SARGSYAN: CURRENT STAGE OF KARABAKH SETTLEMENT GIVES HOPE FOR ITS DECISION WITHIN FAIR DATES

YEREVAN, November 30. / ARKA /. The current phase of the Karabakh
settlement offers hope to reach its decision within a reasonable time,
President of Armenia, Chairman of the Republican Party of Armenia
Serzh Sargsyan said on Saturday.

"It is clear to any sensible person that a conflict resolution is an
extremely complex process, and the decision could take years. However,
the current stage of the hope promises that within a reasonable time
this may be taken to its logical end," Serzh Sargsyan said at the
congress of the RPA.

As the president believes, unequivocally, that conflicts are long-term
and stable solution only if based on fair and reasonable concessions.

"Gone are the days of colonization of the peoples living on their own
land. We have publicly stated that the Karabakh settlement should
be based on the decision and the will of the people of Karabakh,
as a society, reflecting the common will. Only in this case, the
solution can be productive, long-term, achievable, and peaceful,
" Sargsyan said.

According to the head of state, in this case all parties of the
Karabakh conflict an agreement should be reached around a single
package that will contain all matters and all internationally enshrined
mechanisms that provide a solution to this conflict.

The beginning of the Karabakh conflict was settled in 1988, following
a statement to withdraw from Azerbaijan by the predominantly
Armenian-populated Nagorno-Karabakh. On December 10, 1991 there was
held a referendum in Nagorno-Karabakh, in which 99.89% voted for full
independence from Azerbaijan.

Following that Azerbaijan initiated large-scale war fares that led
to a loss of control not only over Nagorno-Karabakh but also seven
adjacent districts.

>From 12th of May of 1994, after the entry of the tripartite agreement
on truce in the conflict zone hostilities, in which around 25-30
thousand people were killed from both sides and nearly 1 million were
forced to flee their homes, were ceased.

The agreement on the establishment of the ceasefire has been followed
until now. From 1992 to date, negotiations are being held for a
peaceful settlement of the conflict within the OSCE Minsk Group
co-chaired by the United States, Russia and France.

Open letter to Peter Semneby, EU Special Representative to the South
Caucasus countries, from the "Yerkir" Union of NGOs for Repatriation
and Settlement

Dear Mr. Semneby,

In the interview published in the Russian daily newspaper "Vremya
Novostey" on November 2, 2009 you, among other issues, touched upon
the problems of ethnic minorities of Georgia and, in that context, the
problems of the Javakheti Armenians, making the following observation:
‘The issues of national minorities in Georgia are important. We must
pay more attention to them, than we – on our part, and the Georgian
authorities – on theirs used to. This is a difficult issue. … The
problems there are largely social; those are problems of economic
development."

The very fact of your statement can be considered as positive,
even if it is only viewed from the standpoint of public recognition
of the existing problem by such a high-ranking official of the
European Union. However, to what extent does it reflect the real
situation, reducing the problems of Javakheti Armenians to only their
socio-economic component?

Of course, the socio-economic component is present in the complex of
the problems of the Javakheti Armenians, but it does not occupy the
central and decisive position. The Armenian population of Georgia,
and the part, compactly inhabiting the south-western regions of the
country in particular, suffers from violation of their political,
civil, cultural, educational and religious rights, the rights that
are guaranteed by numerous international obligations undertaken by
Georgia and aimed at protection of ethnic minorities.

The main problems facing the Georgian and the Javakheti Armenians can
be summed up as follows: The Armenian population is disproportionately
represented in the administrative and governing bodies of the regions
of their compact residence; The Georgian authorities impose mandatory
legislative and administrative measures to compel the minorities in
the places of their compact residence to use exclusively the Georgian
language in all spheres of public life, although the vast majority
of the Javakheti Armenians by objective circumstances do not speak
the language of the titular nation; The Armenian Apostolic Church in
Georgia has no legal status, and the Georgian authorities refuse to
return to it the Armenian temples, confiscated during the Soviet era.

The very fact that you avoided mentioning in your interview
the existence of these issues, which are far from being only
socio-economic, becomes even more bizarre, considering the fact that
numerous reputable international organizations have addressed the
issue of discriminatory policy implemented by the Georgian authorities
towards the ethnic minorities in Georgia.

Thus, for example, the UN Human Rights Committee in its recommendations
adopted on October 16, 2007, proposes that the Georgian authorities
take steps to ensure freedom and equality of religion. The Committee
recommends that the Georgian authorities solve the problem of
restitution of the property, confiscated during the Soviet era to the
religious minorities. The Committee, expressing concern about the low
level of political representation of minorities, suggests that the
Georgian authorities implement measures to eliminate discrimination on
the basis of language. To this end, the Committee proposes to consider
the possibility of allowing minorities to use their own language
at the level of local government and administration and to take all
appropriate measures to ensure adequate political representation and
political participation of ethnic minorities.

Serious shortcomings regarding the compliance of Georgia with
the European Framework Convention for the Protection of National
Minorities were reflected in the report submitted in spring 2009
by the Advisory Committee of the Council of Europe. The Advisory
Committee recommends that the Georgian authorities make sure that the
policy of promoting the Georgian language is not detrimental to the
right of using the minority languages, mentioning that this requires
more resolute measures reflected both in law and in practice. The
experts of the Council of Europe, noting that national minorities
are underrepresented in the country’s political, cultural, social and
economic life, recommend that the Georgian authorities take vigorous
measures to remove legislative and practical obstacles the national
minorities come across, so that they can participate in the elected
bodies and in the executive, and work in the public service.

In addition to the above, authoritative international organizations
in 2005-2009, the Public Defender of Georgia, a number of Western
countries and international organizations in their respective reports
and statements touched upon the various manifestations of the policy
of violation of the rights of the Armenian minority of Georgia,
expressing their concern about these facts.

The President of Armenia Serzh Sargsyan in his speech on September
1, 2009 also addressed the issues of concern of the Georgian and
Javakheti Armenians stating in particular that the logic of the
policy towards Javakhk should rest on the premise of "integration
without assimilation", and that the recognition of the Armenian as a
regional language, the registration of the Armenian Apostolic Church,
the steps undertaken to protect the Armenian monuments in Georgia
will only strengthen the Armenian-Georgian friendship and enhance
the atmosphere of mutual trust and understanding.

However, the Georgian authorities ignore the recommendations of the
international community and continue implementing a discriminatory
policy towards the Javakheti Armenians. Moreover, in recent years this
policy has achieved the level of repressions against the Javakheti
political activists through law enforcement agencies and judicial
authorities. During the period of 2007-2009 as a result of direct
and indirect pressure from the power structures of Georgia dozens
of political activists emigrated from Javakheti, many were tried for
fabricated criminal charges, some of them ‘bought’ their freedom at
the cost of admission of guilt in their alleged ‘crimes’, others were
tried in absentia and sentenced to various prison terms.

On July 21, 2008 the Georgian Special Forces stormed the house and the
office of the prominent Javakheti political activist Vahagn Chakhalyan,
‘found’ weapons there and on this basis immediately arrested him
as well as his father and his under-age brother. Later on Vahagn
Chakhalyan was charged with ‘organizing and active participation in
activities that disrupt public order’ and ‘hooliganism’- charges
solely based on his political activities in 2005-2006, when the
Armenian population through demonstrations and protests put forth
their legitimate claims to honor their linguistic and educational,
socio-cultural and religious rights.

On April 7, 2009, as a result of proceedings accompanied by flagrant
violations, the Javakheti political activist was sentenced to 10
years’ imprisonment in the Court of First Instance. On October 30,
2009 the Court of Appeals upheld the verdict intact.

This retaliatory act by the Georgian authorities against Vahagn
Chakhalyan has caused wide public resonance in Armenia and in the
Diaspora. A number of Armenian non-governmental organizations,
international human rights institutions, European parliamentarians
have adopted statements and taken other steps aimed at protection
of the rights of the Javakheti Armenian activist. On April 14, 2009
the Coordination Council of Armenian Organizations of France held a
protest demonstration before the Georgian Embassy in Paris against
this unjust sentence; two days after this action Vahagn Chakhalyan
was severely beaten in prison.

Meanwhile, Georgia is a member of the ‘The European Neighborhood
Policy’ and ‘Eastern Partnership" EU programs and through them the
country receives substantial financial assistance. At the same time
Georgia openly violates the basic human rights and the rights of ethnic
minorities. Under the circumstances, by ignoring the existing problems
the EU actually authorizes the Georgian authorities to continue their
discriminatory policy towards their ethnic minorities, authorizes new
manifestations of police repressions in the Armenian-populated areas,
and authorizes new irresponsible acts that deepen day by day the
mood of fear, frustration and alienation in the Armenian-populated
regions of Georgia. Thus, the European Union involuntarily assumes
the role of an accomplice of the Georgian authorities, sharing the
responsibility for a possible aggravation of the situation.

Dear Mr. Semneby,

Based on abovementioned facts, we call upon You to take more
decisive and effective stance in this issue in order to ‘explain’
to the Georgian authorities that the communication with the Armenian
citizens of their country from the position of rude force, police
repression and deprivation of rights leads to a deadlock, and only
through recognition, effective protection and enjoyment of fundamental
rights and freedoms of individuals and minorities, as well as the
actual planting of democratic procedures is it possible to create
stable guarantees for the development of the country.

We firmly believe, that only by exercising principled position with
respect to these issues is it possible to help the Georgian authorities
in creating a functioning democratic system, which will be the real
guarantee of stability for the country and the entire South Caucasus
region as a whole.

"Our yes is yes, our no is no", on November 28, at the Republican
Congress said the RP leader Serge Sargsyan perhaps proceeding from the
fear that during the latest months the governmental yes and no have
been confused a little. Serge Sargsyan’s speech was in fact aimed at
dispersing the doubts present within the Republican Party, as well as
at calming them don and convincing them that the RP not only will not
cede its positions but will also pass from its "political leadership"
to "socio-political leadership".

Serge Sargsyan seemed to use the RP platform to address a speech
not to the RP members but to the RA citizens dwelling on issues
concerning them. While, Serge Sargsyan has just slightly touched
upon issues really worrying the society. For instance, with regards
to the economic crisis, Serge Sargsyan only said that the citizens
felt its impact less than presumed proceeding from macro-economic
indexes. Of course, it is always possible to suppose something bad
proceeding from indexes and to say after that the supposition did not
correspond to the reality which came out to be better. No word about
the governmental economic policy, the president’s opinions on it,
necessary improvements, the process of reformation, the question on
oligopoly in Armenia and the formation of a competitive field.

Moreover, Serge Sargsyan not only did not say a single word in this
connection, relating to the business-government connection and fight
against its consequences, as well as against corruption but even
honored the oligarchs which according to him, helped the government to
ease the impact of the economic crisis on the society. It is notable
here that in front of the Republican Party, Serge Sargsyan in fact
expressed his support related to the oligarchs and opposed the prime
minister Tigran Sargsyan who on these days became an RP member and
continuously dwells on the necessary struggle against oligarchs.

Maybe, this is the reason why Serge Sargsyan opposes the prime minister
to assure the RP members that Tigran Sargsyan did not join the party
as a troop but as a soldier.

Serge Sargsyan did not say anything persuasive for the public besides
his statement that the 2010 budget will be more than the 2009 one.

While this is more worrying news for the society. The point is
that the society knows very well that big budget means many taxes
which are squeezed from the society itself because the oligarchs
as usual will have the mission not to pay taxes but to preserve job
posts. In addition, the budget will increase no only on account of
paid taxes but also debts, in other words, loans which Armenia takes
from international organizations. And these debts are to be again
paid by the society.

So from this point too, if Serge Sargsyan wants it to be good, it comes
again out to be as usual. And once again no word about the level of
legitimacy in the country, the elimination of privileged sphere, the
behavior of the elite. Under these conditions, the RP call to become a
"socio-political leader" from a "political leader" seems even a threat.

President Serzh Sargsyan, during the Republican Party of Armenia
convention on Saturday, in stating that those who blame him for handing
over Nagorno-Karabakh wish to see the Republic of Nagorno-Karabakh
as part of Azerbaijan, meant those "who don’t have political
responsibility and courage to carry out the people’s will until
the end." This opinion was expressed by Republican Party of Armenia
parliamentary faction secretary Eduard Sharmazanov while speaking to
journalists today.

"We all remember who didn’t have responsibility, who refrained, and who
on March 5, 1992, said to Komsomolskaya Pravda that Nagorno-Karabakh
must be part of Azerbaijan," stated Sharmazanov.

Upon journalists’ request to name the individual he was referring
to, Sharmazanov replied that Armenia’s first president, currently
the leader of the Armenian National Congress, Levon Ter-Petrossian,
had given an interview to the Russian paper Komsomolskaya Pravda.

Armenian Prime Minister Tigran Sargsyan’s political bearing as
of late testifies to the fact that he intends to create a separate
political bloc, said Heritage Party MP Stepan Safaryan during a press
conference today.

According to Safaryan, the government leader’s projects could’ve been
carried out if governing authorities had allowed him to do so. As
recently reported by Tert.am, the Republican Party of Armenia recently
welcomed Tigran Sargsyan into its ranks.

Safaryan also added that a widely held public opinion stated that it
was the Republican Party of Armenia itself that had appealed to Tigran
Sargsyan to join its party (prior to that, the prime minister did not
belong to any political party). According to Safaryan, the formation
of a new political party by the prime minister could become a problem
for the governing authorities. For that reason, they made the best
possible decision to recruit RA Prime Minister Tigran Sargsyan as a
Republican Party of Armenia member.

Also participating in the press conference was governing party MP
Karen Avagyan who refuted such allegations. According to Avagyan, the
Republican Party of Armenia never appealed to anyone with the request
of joining its ranks. In Avagyan’s words, it’s not appropriate to seek
"sharp corners" in this issue.

Avagyan also stated that there’s nothing unusual about the fact that
certain members of the government have become members of the Republican
Party of Armenia.

During last Saturday’s Republican Party of Armenia convention,
Heritage Party MP Stepan Safaryan came to the conclusion that the
country’s governing leaders are handing over all their power to a
single political party.

For comparison purposes, Safaryan provided the example of Republic of
Armenia’s second president, Robert Kocharian, who had a few players
in the political arena. "The country’s acting president has other
preferences entirely."

In Safaryan’s words, from the beginning, Sargsyan had ruled out the
claim for another political bloc. With this, as noted by the MP,
the country’s political matrix doesn’t change. As for the opposition,
meaning, the Heritage Party and Armenian National Congress, Safaryan
is not of the opinion that "the opposition will appear as an united
front."

A photography exhibit titled "Famous Armenians Against AIDS," which
will showcase work by Karen Grigoryan, will open on December 1 in
Yervan’s Moscow Cinema.

This event dedicated to the fight against AIDS, conceived by journalist
Mher Baghdasaryan, includes photographs of 40 famous Armenian
individuals from different walks of life, including well-known
entertainers such as Shushan Petrosyan, Andre, Erik, Mari Aksel,
Noor and many others.

After the exhibit’s opening ceremony, free condoms and information
booklets will be distributed to attendees. The event will then
continue at KAMI Club, where Armenia’s only known female DJ, Vaksina,
will spin at the NO AIDS event.

The NO AIDS initiative is supported by UNAIDS (joint United Nations
programme on HIV/AIDS) and the NGO SAMSA (Scientific Association of
Medical Students of Armenia).

World AIDS Day is observed every year on December 1. This year’s
theme is Universal Access and Human Rights. Other initiatives to
mark this day in Armenia include an event organized by PINK Armenia
(Public Information and Need of Knowledge) titled "Stop the Counter"
on December 1 from 4 to 7 pm near Komitas’ statue at the intersection
of Sayat-Nova and Mastots streets (near Opera) in Yerevan.

The Ministry of Foreign Affairs of the Nagorno Karabakh Republic
has forwarded the text of the November 25, 2009 statement of the NKR
National Assembly to the OSCE Secretariat for distributing it among
the participants of the meeting of the OSCE Foreign Ministers to be
held on December 1-2 in Athens.

A corresponding letter was sent also to OSCE Chairman-in-Office George
Papandreou, and a copy of it – to Personal Representative of the OSCE
Chairman-in-Office Ambassador Andrzej Kasprzyk.

The statement was adopted by the NKR National Assembly due to
the aggressive policy of official Baku in the process of the
Azerbaijani-Karabakh conflict settlement.

Hayastan Fund is pleased to announce the successful completion of
the Telethon 2009

Today, at 8am local Armenian time, Hayastan All Armenian Fund concluded
its 12th annual Telethon – a twelve hour non stop live broadcast from
Los Angeles, CA. Summing up the results of a year long effort, which
included a whole range of fundraising activities, the Fund announced
a total of 15,875,043 USD in donations and pledges.

The collected funds will be directed at the realization of a variety
of social and economic infrastructure projects in the town of Shushi.

Through building new roads, schools, rehabilitating water mains and
restoring apartment buildings, the Fund will launch the process of the
revival of the historic Armenian town. Parallel to these projects,
the Fund will continue its rural development effort which reaches
out to the villages of Armenia and Artsakh.

One of the key fundraising events preceding the annual Telethon was
the fundraising gala in Mosvow where Russian Armenian businessmen
made their contributions – 5,290,000 USD – which were reflected in
the final results of this year’s all Armenian fundraiser.

Another important fundraising event on the eve of the Telethon was
the annual pan European phoneathon. The results of Phoneathon 2009
were 1,800,000 USD in donations and pledges: a 10 percent increase
from the 1,5mln USD collected in 2008. More than 12,400 Armenian
families from all over Europe participated in this year’s Phoneathon.

This year’s fundraising effort was unprecedented in terms of the
number of people who participated and decided to have their input
in tackling the challenge of rebuilding Shushi. The participation of
residents of Armenia was especially impressive with more than 20,000
people making their donations in the period leading to the annual
Telethon. More than 13,000 people made their donations in their
local post offices. Others used their mobile phones in an innovative
fundraising effort that the Fund brought together in association with
Viva Cell MTS mobile operator.

The fundraising activities in Armenia and Artsakh continue. The results
of this year-s fundraising effort will be finalized at the end of
the year when the Fund will sum up all the donations and publish the
names of the benefactors.

Inhabitants of Artsakh show concerned participation in nationwide
fund-raising initiated by "Hayastan" All-Armenian Fund. They actively
involved in the action as early as from November 18. As informed from
the coordinating republican headquarters, during the passed week to
the corresponding account of the fund 7mln 202 thousand and 266 drams
were transferred. By November 26, the size of the declared sum formed
119 mln drams.

The fund-raising in Artsakh will go on. In future as well benefactors
may make any desired payments.

Donated funds will be directed at Shoushi restoration programmes.
