The crisis of the Constitutional Court must be resolved soon and it can be resolved through constitutional amendments. RA Minister of Justice Rustam Badasyan said this in a conversation with journalists today, January 30, referring to Prime Minister Nikol Pashinyan’s statement that the constitutional crisis will be resolved soon.
“I also think that the crisis of the Constitutional Court should be resolved soon. As for the law on early retirement, there is time until February 27, and no one can assess whether it worked or not. But there won’t be a bigger tragedy if someone doesn’t apply for early retirement, there won’t be any tragedy if someone does.
I have said that the general crisis in the judicial system and in particular the crisis of the Constitutional Court can and should be resolved by constitutional amendments, because whatever solution we find now, that solution cannot be a 100% basis for restoring public trust in the judicial system. I see the complex solution through constitutional amendments,” said the minister.
Badasyan did not rule out that we will have a completely new Constitutional Court.
Earlier, RA Prime Minister Nikol Pashinyan stated that Hrayr Tovasyan cannot be the president of the Constitutional Court, because he was elected to that position “through fraud”.
For the current authorities of Armenia, the activity of the President of the Constitutional Court is also problematic because Tovmasyan was elected to that position a few weeks before the entry into force of the new constitution, according to the 2005 constitution, allowing him to serve until the age of 65.
Meanwhile, the election for the other vacant seat was organized after the entry into force of the new Constitution, when the judge can hold office for only 12 years, and the president for only 6 years.
