be ‘cleansed’ of all Christian and foreign elements (Armenians,
Greeks, Assyrians and Kurds). These policies of ethnic, cultural,
economic and social cleansing were actively implemented through seven
genocides executive during the Republican period. No Armenians,
no Greeks and no Assyrians were left in Anatolia. Only the Kurds
resisted, and despite four genocides, they could not be exterminated.

Just for this reason, every person in Turkey must respect the
Kurds’ struggle for their lives and their rights. Thus, there was
a continuity inherited from the Ottomans with regards to ‘Massive
Annihilation’. In 95 years, 10 genocides were carried out on these
lands (see the archives at ). Among the founders
of the Republic, there were murderers who had been involved in,
organized and implemented the Armenian genocide.

Secondly, there is another line of continuity from the Ottomans to the
Republic, as money and goods confiscated from the Armenians played a
determining role in the financing of the War of Independence. Apart
from monetary and weapons help received from Lenin, the biggest
financial source for the War of Independence was money appropriated
through the Armenian genocide. With this money, weapons were purchased,
an army was set up and its logistics provided. The persons involved
in these came to form a new social class that owed its wealth to
the Armenians’ property (for instance, the porter Haci Omer Sabanci
is the ancestor of today’s Sabanci family, and grocer Vehbi Koc the
progenitor of today’s Koc family), and thus the social bases of the
movement emerged.

The reasons for the Armenian genocide becoming a taboo are hidden in
these three observations. Otherwise, it would have been very easy
to solve the problem by putting the blame for the genocide on the
Ottomans. The person who put these issues on the agenda by producing
major works that influenced Turkish intellectuals on the matter of
the Armenian genocide is Taner Akcam.

Because of the reasons I have enumerated, whenever the expression
‘Armenian genocide’ is uttered, people lacking good sense in Turkey
go berserk. What I’m saying here is that, unlike the official history
thesis, the Turkish Republic was not founded after an anti-imperialist
war (in the War of Independence, the Army only fought against the
Greeks, but not against France or England, which were the imperialist
powers of the era), rather, it was founded on the Armenian genocide.

This reappraisal means that what you and everyone have been told and
taught would be sent to the trash bin. This is the real reason why
there is a big trauma whenever anybody says ‘Armenian genocide’.

Everything has been a lie since 1923. In other words, the situation
is not as simple as the state hiding the reality of the genocide,
as certain intellectuals are now saying.

Today, when one talks about recognizing the Armenian genocide,
practically everything has to be put on the table: the Republic,
Kemalism, the State, the State’s ideology, those who founded and
governed the Republic, Turkey’s regime, this country’s political
system, its army, its universities, its educational programs, its
press, its elite, its businessmen (the sources of certain capital
accumulations), the courts, the political parties, etc.

It is self-evident that no one can cope with such a gigantic
confrontation. Especially in the kind of crypto-fascist and
crypto-totalitarian regime where we are living, it is very difficult –
not to say impossible – to settle accounts with the things enumerated
above even in one’s dreams!

This traumatic situation, in its historical, political and intellectual
dimensions, goes miles and miles beyond the capacity of our current
Islamist government. Nothing can be accomplished with the protocols
signed between Turkey and Armenia. In any event, didn’t the invisible
forces in Ankara make the Armenia Protocols null and void within 24
hours, and through the very hand of the Prime Minister? This State,
in its current structure, will repulse any solution, as there is no
solution that it could accept.

The problem can be solved – like the other problems of the country
– only by a statesman with the highest intellectual credentials,
who has internalized the culture of democracy, come to power through
elections and formed public opinion in this direction. It is impossible
for ordinary small persons to overcome Turkey’s gigantic problems. We
need politicians and statesmen on the level of Mitterrand, Allende and
[Felipe] Gonzales in order to resolve these gangrenous problems. In
other words, we need Big Men.

April 2 will mark 8 years since the shutdown of "A1+" TV.

Surveys have shown that television viewers still remember and long
for their beloved channel.

No matter how much they see the absence of "A1+" among the variety
of television channels, they doubt that the "A1+" TV will ever be on
air again.

"They won’t allow it because "A1+" tells the truth-something which,
according to them, the people don’t need," said Mrs. Varduhi. Gagik
is sure that if "A1+" was allowed to be back on air, it would have
been back by now. "Something is standing in the way."

"If "A1+" was on air, would they be able to implement "March 1"
and kill 10 people? They were free and weren’t afraid of their acts
because there was no television channel that would show all that,"
said one survey participant, Heghine.

Another participant, Armen, says this time the RA government will meet
the demands of international organizations. "I think the government
will allow "A1+" to be back on air. Before it was different. Times
have changed and it is time for "A1+" to be back on air," said Armen.

Let us remind that in early March, the CE Council of Ministers took
note of the RA Government’s information that a tender will be held
in Armenia in July and "A1+" may have the opportunity to participate
in the tender.

Among surveyees were citizens who mentioned that they have felt
the need for "A1+" throughout the past eight years and have been
following-up on the flow of news provided by "A1+".
