Scientific Conference Devoted To The 60th Enniversary Of Repatriatio

SCIENTIFIC CONFERENCE DEVOTED TO THE 60TH ENNIVERSARY OF REPATRIATION IN 1946-1948

On December 13-14 by the initiative of the RA Ministry of Diaspora,
the Institute of Science (RA Academy of science) and "Noravank"
foundation was held an international scientific conference in
Tsakhkadzor on the subject "Repatriation of 1946-1948 and its lessons:
the problem of repatriation today" devoted to the 60th anniversary
of mass repatriation of late forties of the last century.

At the conference reports were made by famous scientists and social
figures from Armenia and Diaspora such as Amatuni Virabyan, Ashot
Melkonyan, Edward Melkonyan, Petros Hovhannisyan, Yuri Avetisyan,
Harutyun Marutyan ("Noravank" Foundation), Gevorg Yazichyan, Khachik
Ter-Ghukasyan (Argentina), Rubina Pirumyan (USA), Alber Achemyan
(Iran), Varvara Margaryan (RF) and others. The repatriates of 1946-1948
and the ones of our days shared with their memories. The Minister of
the RA Diaspora also made a report.

Reports and discussions were touching upon the issues of historical
comprehension of mass repatriation of 1946-1948, mistakes made during
repatriation; significance and consequences of Repatriation for
Armeniancy; historiography, geography and demography of Repatriation;
the role of Armenian Apostolic Church, All-Armenian Charity Union
and traditional Armenia parties (ARFD, "Ramkavar-Azatakan,"
and so cial-political party "Hnchak"); Stalin’s repressions
towards repatriates; adaptation and integration of repatriates
into the Armenian society etc. Reports and discussions connected
with up-to-datedness were devoted to tendencies and problems of
repatriation in the present day Diaspora; publications on the
subject repatriations in the press of Diaspora; integration of the
Armenians from Diaspora into Armenia; problems of easter-Armenian
and western-Armenian languages; legal groundings of repatriation;
policy of the RA towards stimulating repatriation; Israeli experience
of repatriation and absorption and other actual problems.

A Conference On The Karabakhi Issue Took Place In Berlin

A CONFERENCE ON THE KARABAKHI ISSUE TOOK PLACE IN BERLIN

Recently, a conference on "The variants of the Nagorno Karabakh
conflict settlement from the Azerbaijani viewpoint" had taken place
at the Conrad Adenauer Foundation’s office in Berlin.

Elhan Nuriev, director of the Center of Strategic Sciences under the
Azerbaijani President and Johannes Rau, member of the International
Security Forum under the German Military Academy were invited to
have speeches.

NKR Permanent Representative in Germany Gayane Apinyan and Ambassador
of Azerbaijan in Germany Parviz Shahbazov also partook in the
conference, held by senior officer of the Conrad Adenauer Foundation
Peter Hefele.

The Azerbaijani representative developed his speech in the
context of the Azerbaijani territorial integrity and threat of
the Karabakh conflict settlement by force. In response, officer of
the German International Institute on Security Issues Uwe Halbach
and representative of the Union of the Christian-Democratic and
Christian-Social Parties in the Council of Europe Rayner Dornzaifer
noted that they treated the Azerbaijani territorial integrity with
understanding; however the existing new realities and facts should
be taken into account in solving the conflict. Uwe Halbach added that
the demand of territorial integrity is not absolute and sometimes not
realistic, exemplifying Georgia. Rayner Dornzaifer advised Azerbaijan
to learn a lesson from the history of Germany that, according to
him, after the World War II had to accept the existing reality, thus
guaranteeing peace and security in Europe. He expressed confidence
that in case of refusing the territorial integrity, Azerbaijan will
contribute to the peaceful settlement of the conflict and together
with Armenia will be given great assistance from the Council of Europe
for liquidating the consequences of the conflict.

In response to Nuriev’s threatening to solve the Karabakhi issue by
use of force, Gayane Apinyan in her turn reminded how many people from
both sides sacrificed during the previous war and in what unfavorable
conditions the people of Nagorno Karabakh managed to uphold their
natural right to liberty.

"Today, in spite of Azerbaijan’s furious armament, Nagorno Karabakh,
due to its high state orderliness, is incomparably stronger and is
ready to defend its independence", she said.

Gayane Apinyan advised the Azerbaijani representatives to refuse the
revanchist aspirations and respect the right of the people of Nagorno
Karabakh to independent existence.

Law Against Raffi Hovannisian

The Heritage Party thinks that the bill on Yerevan which establishes
the procedure of election of the mayor of Yerevan seems to be made
to measure and against someone definite. This person, according to
the Heritage Party, is the leader of the party Raffi Hovannisian. In
addition, the chair of the board of the party Anahit Bakshiyan and the
leader of the faction Armen Martirosyan who held a news conference
on December 25 at the Hayatsk press club said even the members of
the parliament majority admit in private talks that the law was made
to prevent Raffi Hovannisian from running in the election of mayor
of Yerevan.

The point is that according to the bill the council of Yerevan is
elected under a proportionate system, the force which gets majority of
votes elects the first on its ticket as mayor. The problem is that the
bill does not allow a member of parliament to run in the election to
the council. In other words, Raffi Hovannisian cannot become member of
the council to become mayor, if the Heritage Party wins the election to
council. In order to become, Hovannisian must resign from parliament.

Does Raffi Hovannisian wish to be mayor? Armen Martirosyan and Anahit
Bakshiyan did not answer this question. They said this question should
be asked to Raffi Hovannisian but they said the Heritage Party will
run in the election to the mayor of Yerevan.

Europe Reacts Strongly Against Turkish Deputy’s Remarks On President

EUROPE REACTS STRONGLY AGAINST TURKISH DEPUTY’S REMARKS ON PRESIDENT ABDULLAH GUL’S ANCESTRY

Europe has reacted strongly against Republican People’s Party (CHP)
deputy Canan Aritman’s remarks on President Abdullah Gul’s ancestry.

European deputies think that she either has to apologize or resign.

As the Turkish newspaper Today’s Zaman says, Hannes Swoboda, the Vice
Chairman for Socialist Group said Aritman’s assertion was uttered in a
"racist fasion." Swoboda said, "First of all, the question is whether
it is true or not; I mean, does President Gul have Armenian blood? But
even if it is true that President Gul has Armenian blood in his veins,
this is not an argument at all. These kinds of remarks are racist,
nationalist and unacceptable. Even if it is true, the remarks have
been used in a racist fashion. It is totally unacceptable. She either
has to apologize or resign.

These two alternatives would be the choices of politicians in a
democratic country. Also in a democratic country, if she would resist
resigning, the party leader could ask her to resign or she could be
evicted by the party caucus. It shows that the CHP and its present
leadership are far from European standards".

He also added that even if Gul had Armenian blood, that would mean
nothing, highlighting the fact that Turkey has many citizens of
Armenian origin.

"They are full citizens and have the right to become everything,"
and added that in Europe a politician "who would make such racist
remarks would at least have to apologize."

Another representative of the Socialist Group, Jan Marinus Wiersma,said
President Abdullah Gul’s approach to the issue has been very wise.

Joost Lagendijk, the co-chariman of the EU-Turkey Joint
Parliamentary Committee said the CHP should be embarrased about the
remarks. Lagendijk also crticized a complaint filed by President Gul
against Aritman. "Having an Armenian mother is not a shame. Taking
her to court would not be my first reaction. I am afraid it could
imply that he felt insulted by the claims that he could have had an
Armenian mother," he said.

Armenian President Serzh Sargsyan met today with the Human Rights
Defender Armen Harutyunian. Presidential press service told Armenpress
that during the meeting the sides discussed a number of issues on
general situation over the human rights and freedoms in the republic.

As a result of the meeting the president of the country assigned the
Armenian Justice Minister and aide to the Armenian president on legal
issues to conduct service examination over the recent alarms about
usage of force in the prisons of the republic.

The human rights defender expressed readiness to participate in the
conduction of the service examination.

"The grave consequences of March 1-2 are not addressed today. Today
Armenia faces socio-ecomic, moral and psychological crisis," Leader
of the People’s Party of Armenia (HZhK) Stepan Demirchyan announced
today when summing up the passing year.

The HZhK Leader congratulated political prisoner Alexander Arzumanyan
on his birthday and wished him an immediate release. Demirchyan
also condemned the violence against detainee Grigor Voskerchyan
and considered the trail of the case against seven as an utter
farce. Demirchyan said that the publicised eavesdropping of
Arzumanyan’s telephone talks further dispelled the alleged coup
attempts in Armenia.

Stepan Demirchyan noted that the artificial tension during the previous
court ruling might give grounds for the authorities to hold closed
sittings but, in his opinion, a case finding deep resonance in public
should be heard openly.

"The authorities had an opportunity to avoid tough assessments of
the PACE Monitoring Committee but they missed the chance." The HZhK
Leader meant PACE’s recommendation to release people jailed for their
political viewpoints.

Demirchyan thinks that the authorities should free the political
prisoners and start a dialogue with the opposition.

With regard to their further steps, Demirchyan reminded about the
ANC’s intention to hold a massive pan-national rally on March 1.

"The authorities themselves enhance rallies," said Demirchyan grounding
his statement for the fact that the authorities don’t give halls to
the Congress, address the existing problems, release the political
prisoners and make a fair inquiry into the March 1-2 riot.

Today Mr. Demirchyan made rather bleak predictions for 2009: the
international economic crisis has added to the existing problems. The
crisis will pose numerous hardships before Armenia.

In reply to a journalist’s question why the Congress qualified the
Monitoring Committee’s preliminary report as a victory and whether
they do not realise its negative outcome, Demirchyan said he would
avoid using the word "victory." Then he added that people rigging
the election, and hindering the democratic development of the country
should care for the aftermaths.

He noted that Armenia continues ignoring the PACE resolutions. "People
tampering the 2003 elections are still unpunished, A1+ hasn’t
been returned to the air, moreover, they cancelled tenders for TV
frequencies by 2010," concluded Demirchyan

Serzh Sargsyan today had a meeting with Human Rights Defender Armen
Harutyunyan, President’s Press Office reported.

Issues related to the common state of human rights and freedoms,
and the problems existing in this field were discussed at the meeting.

As a result of the meeting the President of the Republic instructed
the Minister of Justice and the Adviser to the President on Legal
Issues to conduct an inquiry connected with the recent signals about
the application of violence in Armenian jails.

Human Rights Defender Armen Harutyunyan expressed willingness to
participate in the conduct of the investigation.

PACE Will Analyse Media Reform And Its Implication On Media Pluralis

"However, we would like to stress that the technical implications
of the introduction of digital broadcasting should not be used as a
pretext to delay unduly the holding of an open, fair and transparent
licensing tender, as requested by the Assembly," holds the report
Georges Colombier (France) and John Prescott (United Kingdom), the
co-rapporteurs of the Parliamentary Assembly of the Council of Europe
(PACE) on the monitoring of Armenia’s obligations and commitments.

The draft resolution on the implementation by Armenia of Assembly
Resolutions 1609 (2008) and 1620 (2008) is already put into
circulation.

Georges Colombier and John Prescott, have drafted a 12-page document
on Armenia. The draft document refers to the recommendations of
Resolutions 1609 and 1620 and their implementation.

Special reference is made to the establishment, by Presidential decree,
of an expert fact-finding group to inquire into the events of March 1
and 2, 2008, as well as to diversity of media environment, amendments
and freedom of assemblies.

Below is an extract from the docuemnt iii. Media reform and pluralist
media environment 44. In Resolution 1609 (2008), the Assembly
considered that the independence from any political interest of both
the National Television and Radio Commission and the Public Television
and Radio Council must be guaranteed. In addition, the composition
of these bodies should be revised in order to ensure that they are
truly representative of the Armenian society.

45. In addition, in Resolution 1620 (2008), the Assembly recalled that
there is a need for a pluralistic media environment in Armenia and,
referring to the Strasbourg Court judgment concerning the denial of a
broadcasting licence to the A1+ channel, called upon the authorities
to now ensure an open, fair and transparent licensing procedure,
in line with the Guidelines adopted by the Committee of Ministers
of the Council of Europe, on 26 March 2008, and with the case law of
the Court.

46. As mentioned in our previous report (Doc. 11656 (2008)), a public
hearing was organised by the National Assembly of Armenia on the
issue of media reform, with the participation of representatives of
the authorities, NGOs and opposition. This public hearing resulted
in a legislative package that was sent to the Council of Europe for
opinion, as well as to the establishment of a parliamentary working
group on the reform of the Law on Television and Radio.

47. Part of the legislative package concerns the implementation of
an open and transparent tender procedure for the composition of the
National Television and Radio Council and for the composition of
the Public Television and Radio Commission. This tender procedure
aims at ensuring the independence of the members and, as a result,
the work of these two bodies. The preliminary opinion of the Council
of Europe experts with regard to this new tender process is generally
positive. As noted in previous reports, the lack of independence of
these two main regulatory bodies for the media raises concerns about
possible government influence over the media that are regulated
by them. We therefore welcome the efforts of the authorities in
this respect. However, we note that the proposed amendments do
not explicitly stipulate that the two regulatory bodies should be
representative and reflect a broad cross-section of the Armenian
society. We would therefore recommend that further amendments are
made to the Law on TV in this respect.

48. On 9 September 2008, the National Assembly adopted an amendment
to the Law on Television and Radio that cancels all tenders for
broadcasting frequencies until 2010, when the introduction of digital
broadcasting in Armenia will have been completed. The amendment extends
the validity of all current licenses until January 2010. While the
government argues that the adoption of these amendments was needed
to address the technical requirements related to the introduction of
digital broadcasting, the opposition has decried these amendments as
an attempt to avoid the organisation of an open, fair and transparent
licensing procedure, as demanded by the Assembly, so as to keep A1+
off the air.

49. We take note of the ongoing discussions between the authorities,
the National Assembly, and Council of Europe experts with regard to
the proposed legislative reform package, as well as the already adopted
amendments to the Law on Television and Radio that cancel tenders for
broadcasting licenses until 2010. We understand that the Council of
Europe will provide an expert opinion on the revised amendments to the
Law on Television and Radio and is ready to provide a "spectrum expert"
to analyse the technical implications of the introduction of digital
broadcasting. In addition, the amendments to the Law on Television
and Radio with regard to the cancellation of tenders for broadcasting
licences was also discussed by the Committee of Ministers in December
2008, in the context of the discussion on the execution by Armenia
of the above-mentioned judgment of the Court in the case of A1+.

50. We do not wish to pre-empt the ongoing co-operation and discussions
on these issues between the Armenian authorities and the relevant
Council of Europe departments. We therefore intend to analyse in
extenso the media reform and its implications on the pluralism of the
media environment in our next report on Armenia in the framework of
the regular ongoing monitoring procedure of the Assembly. However,
we would like to stress that the technical implications of the
introduction of digital broadcasting should not be used as a pretext

Voskerchyan Told About His Sufferings

VOSKERCHYAN TOLD ABOUT HIS SUFFERINGS

Advocate Stepan Voskanyan who presents the interests of detainee
Grigor Voskerchyan announced today that his defendant had been severely
beaten in the "Nubarashen" penitentiary institution on December 23.

Today the office of the Human Rights Defender issued a statement
which runs, "On December 22 detainee Gevorg Manukyan’s Advocate
Inessa Petrosyan reported that her defendant had been beaten in the
Nubarashen penitentiary. She also stated she was denied a meeting
with her defendant."

Following the Ombudsman’s instruction the office representatives
visited the penitentiary and met pre-trial detainees Grigor Voskerchyan
and Gevorg Manukyan.

During a meeting with Ombudsman’s representatives Voskerchyan said
that at about 10.00, December 23, 2008, on-duty Tatul Hakobyan intruded
into his cell with a few other people and began searching the cell.

After inquiring about Voskerchyan’s indictment one of them slapped
in his face and kicked him. The hard blows worsened Voskerchyan’s
state therefore he was late for a December 23 court sitting.

Later Detainee Gevorg Manukyan informed the Ombudsman’s Office that
he had already met his advocate. He refused to comment on the beating
unless he consulted with Inessa Petrosyan.

"RA Ombudsman Armen Harutyunyan condemns the recent violence against
pre-trail detainee Voskerchyan and considers it a pressure against
a prisoner at the bar. Relying on the information submitted by
Voskerchyan the Ombudsman has requested to the Ministry of Justice to
start a probe into the case of violence and punish the wrongdoers,"
holds the statement.

In Karabakh Defence Ministry they have disproved the information about
the death of the Azerbaijani civilian as a result of the cease-fire
regime violation.

‘This is a regular lie disseminated by the Azerbaijani party for
the propagandist purpose and for heating up tension at the border’, –
press-secretary of the NKR Defence Ministry Senor Asatryan told ArmInfo
correspondent. He also added that the Azerbaijani party continues
violating the cease-fire regime from time to time especially at night.

As Azerbaijani pass media reported, the 55 year old resident of
Terter region Asif Sheldiev was allegedly killed by a sharp shooter
when implementing agricultural work.
